The Commission began the Quasi Judicial Hearing at this time is The Chamber Presentation was heard at the end of the Quasi Judicial Hearing I "Laura Piccolo, Vice President of Governmental Affairs for the Dania Chamber, repotted that new officers have been appointed for 1995 and that Chamber updates will be presented on a quarterly basis instead of a monthly basis. All other Vice Presidents remain active Ms. Piccolo explained that the Chamber held a successful 56th Annual Installation and Awards Banquet on February 4 at the Graves Museum of Archeology and Natural History and that Awards were presented as follows: Joe Dorsey- Outstanding Citizen Award Peggy Breeschoten - Outstanding Senior Citizen Award Wanda Mullikin and Frank Adler-Pioneer Citizen Award ( r Pedro Hing-Humanitarian Award The monthly Breakfast was held at the Hilton Hotel and City Manager,Robert F. Flatley presented information about the completion and opening of the pier. The last Business Card Exchange was held at Flossie's Bar& Grill and the Executive Board Meeting is being held tomorrow night. (First Ordinance Reading) Commissioner Hyde expressed concern that the City may be taking zoning action on property that may be condemned by the County in the near future and whether this would 4� have an affect on current litigation with the County. Mayor Mikes questioned whether the principal property owners are required to disclose 4 their identity on a rezoning request. The petitioner came forward to state that the Droperty owners are Peerless Investment Company based in Chicago, Illinois and that aniel J. O'Shaughnessy is the President. REGULAR MEETING 4 FEBRUARY 28, 1995 Commissioner Jones questioned why they are changing from I-G to IRO zoning and Mr. Allen mentioned that there is little difference in the zoning classifications exceppt that IRO allows some Special Exceptions that the petitioner would like to apply for in the future. Mr. Allen explained that the Planning& Zoning Board recommended approval of the rezoning as the proposed IRO zoning district is consistent with surrounding zoning as well as the land use designation on the Comprehensive Plan which is Employment Center. The Planning & Zoning Board did indicate two limiting factors to the site; the wetland situation on the property and that development can only take place on the 5 acres of property at the west end. Mr. Allen confirmed that this is one of the areas that the Broward County Aviation Department is considering for purchase in regards to the airport expansion project and that staff was required to proceed with the request anyway. Mr. Leigh Kerr, representing Peerless Investment Company, mentioned that the owners have spent a good five years working with the Army Corps of Engineers and Florida y Department of Environmental Regulation to obtain permits. Mr. Kerr described the western section of the property that can be developed and the existing trade zone building on the site. He requested approval of the zoning that is consistent with the Comprehensive Plan and understood that the Commission would have to approve any future special exception use and site plan. Vice Mayor Grace and Commissioner Bertino felt that the ordinance could be adopted on first reading and a final decision can be made on second reading. City Attorney Adler didn't feel that there is any problem with upgrading the zoning even if the County may condemn it in the future. a mentioned that the County will also have to obtain permission from the City to change the zoning to transportation if they want to use the property for airport use. A motion was made by Vice Mayor Grace, seconded by Commissioner Jones to adopt the ordinance on first reading with the stipulation that the petitioner provide disclosure i information prior to the second reading. STTE PLANS 5.1 SP-37-94-Request by Second National Acceptance Corporation for modification of site plan approval for the commercial recreation facility located at 1700 NW First Street. F`f Will Allen, Growth Management Director, presented a request for a building addition to the arcade building at the Grand Prix Race-O-Rama. The building will be located by the batting cages and meets all the requirements of the zoning code. Mr. Allen explained that E REGULAR MEETING 5 FEBRUARY 28, 1995 A ri . c 44 , the parking, landscaping and utilities are in place and that a request will be forthcoming on a dedication of a water main that has been relocated on the site. A motion was made by Commissioner Hyde, seconded by Vice Mayor Grace to approve the modification of site plan approval for the commercial recreation facility located at 1700 NW First Street as requested by Second National Acceptance Corporation. EXPENDITURE REQUESTS 7.1 Approval of invoice from Bailey Hunt Jones &Busto in the amount of$3,424.76 for l the period ending January 31, 1995, for airport related services. (Staff) A motion was made by Commissioner Hyde,seconded b Commissioner Bertino to y1 approve the expenditure for Bailey Hunt Jones& Busto for airport related services. Mr. Bruckner left the meeting. i 8. DISCUSSION AND POSSIBLE ACTION 8.1 Law Enforcement Trust Fund request by the Broward Sheriffs Office District II Dania. Chief Frey presented his request to purchase some equipment for around $17,000 from the Law Enforcement Trust Fund and advised that a quarterl report has been provided to the City that shows how the funds are replenished from confiscated items. A motion was made by Commissioner Bertino, seconded