Coastal Tech shall certify as to the progress and conformity of the work and make all inspections for the City of Dania Building Department. I 5.4 No extension of time shall be granted for delays resulting from normal weather conditions prevailing in the area as defined by the average of the last ten (10) years of weather data recorded in the Fort Lauderdale-Hollywood Airport Weather Station, unless adversely affected by storms or hurricanes. 5.5 The Owner and Contractor agree that if it is determined by the Owner to be feasible, the Owner in a separate contract shall attempt to construct the restaurant and pavilion contemplated by the Fishing Pier Project along with utilities to be connected thereto simultaneously with construction of the pier; however, the Owner and Contractor agree that the work shall be scheduled in such a way as not to delay or hinder the Contractor in his work and that in the event it is agreed as justified, a time extension shall be granted for completion of the work because of any actual interference. Contractor shall be entitled only I! to extensions of the contract time as the sole and exclusive remedy for such resulting delays, in accordance with and to the extent specifically provided above. PAYMENTS: 11. 1 .1 On or before the a-5 day of each month after Work has commenced, the Contractor shall submit to the Owner an Application for Payment ,j; in such detail and on a form required by the Owner based on the Work completed, materials placed and stored beams, concrete piling and wood grates (provided said stored materials shall never exceed SO % for the beams and piling or SO 8 for the grates on Bid Breakdown) ; progress payments to the Contractor shall be in accordance with the Bill of Materials, Bid Breakdown attached hereto, and Article 11. j 9 W i Ni[�: 12.4 .A The indemnification and insurance requirement set forth in the proposal and design for the construction of the Dania Pier by the City of Dania, rr*'9a.0 Department of Parks and Recreation, as set forth in Paragraphs 12, 13 and 14 of the Instructions to Proposers (including builder's risk requirements) are incorporated herein by reference and attached hereto; all reference therein to the City shall be synonymous with the Owner, a/k/a The City of Dania, a municipal ,;s subdivision of the State of Florida. r i Q j ACTUAL D Mer 13.2.3 Upon failure of the Contractor to substantially complete the Construction Phase of the Contract within the specified period of time (plus .:F approved extensions, if any) Contractor shall pay to the owner (City) a sum equal - to the prorates debt service incurred by the City for a 2.1 million dollar municipal bond issue for this Project (hereinafter called "proration amount") , for each calendar day, plus approved extensions, after the times specified in { f '! Article 5 for substantial completion. After substantial completion (as defined herein) should Contract neglect, refuse or fail to complete the remaining work within the Contract Time or any approved extension thereof, Contractor shall pay to the Owner/City the "Proration amount" for each calendar day after the time specified in Article 5 above (plus approved extensions) for completion and readiness for final payment. These amounts are not penalties but liquidated damages to Owner/City. Liquidated damages are hereby fixed and agreed upon ' between the parties, recognizing the impossibility of precisely ascertaining the amount of damages that will be sustained by Owner/City as a consequence of such delay, and both parties desiring to obviate any question of dispute concerning the amount of said damages and the cost and effect of the failure of Contractor to complete the Contract on Time. The { existing pier would be demolished; the timing of demolition will be dependent on a number of variables to be decided upon at a it future date. I f . Included in the new pier complex would be an expanded restaurant/retail complex (min. 2500+ sq. ft. ) , two public restrooms, a bait and supply shop as well as ancillary maintenance areas and utilities . At least two ( 2 ) roofed areas for fishing shall be supplied as well as sufficient + - strategically placed seating (benches ) . Fresh water, salt water, electric, bait wells and cutting tables shall also be included along the pier. The design will be reviewed by the City of Dania engineering consultants and Building 6 Zoning Department, and all regulatory agencies prior to construction. PROPOSER shall submit as part of his proposal, a complete general description and layout of the proposed facility including lighting, stairways, ramps, walkways, bathrooms and security system. The PROPOSER will also submit as part of his proposal a statement listing those agencies he has consulted concerning his proposal and the primary contact at said agencies. The PROPOSER will also submit the primary members of his design and construction team and past experience, qualifications, as well as copies of contractors, and all sub-contractors licenses; engineers, architects ' registrations and companies , registrations certification and licenses in Florida; and from PROPOSER and contractors written authorizations for obtaining credit reports and informatin from creditors, affidavit containing satisfactory information as to status of all litigation in the last ten years . 