Proposal of Nabors, Giblin & Nickerson, P.A., to develop Solid Waste s Assessment Program. IRV ru Mark Lawson, Nabors, Giblin & Nickerson, P.A., presented the proposed work plan, fees and Critical Events Schedule for Implementation of (1) a Partial Year Residential Solid Waste Assessment (April 1, 1996 - September 30, 1996) to be collected by Separate Bill and (2) a Subsequent Recurring Annual Residential i r Solid Waste Assessment (October 1, 1996 - September 30, 1997 and T Subsequent Fiscal years) to be collected using the Broward County Tax Bill. n" ar. Mr. Lawson explained that the program will virtually pay for itself since outstanding delinquent amounts will be collected when added to a property owner's tax bill. The City's cost up front can be spread over a few years and any unpaid bills will continue to be rolled over on the property owner's tax bill. Marie Jabalee, Finance Director/City Clerk, recommended approval of the program to change the method of collection of the solid waste fees for the Griffin I area. She requested approval to go forward with advertising the first of four advertisements on November 13 in order to begin the legal process of implementing the collection program for the 1996 tax year. WORKSHOP MEETING 1 NOVEMBER 7, 1995 z r GC ��l $ Vp �J: titi',lh F '1Y The Commission agreed to have staff go forward with the advertising and include ratification of the Solid Waste Program on the next regular agenda. Mr. Lawson agreed to bring proposals back to the Commission for establishing assessment programs for EMS and Stormwater District. 2. Agreement with MADDADS to provide programs at Modello Park. City Manager Smith mentioned that MADDADS has a Chapter in Dania and is a national organization. They are requesting to use recreational facilities and v office space at Modello Park to implement their program activities for youth in �4 Dania. Jacqueline Hampton, Director of Operations for Friends of Children Youth and s Families, presented background information on the non-profit organization that provides educational services and assistance for disadvantaged children and families in Broward County. Ms. Hampton presented an overview of the types of programs coordinated through the Broward Sheriffs Office and Broward County Commission on Substance Abuse. MADDADS (Men Against Destruction Defending Against Drugs & Social Disorders) would provide four part-time staff members to counsel and educate the youth at the Modello Park Recreation Center at no cost to the City. City Manager Smith clarified that the programs provided through MADDADS would be in addition to the City's programs and that the organizations seems to i=t have the support of the community. Vice Mayor Bertino expressed his concern with legal complications using city property to provide drug counseling and impose religious and moral concepts on individuals. Ms. Hampton confirmed that MADDADS is licensed with HRS to provide information on drug prevention and drug counseling of a general nature. MADDADS' Counselors refer clients, with specific drug problems, to other agencies outside their program and similar programs like this are operated successfully across Florida. Ms. Hampton assured the Commission that city employees will be involved in the recreational activities only and not with the values training, personal hygiene and counseling programs. City Manager Smith suggested that the programs could be tried out at the park and that the City would not be obligated to continue the programs if they did not work out. The Commission requested staff to provide further information on the values curriculum that will be provided as well as information on how the programs are working out in other cities. 3. Proposal by Dania Pier Management Inc., to operate beach water sport concessions and acquisition of lease for Dania Beach Grill. WORKSHOP MEETING 2 NOVEMBER 7, 1995 j pig LM n. City Manager Smith advised that Dania Pier Management, Inc. will not be presenting information on the acquisition of lease for Dania Beach due to new developments but will present their request for water sport concessions. Don Streeter, Dania Pier Management, Inc., presented his business proposal to operate four waverunner rentals and other water sports at the beach. For additional safety purposes, a kill switch and chase boat will be provided on each vehicles and they will be operated 300' north of the pier. Tom Zannucci, Dania f Pier Management, Inc., explained that each waverunner will have its own liability insurance and the remote kill switch is good up to two miles away. ' Mr. Streeter mentioned that Fort Lauderdale recently awarded a contract for waverunners to be operated at their beach and that the company is not offering the safety factors that his company is offering. Discussion followed on providing a 20 foot lane for the waverunners to enter the water and return so as not to interfere with the surfing activities at the beach. Mr. Streeter and Mr. Zannucci were agreeable to a trial basis approval for the operation before entering into an agreement. I . The Commission directed staff to obtain a copy of the Ft. Lauderdale Agreement, insurance information and to contact John Lloyd Park regarding the waverunner operation. S Mr. Streeter presented his second idea to operate a pontoon boat to provide water taxi tours for 10 people at a time from the Dania Cut-off Canal . The Commission generally agreed that this would be a good way to promote the Dania Waterways and to have Mr. Streeter bring back a proposal. i. a. Byrd Park Improvements. Commissioner Jones expressed his dissatisfaction with the selection of bahia grass and the width of the running track at Byrd Park. He stressed the need for projects like this to be watched very careful to ensure that the contractors are completing the improvements correctly according to contract requirements. City Manager Smith explained that bahia grass was selected by Dan Oyler, City Planner, and Mardie Holloway, Parks Coordinator, because it is one of the most hardy grasses which can take a lot of activity. Mr. Smith thought that the track could be widened later if there appears to be a need to do so. Commissioner Jones disagreed with waiting to widen the track later even if the City must pay the extra cost. Dan Oyler, City Planner, presented his reasons for selecting bahia grass for the park. He agreed to speak with the contractor to find out what the cost would be WORKSHOP MEETING 3 NOVEMBER 7, 1995 1 t 7 x r to increase the size of the running track and to reduce the hedge at the front entrance of the park. Discussion followed on safety concerns for the children who are fishing from the bridge instead of using the 14th Street Dock that was recently built. 