by Vice Mayor Grace to approve k„ the request for BSO to purchase equipment in the amount of$17,182.00 for the bicycle patrol, community policing effort, I.D. Kids Program and Camera equipment for the holding cell. Commissioner Jones asked that there be more policing provided in the community by . BSO. Vice Ma or Grace stated that there have been some positive results in reducing crime over the past few weeks. Chief Frey reported that there will be more visibility seen over ;}y the next 60 days and reminded the Commission that BSO is hosting a breakfast workshop REGULAR MEETING 6 FEBRUARY 28, 1995 - r 'gym for the clergy in Dania on Saturday at 9:00 a.m. at the Hilton Hotel in an effort to work closer with the community. The motion passed on the following roll call vote: Commissioner Bertino-yes Commissioner Hyde-yes Commissioner Jones-yes Vice Mayor Grace-yes Mayor Mikes-yes 8.2 Recommendation for amending the occupational license code by the occupational "t license committee. Commissioner Hyde asked for an u date from staff on their recommendations in changing some of the Occupational License Fee amounts as nothing has been accomplished since the October 25, 1994, meeting with the Review Committee. City Manager Flatley mentioned that the Review Committee recommended nine new classifications with proposed fees and to make adjustments to five existing classifications to be more in line with other cities. Eula Gardner, Admin. Asst./Occupational License Clerk, felt that there are enough `.;' businesses in the nine new classifications to warrant individual categories instead of being •i' placed under the un-classified section in the ordinance. Mayor Mikes asked Ms. Gardner to pprovide financial information as to the impact and profit that the changes would provide. gv°' Ms. Gardner agreed to provide a financial breakdown on the fees but mentioned that the current charge for the nine new classifications is $125.00 each. l Will Allen, Growth Management Director,explained that the Occupational License Fees c are not used to support his department and that these fees are normally handled through r the City Clerk's Department in other cities. 4 City Manager Flatley commended Eula Gardner for her hard work efforts to address the changes in the law with Occupational Licenses which has resulted in an increase in revenue { to the City. The Commission agreed to have an ordinance prepared on the nine new classifications and '?} to have the City Attorney review the car rental category. r 8.3 Lack of adequate Alandco buffer for Dania residents. K: City Manager Flatleyexplained that ropert owners sent a letter in response to a notice of p y R an Administrative Variance filed by Home Depot which is in Hollywood and located on the Alandco property. The letter triggered a public hearing being set and Home Depot withdrew their Administrative Variance request. No action has been taken to construct a s noise barrier wall to protect residents along the canal being impacted by the loading and r unloading from Home Depot. Mr. Flatley mentioned that Will Allen, Growth Management Director, wrote a letter to Hollywood in January and visited the Zoning Department regarding the matter and no one seems to feel that a noise barrier wall is necessary. City Attorney Adler explained that the individual homeowners could file a suit against Hollywood but that Dania could not take action since Dania property is not being implcted. He mentioned that the DRI order with Hollywood needs to be looked at to see if they are required to provide the wall. Mr. Allen mentioned that the DRI order requires an open space buffer along the canal. The developer did not have to purchase the open REGULAR MEETING 7 FEBRUARY 28, 1995 v G a s space area and they believe that the industrial property does not abut the residential property. Discussion followed on the need for the residents to go to the Hollywood City Commission to complain as Dania cannot really do anything in the matter. The Commission agreed to have a letter drafted from the Mayor to the City Commission of Hollywood requesting them to review the action taken by their staff in this matter since residents are being impacted and to make a formal request for them to provide some relief. If no response is received from Hollywood, then Dania can pursue action through the Legislative process since a DRI order is involved. Mayor Mikes asked that the letter be copied to Representative MacKenzie and Senator's Forman and Jenne. Mr. Allen stated that representatives from Alandco and Home Depot have made it clear that they have no intention of constructing a wall and that Home Depot has indicated that they are going to plant a row of Green Buttonwood Trees. Mr. Allen stated that normally a wall would be included in this type of buffering. ti 8.4 "A Resolution Of The City Of Dania, Florida, Approving Change Order No. 1 Submitted By Coastal Systems International, Inc. To Deduct The Amount Of$2,760.62 From The Landscape Portion Of The Contract And To Extend The Contract Time To July 31, 1995, For Final Completion Of The Dania Ocean Pier; And Providing For An Effective Date." is C City Manager Fladey mentioned that the change order providing a credit of$2,760.62 was previously discussed at the last workshop meeting with Kevin McCabe, Coastal Systems International,Inc., and it covers a credit for landscaping, an extension of time to remove the debris and to extend the expiration date to July 31, 1995, for the Pier. Marie