3. LOCATION: City-owned property at the north end of the city beach, Dania, FL. 4 . PERSONAL INVESTIGATION: PROPOSERS shall satisfy themselves by personal investigation and by such other means as they may think necessary or desirable, as to existing, future, unforseen, natural (weather, storm, tides, etc. ) war, government emergency, tort, riot, arson, sabatoge, strike, inflation, material availability, conditions affecting the proposed work and the cost thereof. No information derived from maps , drawings, specifications or from the city officials shall relieve the contractor from any risk or from the fulfilling of all terms of the contract. The PROPOSER will be responsible for all soil �. testing, weather and tide planning, unforseen delays, adequate i time scheduling, required in the developing of the project. See Appendix "B" . The PROPOSER will be responsible for all fees and .F permits required for this project. ! s . I'r' -2- L! 11. POSTPGtiEMEtiT OF DA'_"E FOR SUBMITTING PROPOSALS : The CITY reserves the right to extend the date for the receipt of proposals and will give ample notice of any such postponement to each prospective PROPOSER. 12. INDEMNIFICATION: The PROPOSER shall indemnify and save harmless ` the CITY, its officers, agents and employees , from or on account of any injuries or damages received or sustained by any person i or persons during or on account of any operations connected with the design, planning, investigation or construction of this i . . } project; or by or in consequence of any intentional act, negligence (excluding negligence of CITY) , in connection with f the same; or by use of any improper materials, design, work, construction or by or on account of any act or omission of the said PROPOSER or his sub-contractor, agents, servants or 4 ' employees . PROPOSER agrees to indemnify and save harmless the CITY from all such claims and fees, and from any and all suits and actions of every name and description that may be brought against CITY on account of any claims, fees, royalties or costs for any invention or patent, and from any and all suits and actions that may be brought against CITY for the infringement of any and all patents and rights claimed by any person, firm or corporation. The indemnification provided above will obligate the PROPOSER to defend, at its own expense, or to provide for such defense, at the CITY'S option, any and all claims of liability and all suits and actions of every name and description that may be brought against the CITY which may result from the operations and activities under this contract whether the construction operations be performed by the PROPOSER, contractors, sub-contractor or by anyone directly or indirectly employed by any of them. 13. INSl1RANCE AEOUZREMENTS: PROPOSER shall be required to furnish evidence of the following insurance coverages by a licensed Florida Company which is rated in accordance to Sec. 16.2 (b) and has at least a "HEST" rating of "A" . 13. 1 Without limiting any of the other obligations or liabilities of PROPOSER, PROPOSER shall provide, pay for and maintain in force until all of its work .to be performed under this contract has been completed and accepted by CITY (or for such duration as is otherwise specified hereinafter) , the insurance coverages set forth herein. 13. 1. 1 Professional liability for the architect in the amount of One Million Dollars ( $1,000,000) with t deductible ( if applicable) not to exceed One Thousand Dollars ( $1, 000 ) each claim. Certificate of Insurance for professional liability shall i reference deductible applicable for this specific project. -4- x l 13. 1 . 2 Workers ' compen:.ation insurance to apply for all employees of the contractor, sub-contractors and the contractor' s architect in compliance with the "Workers ' Compensation Law" of the State of Florida and all applicable federal laws. In addition, the policy( s ) must include: 'r Employers ' liability with a minimum limit of One 4 Hundred Thousand Dollars ( $100, 000) each accident. If any operations are to be undertaken on or about navigable waters, coverage must be included for the U.S. Longshoremen 1, Harbor Workers Act and ' Jones Act. r. !. 13.2 Comprehensive General Liability with minimum limits of One Million Dollars ($ 1, 000,000 ) per occurrence combined single limit for bodily injury liability and property damage liability. Coverage must be afforded on a form no more restrictive than the latest edition of the Comprehen- sive General Liability policy, without restrictive endorsements as filed by the Insurance Services Office and must include: 13.2 . 