5. Development of RFP to operate sports programs at City Facilities. City Manager Smith mentioned the problems that have occurred in the past at Meli Park with the Griffin Little League Association due to inappropriate behavior and substance abuse by members. Mr. Smith requested permission to advertise for an RFP to operate sports programs at the parks or take action to ban >-- individuals who are creating problems. The Commission directed staff to contact Little League Headquarters regarding the behaviors of some of their members at Meli Park in an effort to resolve the i matter. s. Membership in Broward League of Cities. Commissioner Mikes mentioned his attendance at a recent Broward League of Cities' meeting which involved a presentation by the County Charter Review Committee. He felt that a major shift in power was accomplished when action was taken to direct the Broward League to make a request to the Broward + County Commission to allow 51% of the population, as made up through cities, A,. to put items on the Charter Ballot independently of the County. Based on these t i new developments, he recommended that the Commission renew their membership in the Broward League of Cities The Commission agreed to wait until one or two Commissioners have attended a Broward League of Cities Meeting before renewing the membership. I 7. Formation of an Education Advisory Board. Commissioner Jones expressed the need for establishing an Education Advisory Board to assist the community in dealing with the School Board on issues relating to schools. Discussion followed on checking with the schools to see if there are school committees already established that could represent the City at the School Board level before taking any action to create another board. Staff was directed to speak with the Human Relations Board to see if this function could become part of their responsibility. WORKSHOP MEETING 4 NOVEMBER 7, 1995 .a . 1 e. Discussion of Seafair Marina, Commissioner Mikes recommended to review the legal language carefully in the proposed Seafair Lease to protect the City's rights in regards to the parking area and marina. Discussion followed on whether the City should run the marina instead of Aragon Group, Inc. City Manager Smith advised that FAU did not want the marina in the lease and that he does not believe the City can profit by operating the marina. Commissioner Mikes expressed his dissatisfaction with the way the lease negotiations have been conducted with FAU and Aragon U Group, Inc. City Manager Smith did not believe changes could be made to the proposed lease but agreed to speak with Attorney Karl Adler regarding the possibility of the City operating the marina. Craig McAdams, Chairperson on the Marine Advisory Committee, mentioned that the City may be eligible for grant funding for improvements to the marina area at the beach and that the marina would be a revenue producing operation for the City. If the City wishes to pursue the Tax Bill Method of Collection for any or all of these vital services effective for FY 96/97, the Public Hearing, proceeded by 4 weekly published notices, must be held before 1/1/96. The notices must be published beginning November 12, 1995. Adoption of the Resolution does not commit us to this billing method, but reserves our right to do so. ("NG&N") and Government Systems Group, L.C. (KGSG") to provide the City of Dania (the "City") with client references, we have listed the names and telephone numbers of two individuals 1 the City should contact, as follows: Mark H. Although each community's program is different, we know you will find their insight and experience with our firms informative and positive. As promised and in anticipation that the City desires to {s A£ 9*g.Ye its ability to collect the solid waste collection and it. disposal assessments on the tax bill beginning in fiscal year 1996- 97, I am providing you with the following documents. Although our proposed workplan included the preparation of these documents, we are providing these in advance and as a courtesy because the timing of the publication and adoption of these documents is critical. r 1. A form of Notice of Intent for the potential solid waste collection and disposal services assessment program which should be published in a newspaper of general circulation in order to use the uniform method of collection; and 2. A form of Resolution for the potential solid waste collection and disposal services assessment program electing to use the uniform method of collection. Please note that Appendix B of the enclosed form of Resolution requires a legal description of the City of Dania 's boundaries. �;; .. Section 197. 