HomeMy WebLinkAboutR-1993-195 E k i RESOLUTION NO. 19 5-9 3 I � A RESOLUTION OF THE CITY OF DANIA, FLORIDA, ` APPROVING AMENDMENTS TO ITS CONTRACT WITH SEACOAST SANITATION, LTD., INC. DATED OCTOBER 1, 1991 TO PROVIDE FOR A $.35 PER UNIT PER MONTH INCREASE; A THREE (3) YEAR EXTENSION; PAYMENT OF PENALTY BY SEACOAST; AND CANCELLATION OF CONTRACT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA; k do 1 That that certain Agreement between the City of Dania and Seacoast Sanitation Ltd., Inc. dated October 1, 1991, be and the same is hereby amended as follows: (a) Article II entitled "Term" is amended to read as follows: "The term of this agreement shall be for a period beginning October 1, 1991 and ending September 30, 1999." (b) The first paragraph of Article V entitled "Compensation to Contractor" is amended to read: { "The city shall pay contractor the sum of $12.02 per unit per month. Such monthly payments are due and payable prospectively from the effective date of this amendment on the first day of the month following that for which the services herein described are provided." (c) 'That beginning on October 1, 1996 and ending September 30, 1999, Seacoast Sanitation Ltd., Inc., shall pick up all garbage and trash in the Griffin/Ravenswood area at the same rate per unit that the city is paying at that time for the area east of Ravenswood Road. " Section 2, That the foregoing amendments are subject to the payment by { Seacoast Sanitation, Ltd., Inc. to the City of Dania of the sum of $59,358.50 due to f Seacoast's failure to deliver all refuse to the Reuter facility and the effective date of the Ili said amendments shall be the date on which said sum is paid. lb r I I Section The foregoing amendments are further subject to the agreement of the parties to the original agreement that in the event Seacoast fails, at any time, to deliver all waste collected within the city to Reuter, the entire contract shall become null and void and of no force or effect. } "tec ion 4. MEMORANDUM TO: ROBERT FLATLEY, CITY MANAGER I FROM: WANDA MULLIKIN, CITY CLERK l� SUBJECT: SEACOAST SANITATION LITIGATION DATE: NOVEMBER 10, 1993 i Staff met with Lou Manzella of Seacoast Sanitation today to further negotiate a possible settlement of the litigation between the city and Seacoast. i As a result of the meeting, staff recommends that we offer the following in settlement of I !I the pending litigation: 1. We recommend that Seacoast be required to immediately repay the City of Dania the sum of $59,358.50 due to their failure to deliver all refuse to the Reuter's facility. 2. We recommend that the city agree to a one time increase of $.35 per unit per month in the contract. We feel that this would be beneficial to both parties. The city would benefit in that the next lowest bidder at the time the original bid was received was $1.48 per unit more than Seacoast's. k 3. We recommend that the city grant a three (3) year extension to Seacoast at the end (( of the 1996 contract which would also incorporate pick up of garbage in the Griffin/Ravenswood area at the same rate per unit the city is paying at that time for the area east of Ravenswood Rd. We feel that this would enable the city to charge the same rate to all citizens of the city. Thus, the citizens in the Griffin/Ravenswood area would be paying a lesser amount per month. Note: We recommend that at the expiration of IWS's contract in 1996 that the city negotiate with the contractor picking up the bulk trash in the area east of Ravenswood at that time, to include the Griffin/Ravenswood area, thus having one hauler picking up bulk trash for the entire city at the same cost for all residents involved and to provide the same monthly service. If this was done, the city would be dealing with two sanitation companies in lieu of the present three. As an alternate solution, the city might consider negotiating with Seacoast Sanitation at that time for bulk pick up as well as the sanitation. This would enable the city to deal with one contractor for the entire city for garbage and trash pick up. i i t { 4. We recommend that Seacoast remain liable for any penalties incurred by the city i that may due to their failure to deliver all refuse to the Reuters facility. i 5. We recommend that the contract with Seacoast will be null and void if Seacoast fails to deliver all refuse to the required facility. 6. Except for the above referenced recommendations, the contract terms will remain in full force and effect.