Jabalee, Acting City Clerk, advised that the Resolution needs to be amended to include Murphy Construction in the title since it is their contract that is being amended { not Coastal Systems International. Commissioner Bertino uestioned whether the resolution should be amended to state that the extension toluly 31 is for the debris removal and not for final completion. City Attorney Adler stated that the reason is listed in the Change Order. A motion was made by Commissioner Hyde to amend the resolution. The motion was withdrawn by Commissioner Hyde. A motion was made by Commissioner Hyde,seconded by Commissioner Bertino to defer adoption of the resolution approving the Change Order to the next regular meeting until clarification can be provided on the amount of credits and amount being withheld for the debris removal. ti The motion passed on the following roll call vote: t` Commissioner Bertino-yes Commissioner Hyde-yes Commissioner Jones- yes Vice Mayor Grace-yes Mayor Mikes-yes 8.5 Request for revival meeting on City property located between cemetery& Byrd Park. Will Allen, Growth Management Director, presented a request to hold a revival by Boyd ` Outreach Evangelistic Ministries on city property between the cemetery and Byrd Park from March 10 to 23 which is between Ely and Phippen Road. Mr. Allen mentioned that „r the request includes a 4x8 sign and that the Commission may want to include conditions on the noise impact to the residents across the track. ° REGULAR MEETING 8 FEBRUARY 28, 1995 i r City Attorney Adler advised that religious services are not allowed at the I.T. Parker Community Center or any city property which is in accordance with separating Church and State. Rev. Frank J. Boyd, Sr. explained that the major emphasis of the revival is to provide evangelistic effort in the community and to work with the young people. Rev. Boyd stated that ley are willing to pay for insurance, inspections and whatever costs that are necessary. th Mayor Mikes stated that cities operate by tax revenues and need to remain independent from subsidizing any church or group of churches and that this request does not involve a Dania church. Vice Nlavor Grace mentioned Dania's desire to work within the community with tax paying citizens and her inability to support the request. Rev. Bovd mentioned that he would not be too disappointed if the request is not approved and understood the City's position. A motion was made by Commissioner Hyde, seconded by Commissioner Jones to deny the request. The motion passed on the following roll call vote: Commissioner Bertino-yes Commissioner Hyde-yes Commissioner Jones-yes Vice Mayor Grace-yes Mayor Mikes-yes ADDENDUM 8.6 City Manager Flatley mentioned that the City made a counter proposal to Steve Snyder on the Seafair property to receive half of what he receives from FAU on the proposed ocean engineering center at the beach. He mentioned that FAU cannot pay anymore for the property than the amount of the appraisals and that the appraisal work is nearing completion. Karla Coleman, FAU, mentioned that the appraisers expect to have some information for her by the end of the week and that negotiations cannot be completed by the time the f;. referendum question is presented to voters on March 14, 1995. She expressed a desire to i f: w' continue to tie otiate with the City and to provide information on the project as it g s- bl becomes available. M . - Mayor Mikes stated that the City of Dania is not in any position to turn prime beach propem over to FAU for their facility without any compensation and that FAU and Aragon Group should not expect this of the citizens of Dania. Ms. Coleman stated her understanding of this position and her hope that negotiations can be worked out. Commissioner Bertino explained that the citizens are being asked to vote on a proposal j.. that is not definitive and that the City should continue to negotiate for a deal that is better than what is currently received from Seafair. ; Y Y Mayor Mikes felt that Ara on Group has been in default of their contract and that legal r action should be pursued along these lines so that the property could be leased to someone who really wants to promote it. REGULAR MEETING 9 FEBRUARY 28, 1995 s 2Y�s� y Commissioner Bertino questioned the City Attorney on whether the City could find Aragon Group in default of their lease. City Attorney Adler explained tliat the building does not belong to Aragon Group as the building was built on City property and is subject to the lease. Mr. Adler stated that as longas Aragon Grou pays the rent the can use the "< building which they say cost them betwen 8 and 9 million dollars. Mr. Adler explained that Aragon has only been paying minimum rent and that the City expected the place to be operating with restaurants and stores. The city was suppose to receive a percentage of the profit but this only happened for a short time before Seafair shut down. 8.7 City Manager Flatey reminded the Commission and public that the pier will be opening in about one week and that the formal dedication is scheduled in conjunction with the Dania Lion's Club One-Ton Tug on March 18, 1995. 10.APPORVTALENTS 10.1 Appointment of 1 member to the Airport Advisory Board was continued to the next t regular meeting. 1= 10.2 Appointment of 1 member to the Unsafe Structures Board was continued to the next regular meeting. 