3632 , Florida Statutes, requires that the City must hold a public hearing and adopt a resolution of intent to use the uniform method of collection for any assessment program in the ' calendar year prior to any such collection. The resolution, which "` - dnas� nat obligate the governmental unit to use the method or impose a special assessment, must be adopted by January 1 and sent to the Broward County Director of Revenue Collection, the Broward County Property Appraiser and the Department of Revenue by January 10. If the County's Property Appraiser and County's Director of the Department of Revenue Collection agree, adoption of the resolution can occur as late as March 1st. However, we strongly recommend to you that the City adopt the resolution prior to January 1st, as the consent of the County's Property Appraiser and the County's Director of the Department of Revenue Collection is not required when the adoption occurs prior to January 1. Jabalee October 25, 1995 Page 3 As well, section 197.3632 requires notice of the public hearing to adopt the resolution of intent for the four consecutive weeks immediately preceding the date of the hearing. Please note that we have assumed a public hearing date for the resolution of intent adoption of December 12, 1995. Should the City decide to change the date of the public hearing, the publication dates for the notice should also be changed to conform with the aforementioned requirement. l� We have prepared a notice and form of resolution for the City S , of Dania which specifically references the potential residential solid waste collection and disposal services assessment program and reserves to the City Commission the ability to impose assessments y in the incorporated area. This package only assists the City in meeting statutory notice requirements necessary to preserve this funding approach. To reiterate, this resolution is non-b:ndina and the City Commission may reduce the areas covered by any future assessments or decide not to go forward with the assessment program 2 at a later date. By adopting the attached resolution, the City Commission is simply reserving the right to use the tax bill collection method beginning in November of 1996. We understand the City is also contemplating the development of assessment programs to fund emergency medical services and stormwater management services and facilities and the use of the tax bill collection method to collect these assessments. If the City Commission wishes to preserve the right to use the tax bill collection method for fiscal year 1996-97 for these proposed assessments, we would be pleased to discuss these programs with you � - as well, and provide the City with the appropriate documents in time to publish the notice of intent public hearings concurrently with the solid waste assessment ram ro p g publication. (IING&NII) prepare a proposal to provide specialized assistance to the City of Dania (the "City") , its staff and general counsel in the implementation of a I. solid waste collection and disposal assessment program for residential properties within the annexed area of the City. From our telephone conversations with you, the City desires to include previously unpaid and delinquent assessments in a partial year billing for the period April 1, 1996 through September 30, 1996 and thereafter, using the authorization in a home rule assessment ordinance, seek to collect an amount equivalent to all prior unpaid assessments as a part of the Fiscal Year 1996-97 assessment to be collected on the tax bill. Attached as Appendix A is a work plan which articulates anticipated special counsel and non-legal consulting services required to assist you in implementing a partial year special assessment program which specifically addresses the City's delinquency problems. This activity is to be accomplished in a manner that is conducive to the subsequent imposition and collection of the special assessments via the uniform method of • r a 1 er ' vl M fS t Marie J. Jabalee October 19, 1995 Page 2 collection in conformance with the provisions of Section 197.3632, Florida Statutes. Accordingly, this engagement will necessarily have two distinct, but overlapping phases: the first phase dealing with the imposition of the partial year assessment for the period April 1, 1996 through September 30, 1996 and the second phase, that will address the transition to the imposition and implementation of a subsequent recurring annual assessment to be collected on the tax _ bill beginning Fiscal Year 1996-97. We have also attached as Appendix B and C respectively, an hours and fees matrix and critical events schedule to assist the City in understanding the magnitude of the work effort required to develop and implement the proposed assessment program on a task-by- task basis. Upon notice to proceed, we would expect to provide a more detailed critical events schedule. To accomplish the objectives of each of these project phases, s we would focus on the following essential tasks: i • provision of both legal and implementation services relative to developing a method of apportionment conducive to use with the County's ad valorem tax roll data base; development of the necessary legal and implementation ' documentation for both the partial year and recurring annual ? ± collection methods; legal advice and development of documentation to address the it � Cy's desire to collect "bad debt", and r r' development of an assessment roll conducive to collecting both the partial year and recurring annual assessments. 