1 Premises and/or operations; 13.2.2 Independent contractors; 13.2.3 Products and/or completed operations for contracts over $50,000 - PROPOSER shall maintain in force until at least three years after completion of all work required under the Contract, coverage for products and completed operations , including Broad Form Property Damage; i 13.2.4 Explosion, collapse and underground coverages; 13.2.5 Broad Form Property Damage; 13 .2.6 Broad Form Contractual Coverage applicable to this specific contract, including any hold harmless and/or indemnification agreement; 13.2.7 Personal Injury Coverage with employee and contractual exclusions removed with minimum limits of coverage equal to those required for bodily injury liability and property damage liability; 13.2.8 CITY is to be expressly included as an "Additional Insured" in the name of "City of Dania" with respect to liability arising out of operations performed by CITY by or on behalf of PROPOSER; or acts or omissions of CITY in connection with general supervision of such operation. -5- 13 . 3 BusinusJ! :ut iao:;ile liability with minimum limits of Five ❑undredrhousand Dollars ( $500 , 000 ) per occurrence i combined single limit for bodily injury liability and property damage liability. The required Certificates of Insurance shall not only name the types of policies provided, but also shall refer specifically to this contract and section and the above paragraphs in accordance with which insurance is being furnished, and ' i shall state that such insurance is as required by such paragraphs of this contract. Such alternate forms of security shall be for the same purpose and shall be subject to the same conditions as those applicable above and shall be held by the CITY for one year after completion and acceptance of the work. I i 16. QUALIFICATION OF SURETY: 16. 1 A Performance and Payment Bond must be executed by a surety company of recognized standing, authorized to do business in the State of Florida as surety, having a resident agent in the State of Florida and having been in business with a record of successful continuous operation for at least five years . i t , 16 .2 In addition to the above minimum qualifications, the surety company must meet at least one of the following i' additional qualifications : / (a ) The surety company shall hold a current certificate of authority as acceptable surety on federal bonds in accordance with United States Department of Treasury Circular 570, Current Revisions. If the amount of the bond exceeds the underwriting limitation set forth in the circular, in order to qualify, the net retention of the surety company shall not exceed the underwriting limitation in the circular, and the excess risks must be protected by coinsurance, reinsurance, or other methods in accordance with Treasury Circular 297 , revised September 1, 1978, ( 31 DFR Section 223 . 10 Section 223 . 11 ) . Further, the surety company shall provide the CITY with evidence satisfactory to the CITY, that such excess risk has been protected in an acceptable manner. Specific language regarding permits is attached. i I This addendum is also to notify proposers that the City of Dania had previously purchased twenty ( 20 ) eighteen inch diameter prestressed concrete piling as part of the 1992 Dania Pier Renovation Project. The piles were cast in August, 1992 , and are approximately 58 feet long. The piles are the property of the City of Dania and are stored at the yards of Florida Pile, Hollywood, Florida. There are no storage costs associated with these piles and they can be made available to the successful proposer in the performance of work. CONCRETE STRENGTH: At transfer of the prestressing load and tensioning of the post-tensioned beam, the cylinder strength of the concrete shall be 4000 psi. It shall be 5000 psi at 28 days for piles and 5500 psi at 28 days for post-tensioned beams. HANDLING AND STORAGE: During handling and storage, the prestressed units must be picked up at the ends of the units to prevent damage. Engineer will review the Progress Schedule and the Schedule of Values for format and content. A. Progress Schedule: Submit four copies of Progress Schedule ( formally in bar chart form) showing estimated starting and completion dates for each part of the work. The progress schedule shall also include reference as to when approved shop drawings are required. The first progress payment will not be issued until an acceptable progress schedule is submitted. B. If strengths of laboratory controlled cylinders for any portion of the structure fall below specified compressive strengths, the Engineer shall have the right to order a change in proportions of the concrete ingredients to ensure proper quality of concrete for remaining portion of the structure. S . Specimens shall be tested according to ASTM C38-72. l6 . The standard age of test specimens shall be 28 I days, but 3 and 7-day specimens may be used, provided that the relationship between the 3, 7, and 28-day strengths of the concrete is established by test for the materials and proportions used. 1 7 . If, in the opinion of the Engineer, the 3-7 or 28- day test falls below specified values, field load tests or core tests shall be made at no additional expense to the Owner. 