10.3 Appointment of 1 member to the Downtown Redevelopment Agency and Dania Economic Development Board was continued to the next regular meeting. s ; Y 11.ADAEMSTRA77 VE REPORTS City Manager City Manager Flatley reminded the Commission and public that the next regular meeting is on March 15, 1995, due to the elections on March 14, 1995. Further comments related to concern that Gloria Daly has become seriously ill. ' City Attorney - no comments a y. 12. COMUSSION COMMENTS 12.1 Commissioner Bertino mentioned his visit at the Dania Retirement Home that honored the "Volunteer of the Week." 12.2 Commissioner Hyde suggested to rezone vacant property to increase the City's tax r base. 12.3 Commissioner Jones mentioned his recent visit to the Dania Retirement Home and complained about the location of a dumpster near the home. He commented on vacant properties that are used for drug houses and encouraged the public to vote in the upcoming election. Commissioner Jones mentioned his recent speaking engagement at BCC for Black History Day and how gratifying it was to see his students pursuing education. 12.4 Vice-Mayor Grace advised that she also attended the Dania Nursing Home "Volunteer of the Week"event. As You may know, the state of Florida has one of the most ambitious and cost-effective land buying programs in the country. Created by the Florida Legislature in 1990, this 10 year, 03 billion, program seeks to purchase high priority environmentally sensitive lands in Florida to enhance the quality of life for this and future generations- Scientific calculations predict that all remaining natural areas in Florida by the turn of the century will either be protected or developed. Therefore, the ratio of developed land to open i space depends heavily on the continued funding of Preservation 2000. To meat the $3 billion goal of Preservation 2000, the Florida Legislature must raise $300 million annually through the sale of state revenue bonds. This means that every year the legislature must appropriate funds to pay the first year debt service an each bond series. Preservation 2000 debt service(the amount Florida must pay each year in principal and interest for the combined series of P2000 bonds) is about $25 million per year per series. Funding for the debt service comes from documentary stomp tax revenue. Increases from 1990 through 1992 will generate enough funds to cover the debt service on all ten series without the need for new tax increases. Halfway to its commitment to preserve the slate's environmentally sensitive lands, Preservation 2000 will have been funded a remarkable $1.5 billion, with the annual cost for interest and principal estimated at 20% less than predicted. ' The tangible results are overwhelming. To date, over 500,000 acres of Florida's natural beautyhave been saved. Places like Topsail Hill Beach in Walton ;e County and the Archie Carr See Turtle Refuge in Brevard County will exist as they did thousands of years ago. Rivers and aquifers have been safeguarded to ensure future water supply, and endangered species, like the Florida Panther and the Florida Black Bear can thrive In protected wildlife habitats. Yet, we are only halfway into reaching our goal of protecting what will otherwise be lost forever. Florida's rapid growth puts a serious strain on our nature) resources. Each day, 450 new residents pour into our state. Five Florida counties , rank in the top 25 for growth in the nation. The State of Florida's tax revenue is growing faster than projections. In 1994, the state will collect more taxes than had bean astimated. The documentary stamp tax, which is the major source of preservation 2000 funds, Is growing faster than projections. There is plenty of money in this growth to fund Preservation 2000 without affecting the baseline budgets of other state programs. THE STATE BUYS ENVIRONMENTAL LAND IN BIG TRACTS AND LOCKS IT AWAY FROM THE PUBLIC. All Preservation 2000 lands are open for public use. There is a lag time between purchase and the development of capitol facilities such as parking lots, roads and a: restrcoms. Funds to manage lands are already provided from an earmarked portion re of the CARL and Save Our Rivers land acquisition funds. Despite the delay, it is r. ! Important to move ahead to save lend while we can. I UNDERSTAND THAT THFRE ARE HUGE BALANCES IN PRESERVATION 2000 ACCOUNTS. THE STATE CAN'T SPEND THE MONEY IT HAS. Most of the Preservation 2000 account balances are encumbered or targeted to specific land acquisition projects. It often takes many months to negotiate and close a major real estate deal. State officials try to negotiate the best possible price for the public dollar. This is complicated by cumbersome regulations and red tape. Preservation 2000 supporters hope to streamline the land acquisition process to allow more land to be saved in a timely manner. PRESERVATION 2000 IS TAKING TOO MUCH LAND OFF THE TAX ROLLS. RURAL COUNTIES CAN'T AFFORD TO LOSE THAT REVENUE. Preservation 2000 is supported by both the League of Cities and the Association of Counties. Local governments are impacted by land preservation: some impacts are positive, some negative. The positive impacts include parks and open spaces which the local government would otherwise have to pay for with proporty taxes. And small rural counties can be reimbursed for tax loss form public land acquisition through the 19.92 Public Lands Bill. THERE'S NOT ENOUGH MONEY TO MANAGE THE STATE'S LAND NOW, HOW WILL WE EVER MANAGE THE LAND PURCHASED THROUGH PRESERVATION 20007 Land management is funded through an earmark of land acquisition funds. The owner is Peerless Investment Company. The public hearing on this request would follow at the March 15,1995 City Commission meeting. 