HomeMy WebLinkAboutR-1993-127 ws; cti RESOLUTION NO. 127-93 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, EXPRESSING THE CITY'S POSITION IN CONNECTION WITH THE PLANNED IMPROVEMENTS TO STIRLING ROAD AT SOUTHWEST 18TH AVENUE; AND PROVIDING FOR AN EFFECTIVE DATE. i WHEREAS, the Florida Department of transportation has proposed a plan for the improvement of Stirling Road relative to the connection of Oakwood Plaza within the City of Hollywood, Florida, at S.W. 18th Avenue in the City of Dania; and WHEREAS, S. W. 18th Avenue provides the only means of access to and from I the eastbound lanes of Stirling Road for certain properties within the City of Dania; and WHEREAS, the Burger King at the intersection of S.W. 18th Avenue, the adjacent Krilich property and adjacent existing residential properties have long enjoyed access to i and from the eastbound lanes of Stirling Road from S.W. 18th Avenue; and i WHEREAS, the proposed Florida Department of Transportation plan for the improvement of the intersection of Stirling Road and S.W. 18th Avenue would eliminate E i the access to and from the eastbound lanes of Stirling Road S.W. 18th Avenue in the i City of Dania currently enjoyed by businesses and residents of the City of Dania while I allowing full access to the proposed Oakwood Plaza development within the City of Hollywood; and WHEREAS, the elimination of access to and from the eastbound lanes of Stirling Road to S.W. 18th Avenue would create a severe hardship for residents and businesses abutting S.W. 18th Avenue in the City of Dania, would cause damage to the businesses which utilize S.W. 18th Avenue as the only area access to and from Stirling Road, would cause a diminution of the developable nature of the Krilich property, which is platted and for which a site plan has been approved, and would cause a diminution of the value of the adjacent residential properties; and I f ' I Jwq ON, s I WHEREAS, the harm to adjacent properties caused by the elimination of currently existing access to and from Stirling Road to S.W. 18th Avenue would cause an erosion of the City of Dania's commercial tax base; and WHEREAS, it is in the best interests of the City of Dania, its businesses and its 4. citizens, that the currently existing full access between Stirling Road and S.W. 18th Avenue be preserved; and WHEREAS, an alternative plan has been proposed that would preserve the existing full access to the properties located within the City of Dania which utilize S.W. ' 18th Avenue, and would allow access from Stirling road to the Oakwood Plaza property located within the City of Hollywood; and WHEREAS, the proposed alternative plan provides for a signalized intersection at Stirling Road and S.W. 18th Avenue that would allow or let turns to be made to and from S.W. 18th Avenue to Stirling Road and to and from Oakwood Plaza to Stirling Road but would not allow through traffic between Oakwood Plaza and S.W. 18th Avenue; and WHEREAS, at a public information meeting held on June 29, 1993 at Hollywood City Hall, those businesses and residents of the City of Dania affected by the proposed ' improvement spoke unanimously in favor of the alternative plan;. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: j Section 1. That the above WHEREAS clauses are true and correct recitals and are incorporated herein as if set forth fully. Section 2. That the City Commission of the City of Dania opposes any plan for the improvement of Stirling Road which includes a plan to eliminate access to and from S.W. 18th Avenue in the City of Dania to the eastbound lanes of Stirling Road. `i Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. -ny r qia < Section 4 That the City Commission of the City of Dania supports the v: proposed alternative plan that will preserve access to and from S.W. 18th Avenue in the ` City of Dania and the proposed Oakwood Plaza development on the south side of f r. . Stirling Road in the City of Hollywood. Se ion 5 That this resolution shall be in force and take effective immediately '` upon its passage and adoption.