1 . 3 SUBMITTALS: As specified in Section 01300. Remove ice and excess water and sprinkle semiporous subgrades sufficiently to eliminate auction. i 4 . Do not place concrete during rain, sleet, or snow unless protection is provided. B. High Slump (Superplasticized) Concrete: The " manufacturer' s competent field service representative shall oversee the placement of the first pour of each different design mix of high slump concrete and shall also oversee all subsequent pours of ASTM C494, Type F superplasticized concrete. i C Depositing: 1 . Handle concrete from the mixer to the place of final deposit as rapidly as possible by methods that will prevent separation or loss of ingredients and ensure that the required quality of the concrete is obtained. 2. Deposit concrete continuously and rapidly enough so that the layer supporting the one being placed is I still plastic. If continuous placement is impossible, locate construction joints where shown or as approved. Do not use partially hardened or contaminated concrete. 3. Remove temporary form spreaders when concrete reaches them. 4. Do not begin placing concrete in supported elements until the concrete previously placed in column and walls is no longer plastic. 5. Deposit concrete as near to its final position as ! possible to avoid segregation due to rehandling or flowing. Do not subject concrete to any procedure that will cause segregation. D. Compacting: 1. Consolidate all concrete by vibration, spading, DANIA PIER RECONSTRUCTION 03301-8 rodding, or forking so that the concrete is thoroughly worked around the reinforcement, around j embedded items, and into corners of forms, eliminating all air or stone pockets which may ; cause honeycombing, pitting, or planes of weakness. i 2. Internal vibrators shall have a minimum frequency of 8,000 rpm. Overvibrating and use of vibrators to transport concrete within forms shall not be allowed. Insert and withdraw vibrators at many points, from 18 to 30 inches apart, for 5 to 15 seconds duration. Keep a spare vibrator on the job site during all concrete placing operations. 3. Compact concrete in slabs thoroughly by means of screede. E. Bonding: Where fresh concrete is to be placed against and bonded to hardened concrete, dampen (but do not saturate) the hardened concrete. If bonding is required j in a critical section, obtain approval from Engineer of 1 method proposed. 3.6 FORM REMOVAL: A. Leave formwork for columns, walls, sides of beams, and other parts not supporting weight of the concrete, in place during curing period. B. Leave formwork for beam soffits, slabs, and other parts that support the weight of the concrete in place until concrete has reached its specified 28-day strength. 3 .7 REPAIRING AND PATCHING: Patch all the tie holes and all repairable defective areas immediately after form removal. A. All honeycombed and other defective concrete shall be removed to sound concrete with edges perpendicular to the surface. Dampen the area to be patched and an area at least 6 inches wide surrounding it to prevent absorption of water from the patching mortar. Mix patching grout to the consistency of thick cream and brush it well into the surface. Use Masterflow 928, Master Builders, or approved equal, for all structural patching. B. Tie Holes: Clean and thoroughly dampen, then fill solid with patching mortar. I 3.8 FINISHES FOR FORMED SURFACES: f DANIA PIER RECONSTRUCTION 03301-9 'r Rough form finish; patch tie holes and defects. Chip off or rub off fins over 1/4 inch in height; otherwise leave surface with texture imparted by the forms. 3.9 SLABS: A. Screeding: After concrete has been thoroughly consolidated, screed slabs to the desired elevation and contours by means of accurately placed edge forms and intermediate screed strips. B. Jointing: 1. Locate and construct joints in slabs on grade as shown. 2. Start cutting saw-cut joints as soon as concrete is hard enough to prevent dislodgement of aggregates while sawing, and complete cutting before shrinkage stresses have developed sufficiently to induce cracking. C Floated Finish: 1. Place, consolidate, strike off, and level concrete, but do not work it further until ready for floating. Begin floating when water sheen has disappeared and when the surface has stiffened sufficiently. 2. During or after the first floating, check planeness of surface with a 10-foot straightedge applied at not less than two different angles, and then cut down all high spots and fill all low spots to achieve a true plane within 1/4 inch in 10 feet. 3. Refloat slab immediately to a uniform sandy texture. D. Troweled Finish: Float finish slab as described above, then steel trowel by machine or by hand. Additional trowelings shall be done by hand after the surface has hardened sufficiently. Final troweling shall produce a ringing sound from the trowel and then finish surface shall be free of trowel marks, uniform in texture, and appearance shall be planed to the tolerance specified j under Floated Finish. j E.