41 ' - t' The Planning and Zoning Board reviewed this request at their February 16, 1995 meeting. The recommendation is to approve the rezoning as the proposed IRO zoning district is consistent with surrounding zoning and with the land use designation on the Comprehensive Plan which is Employment Center. I ��r The subject property is unplatted. It consists of 16.1119 acres on the east side of NE 7 Avenue and south of Taylor Road. The site surrounds the Port Dania office/warehouse ,.;.. e� at 1100 NE 7 Avenue. The zoning in the area is either IG or IRO. Each is consistent "^ with the land use designation of Employment Center. The IG district regulations allows all permitted uses in the IRO and IR districts. The IRO district lists special exception uses which are more commercial in nature such as a car rental agency. The petitioner wants to have the ability to apply for such special exception uses in the future. The Planning and Zoning Board noted that the City of Dania would have ample opportunity to review any specific development proposal in the future. The property would need to be platted, site plan approval would be required, a special exception request may be filed, and possibly flexibility units for a commercial type development would have to be requested. r* i Page 2 RZ-01-95 - Peerless Two potential limiting factors about the site were noted at the Planning and Zoning R Board meeting. The first is that this site has been listed for potential purchase by the Broward County Aviation Department as part of the proposed runway expansion program. The second is that a portion of the site cannot be developed as it is considered a wetland. The subject property is designated as a "Natural Resource Area" by Broward County in that the majority of the site is a designated wetland. The wetland area is generally east of the Port Dania facility parallel with NE 7 Avenue. The developable property is the westerly 5.2 acres adjoining NE 7 Avenue. Dredge and fill permits have been issued by the Florida Department of Environmental Regulation and the Army Corps of Engineers. The DER permit requires placing 11.1 acres into a conservation easement. The DER permit was issued February 13, 1991 and expires February 13,1996. The same permit allows dredging and filling to construct a development by filling 1.62 acres l" of ditches and scattered mangrove wetland areas with mitigation consisting of creating 1.94 acres of wetland (1.08 acres of mangrove and .86 acres of open water). The Army Corps of Engineers permit allows filling over the westerly 5 acres. This permit expires December 24, 1997. As earlier stated the Planning and Zoning Board found that the request for rezoning is consistent with the Comprehensive Plan and is consistent with surrounding zoning and uses. The terms, conditions, requirements , limitations , and restrictions set forth herein are "Permit Conditions" and as such are binding upon the permittee and enforceable pursuant to the authority of Sections 403.161, 403 .727, or 403 .859 through 403 .861 , Florida Statutes. The permittee is hereby placed on notice that the department will review this permit periodically and may initiate enforcement action for any violation of the "Permit Conditions" by the permittee, its agents, employees, servants or representatives. 2 . This permit is valid only for the specific processes and operations applied for and indicated in the approved drawings or exhibits. The permittee, by accepting this permit, specifically agrees to allow authorized department personnel, upon presentation of credentials or other documents as may be required by law, access 1 to the premises, at reasonable times, where the permitted activity -.., is located or conducted for the purpose of: j a. Having access to and copying any records that must be j kept under the conditions of the permit; b. Inspecting the facility, equipment, practices, or operations regulated or required under this permit; and C. Sampling or monitoring any substances or parameters at iany location reasonably necessary to assure compliance- with this permit or department rules . Reasonable time may depend on the nature of the concern being investigated. a. If, for any reason, the permittee does not comply with or tj will be unable to comply with any condition or limitation specified in this permit, the permittee shall immediately notify and provide the department with the following information: a. a description of and cause of non-compliance; and b. the period of noncompliance, including exact dates and times; or, if not corrected, the anticipated time the non-compliance is expected to continue, and steps being taken to reduce, eliminate, and prevent recurrence of -� r.e ., the non-compliance . The permittee agrees to comply with changes in department rules and Florida Statutes after a reasonable time for compliance, provided however , the permittee does not waive any other rights granted by Florida Statutes or department rules . 11. This permit is transferable only upon department approval in accordance with Florida Administrative Code Rules 17-4.12 and 17-30.30, as applicable. The permittee shall be liable for any non-compliance of the permitted activity until the transfer is approved by the department. i 12. This permit is required to be kept at the work site of the permitted activity during the entire period of construction or operation. 