1 L' ' Being well versed in the logistics of implementation of all types of assessment programs and familiar with the City's other RRR i potential assessment programs (emergency medical services and stormwater management) , we see a distinct opportunity for the City to use the solid waste assessment program as a laboratory model to develop a working base for its apportionment methods related to other potential assessment programs. The work effort in developing an assessment roll, the software application and the resulting data base are all work product that can also be modified and applied in developing the emergency medical services and stormwater management assessment programs, if the City desires to move forward with either program. Our experience has taught us that the City will need to use certain technical expertise in developing the assessment roll. Accordingly, we will utilize Government Systems Group, L.C. ( GSG ) , to assist us in the development of this solid waste S s a �!in- Marie J. Jabalee October 19, 1995 Page 3 assessment program. GSG is an affiliated company created and s partially owned by NG&N to provide non-legal systems consulting services to the public sector. Camille Gianatasio, and other members of GSG, have successfully assisted in developing apportionment methodologies and assessment rolls on several of our previous projects which have specifically addressed similar problems facing the City. The collective skills and experience of GSG are fundamental to our proposed work plan. The following implementation deliverables will be provided during this project: • a home-rule service assessment ordinance and all requisite implementing resolutions for the partial year and recurring annual assessment programs; • the statutorily required notice and billing documentation required for utilization of the tax bill collection method for the recurring annual assessment program: • billing algorithms necessary to calculate residential solid j waste assessments pursuant to the approved methodology for both programs; and, an assessment roll in an electronic format capable of billing the partial year assessments and merging with the Broward County real property assessment roll in conformity with the requirements of utilization of the tax bill collection method for Fiscal Year 1996-97. t The attached scope of services contemplates that the City will provide the necessary budget background information and the data required to develop an assessment methodology, provide staff to conduct any field research of the data contained on the ad valorem tax roll, if required, and provide policy direction regarding various components of the methodology. GSG and NG&N will share their experiences and expertise and provide advice, research, and opinions to you and other City officials regarding the proposed methodology and proposed rate structures, and provide advice and assistance in the development of the assessment roll required to implement and collect the assessments using a separate bill or the tax bill collection method. For services provided by both NG&N and GSG, we will work under a lump sum fee arrangement described in the attached scope of services and defer payment on a percent completed basis. A lump sum method of compensation eliminates any uncertainty in the total fee. However, if preferred by the City, both NG&N and GSG are willing to provide services on a hourly basis. Under such an r Marie J. Jabalee October 19, 1995 Page 4 arrangement, the City would receive a detailed invoice and be billed for time and actual costs incurred on a monthly basis. In addition to any lump sum or hourly fee, GSG and NG&N will seek monthly reimbursement for actual costs incurred, such as photocopies, long distance telephone charges, and overnight delivery services. Any travel expenses would be in accordance with Section 112.061, Florida Statutes. We trust this work plan and proposed fee is in response to your inquiry. There are three points which the City should keep in ;._.mind while evaluating the attached work plan. First, this r ' engagement entails two separate but overlapping projects. Second, the City will be able to recover all of the costs of implementing =' this assessment program including both the City's expenditures and our fees. Lastly, the work effort to develop and implement the solid waste assessment program will make subsequent programs easier w to implement, thus providing an economy of scale on this and any subsequent assessment program. e; We look forward to working with the City of Dania on this very t *ri important project. Gianatasio r a APPENDIX A PROPOSED SCOPE OF SERVICES i�i75 r x r i i Y k �Y s E City of Dania Proposed Solid Waste Assessment Program Scope of Services 1) Evaluate existing City legal documents, franchise agreements, reports and other data pertaining to the provision of residential solid waste collection and disposal services in the City of Dania. 2) Research and evaluate outstanding issues and assist the City in identifying policy decisions necessary to collect past, present and future residential solid waste assessments. This includes the analysis of how to collect the outstanding "bad debt". ng - 3) Develop method of apportionment, classification of residential properties and the use of the data on the ad valorem roll during the process of creating the special assessment roll. Review the assessment methodology for legal sufficiency and compatibility with the tax bill method of collection. Ensure that the data approach used for the separate partial year billing in April of 1996 is the same data needed for the tax bill collection method in subsequent years. 4) Draft a home-rule service assessment ordinance which provides the City with the flexibility to impose and collect past, t present and future solid waste assessments. 5) Create a partial year assessment roll by merging the City's existing customer account list with Broward County's most - recent ad valorem tax roll. Fee and Costs For services provided by both NG&N and GSG, the lump sum fee for the proposed scope of services will be $85, 080. The lump sum would be due and payable under the following schedule: $50,080 upon completion of the partial year assessment billing cycle and $35, 000 on September 30, 1996. In addition to the above lump sum fee, GSG and NG&N will seek monthly reimbursement for actual costs incurred, such as Photocopies, long distance telephone charges, and overnight delivery services. Modello Park is located in and operated by the City of Dania(hereafter referred to as the City). Friends of Children,Youth and Families, Inc.(Hereinafter referred to as Fiends of children) is a non-profit agency whose mission is to advocate and provide services for youth and the unempowered citizens of South Florida.