13 . This permit also constitutes Certification of Compliance with State Water Quality Standards (Section 401, PL 92-500) . 14. The permittee shall comply with the following monitoring and record keeping requirements: a. Upon request, the permittee shall furnish all records and plans required under department rules. The retention period for all records will be extended automatically, unless otherwise stipulated by the department, during the course of any unresolved enforcement action . b. The permittee shall retain at the facility or other location designated by this permit records of all monitoring information (including all calibration and maintenance records and all original strip chart recordings for continuous monitoring instrumentation) , copies of all reports required by this permit, and records of all data used to complete the application for this permit. The time period of retention shall be at least three years from the date of the sample, measurement, report or application unless otherwise specified by department rule. C. When requested by the department, the permittee shall within j a reasonable time furnish any information required by law which is needed to determine compliance with the permit. If the permittee > , becomes aware that relevant facts were not submitted or were incorrect in the permit application or in any report to the department, such facts or information shall be submitted or corrected promptly. SPECIFIC CONDITIONS: 1. The permittee is hereby advised that Florida law states: "No person shall commence any excavation, construction, or other activity involving the use of sovereign or. other lands of the state, title to which is vested in the Board of Trustees of the Internal Improvement Trust Fund or the Department of Natural Resources under Chapter 253, until such person has received from the Board of Trustees of the Internal Improvement Trust Fund the required lease, license, easement, or other form of consent authorizing the proposed use. " Pursuant to Florida Administrative Code Rule 16Q-14, if such work is done without consent, or, if a person otherwise damages state land or products of state land, the Board of Trustees may levy administrative fines of up to $10,000 per offense. 2. If historical or archaeological artifacts, such as Indian l canoes, are discovered at any time within the project site the permittee shall immediately notify the district office and the Bureau of Historic Preservation, Division of Historical Resources, _,,..j R. A. Gray Building, Tallahassee, Florida 32399-0250. 3 . The permittee shall not commence any of the work authorized by this permit prior to submitting, and having approved, documentation of the permittee 's financial responsibility for i successful completion of all mitigation activity described in this permit pursuant to Florida Administrative Code Rule 17-312.390. 4. Prior to commencement of work authorized by this permit, the permittee shall notify the Department of Environmental Regulation, Bureau of Wetland Resource Management in Tallahassee, and the Southeast District office in West Palm Beach, in writing of this commencement. rr :xz x ! :w Permittee: Peerless Investment Company Permit No. 061364929 Page: 6 i 5 . Semi-annual narrative reports shall be submitted to the Bureau of Wetland Resource Management, Tallahassee, and the Southeast District office indicating the status of the project and shall include the following information: a. Date permitted activity was begun; if work has not begun on-site, please so indicate. b. Brief description and extent of work (dredge, fill, l construction, wetland creation, conservation easement) completed since the previous report or since permit was issued. Indicate on copies of the permit drawings those areas where work has been completed. C. Brief description and extent of work (dredge, fill, j construction, wetland creation, conservation easement) anticipated in the next six months. Indicate on copies of the permit drawings those areas where it is anticipated that work will be done. The status reports may be incorporated into the semi-annual K narrative report of the mitigation monitoring . r>, } " I The first semi-annual report is due six months from the date of ipermit issuance . w. 6. Turbidity and erosion control measures, such as staked hay bales and silt screens, shall be placed in such a manner so as to completely isolate the proposed fill area from the adjacent wetlands prior to the commencement of construction. These devices j shall be inspected on a daily basis and maintained as necessary to ! ensure that the construction does not encroach into the adjacent wetlands. Measures shall be taken to stabilize side slopes within 72 hours of the completion of final grading. These erosion/turbidity control devices shall not be removed until all ---J the side slopes have been stabilized to control erosion. 7. Mitigation for wetland loss shall consist of creation of 1.94 ac. of wetland. Construction of the wetland creation areas shall occur prior to any wetland filling authorized by this permit. Wetland creation shall be performed as follows: a. Exotic vegetation shall be removed from the wetland creation areas and disposed of in uplands off-site, as indicated on Sheets 3 and 4 of 9. i h _ z 3_ r, r� Permittee: peerless Investment Company Permit No. 061364929 Page: 7 b. 1.08 ac . of uplands , at the locations shown on Sheet 3 of 9, shall be graded to an intertidal elevation of approximately -1 ft. NGVD, as shown on Sheets 6, 7, and 8 of 9, and planted on 3 ft. centers with red mangrove seedlings. The seedlings shall be transplanted from the Y proposed fill area to the greatest extent possible. Any additional seedlings required shall be nursery stock. All spoil material shall be placed in an upland disposal area. C. 0.86 ac . of uplands, at the locations shown of Sheet 4 of 9, shall be graded as shown on Sheets 6, 7 and 8 of 9 (-2 ft. to -5 ft. NGVD) to create open water areas. All spoil material shall be placed in an upland disposal area. I d. Tidal inundation to the wetlands in the northeast corner of the project site shall be enhanced by removing blockages from ditches at the location of Section E-E, as shown on Sheets 4 and 9 of 9. B. In order to preserve the created wetland areas and the existing on-site wetlands, the permittee shall provide a !. conservation easement over the 11.10 ac. area indicated on Attachment A of the permit drawings. A draft conservation easement document (format attached) shall be submitted by the permittee within 30 days of permit issuance. Within 30 days of approval by the Department, the conservation easement shall be recorded and proof of the recording shall be submitted to the Department. The conservation easement shall be recorded prior to z any wetland filling authorized by this permit. 9. The wetland creation shall be considered successful when the i following conditions are met: a. Percent cover by non-nuisance, non-exotic wetland species in the mangrove planting areas shall be 80% or ! more. Percent cover shall be reported for the aggregate of those wetland species, relative to the total area, including a measure of percent cover by non-wetland species, bare ground and water . A list of the wetland species included in the aggregate shall be included. Wetland species shall be those listed in Florida Administrative Code Rule 17-301.400; b. Nuisance and exotic species are limited to 10% or less 7 of the total cover . �i Riffla 14 t1 Permittee: Peerless Investment Company Permit No. 061364929 Page: 8 C . Not less than 1.94 ac. of the created wetlands are determined to be jurisdictional pursuant to Section 403 .817, F.S. ; and I d. The mitigation wetlands are constructed in accordance with the permit requirements. 10 . The permittee recognizes that it has a continuing obligation to continue monitoring the wetland creation project and to correct any unsuccessful wetland creation attempts beyond the expiration ? ' " date of the permit. If the wetland creation project is not deemed to be successful six months prior to the permit expiration date, the permittee shall, prior to the permit expiration date, execute an agreement with the Department evidencing that obligation. ` MONITORING REQUIRED: TYPE: Vegetation monitoring The permittee shall furnish to the Bureau of Wetland Resource Management and the Southeast District Office annual statistical reports of vegetational sampling of the created mangrove wetlands done by any mutually agreed upon method . Acceptable methods may be found in Daubenmire (1968) , Oosting (1956) , or Mueller-Dombois and Ellenberg (1974) . Reports shall describe the percent cover of mangroves and listed herbaceous species. Data for listed nuisance or exotic species, as stated in Specific Condition No. 9, shall be tabulated separately from the remaining data. A listed species is one listed in Florida Administrative Code Rule 17-301.400. Data shall be taken during the summer growing season. Reports shall be submitted annually within four months of data acquisition until a determination of successful wetland creation has been made. ti Semi-annual narrative reports shall be submitted to the Bureau of r wetland Resource Management detailing the progress of this wetland creation program. The reports should include: photographs taken _ from the same permanent stations (some of which must be located in the vegetation sampling areas) , a description of problems encountered and solutions undertaken, and anticipated work for the following six months. The reports shall be submitted at six month intervals, with the first report due six months from start of mitigation construction, and may be combined with the status reports required by Specific Condition No. 5. The owner of gi' the site is the Second National Acceptance Corporation. : i ft The Planning and Zoning Board reviewed this request at their February 16, 1995 meeting. The recommendation is to approve the site plan as it conforms to all requirements. The proposed building addition is consistent with plat restrictions for this 18.11 acre site. The plat restriction for"Dania Office Park" restricts the use to commercial <" recreation uses. The adjoining "Bryan Oaks" allows office and industrial uses in addition to commercial recreation uses. The site has a land use designation of Industrial and is zoned IRO. The existing building as well as the miniature golf course complex, rides, batting cage, etc. have been reviewed and approved in the past. These approvals have ranged from platting the property to granting special exceptions to approving site plans. As the proposed building addition is consistent with the existing site plan and as it complies with all applicable regulations, it is recommended to approve the sit plan. The proposed 12,375 sq. ft. addition will make this arcade building total 39,011 sq. ft. The proposed addition complies with the bulk requirements of the IRO zoning district. The building exceeds setback requirements and is well under lot coverage requirements. The building exterior matches the existing building with a total height of 27.5'. The parking, landscaping, and utility system are already in place. Equipment for additional bicycle patrol units: $6597.00 District II currently utilizes our bicycle patrol successfully in j the city. To further this effort, we have trained four additional riders to be used for a high profile bicycle patrol program throughout the community. This request includes only three bicycles because one was left in the district when one of our ?; previous riders transferred. Equipment to enhance enforcement programs associated with our Community Policing effort: $6225.00 District II has one of the most aggressive Community Policing efforts underway in the county. These efforts, designed to enhance the quality of life in our neighborhoods, are most effective when implemented in conjunction with quality enforcement efforts. In District II the deputies are asked to identify problem areas in their patrol zones and given the opportunity to develop and implement action plans designed to address the concern. Traditionally narcotics and prostitution investigations, when identified as a problem in a patrol zone, were given to a tactical team to work, leaving the zone deputy out of the enforcement effort. In District II, we have eliminated such a specialized unit and empowered all of the deputies and shift supervisors with the responsibility and opportunity to solve problems in the neighborhoods they serve. To safely and effectively investigate these type crimes we rely on close supervision and the shared experience of qualified deputies assigned to the district. To further these efforts, I am requesting the purchase of audio surveillance equipment and five pairs of binoculars. This equipment is necessary for officer safety when conducting undercover narcotics transactions. 1 +i l NM1 1 3. I.D. With this equipment, if an officer or prisoner was in trouble it would be observed and rapid assistance could be provided. As we discussed last week, there is concern by citizens of Dania about the lack of an adequate buffer for the Home Depot building under construction at 3300 SW 42 St. in Hollywood, as well as other buildings which may be built along the north side of the Dania Cut-off Canal. j j' The Home Depot site is zoned IM-3 and is part of the Alandco development. The site is located along the Dania Cut-off Canal. The property to the south is zoned for and developed with residential uses. This situation normally calls for a buffer area with landscaping and a wall in the industrial area to protect the residential area from effects ' of noise, glare, odor, etc. r- Information supplied by your office indicates such a buffer is required in Hollywood. Adjoining property owners to the Home Depot site were notified of a request for an x: administrative variance for waiving the requirement for a 6' CBS wall on the south property line in June of 1994. This portion of the request, AV-94-35, was withdrawn --� = 4; when letters of protest were filed. The Home Depot warehouse is now under construction but plans on file with the City of Hollywood do not show the wall. Please investigate this situation and let me know the current status. There would still be time to have the wall erected with the rest of the building. If the wall has been waived we would like to have a copy of the record of the public hearing or a written explanation of why the wall is not being required. The location of this tent meeting is proposed to be the space between the ti cemetery and Byrd Park. This site is owned by the City of Dania. The size of the area is approximately 174' x 389'. Approval of such operations in a tent as well as the use of city property is the responsibility of the City Commission. fA'e The concept of a revival meeting at this location is recommended for approval pending the submittal of additional information. The request is for a 60' x 150' tent to be placed on this site which runs from Phippen-Waiters Road to Ely Blvd. The revival would be from 7:30 p.m. to 10:30 p.m. nightly. Additional information has been requested about the tent. This information is needed by the Fire Department to make decisions about maximum occupancy, aisle widths, location of exits, required extinguishers, etc. BSO was consulted and the reaction was n. r that no extraordinary Problems would be expected . The following suggestions are made should the City Commission approve the request: 1. The tent should be oriented from east to west so that speakers and noise would be directed to the west. This would avoid noise complaints from residents to the east, whom BSO has indicated have complained about noise in the past. 2. Parking should be to the west side of the lot along Ely Blvd. i a 9i-p 9 Page 2 2 3. The City of Dania needs to be named as an additional insured or co-insured in an amount to be determined by the City Commission. 4. Permits for the tent, electrical and fire inspection need to be obtained. The revival cannot open until all applicable inspections have been made and approvals obtained. It is suggested that fees not be waived as these inspections may take considerable time. 5. Trailers/campers shall not be parked overnight or stored on the site. 6. A bond should be filed to assure debris is cleared from the site. 7. No signs or banners have been requested at this time.
