Mike Smith, Personnel Director, presented a plaque to Joanne Johnson awarding her Employee of the i Month for February for her outstanding performance in her duties at the cemetery and as a Crew Leader in the Public Works Department. ' *BSO Deputy of the Month Award Chief Rick Frey, BSO, presented the Deputy of the Month Award for January to Deputy Darrin Dowe. It was explained that Deputy Dowe obtained the highest work load percentage for his shift durin&the month and that his initiative and professionalism on a consistent basis warranted this commendation. I Vice Mayor Grace expressed appreciation to Joanne Johnson for her hard work efforts in the Public Works Department and recognized Deputy Dowes for his continued dedication to the City. i REGULAR MEETING FEBRUARY 15, 1995 ig *Fire Administrative Report, announcement of$59,340 grant received and EMS "Quilt Plan" update. Fire Chief Grammer reported that two computers have been ordered from the Broward County grant and that a matching grant for $60,000 was received from the State of Florida HRS/EMS Office. Chief Grammer reported that the seventeen Broward County Cities are still united in their effort to oppose the County's action to change the EMS system and that meetings are continuing with Broward County in regards to the EMS Quilt Plan. "Bike-a-Thon for St.Jude's Children's Research Hospital Barbara LaMarsh informed the public that the St.Jude's Children's Research Hospital Bike-a-Thon will % be held February 25, 1995, at the Dania Jai Alai parking lot from 7:45 a.m. to 10:00 a.m. Ms. LaMarsh ppresented information on the successful research, patient care and educational programs made ossible by the Bike-A-Thon campaign due to this internationally recognized Hospital. The motion passed on the following roll call vote: Commissioner Bertino-yes Commissioner Hyde-yes Commissioner Jones -yes Vice Mayor Grace-yes Mayor Mikes-yes +'S ' PULLED FROM THE CONSENT AGENDA ti 1.4 "A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING STRAW BALLOT QUESTION TO BE PRESENTED FOR CONSIDERATION BY VOTERS ON MARCH 14, 1995, GENERAL ELECTION BALLOT RELATING TO ASSIGNMENT OF SEAFAIR LEASE TO FLORIDA ATLANTIC UNIVERSITY; AND PROVIDING FOR } AN EFFECTIVE DATE." City Manager Flatley read a letter received from Donald R. Hall, Attorney for FAU, advising that in accordance with Chapter 235, Florida Statute, the University cannot construct or operate improvements on leased land unless the term of the lease is 40 years or more. City Attorney Adler explained that the wording on the straw ballot can be changed to a 40 }, year term and that the Charter provides for a maximum 20 years in regards to lease negotiation unless the lessee makes substantial improvements to the property. City Manager Flatley reported that the appraisals for the Seafair site are still being completed and that FAU cannot purchase property for anymore than the amount of the state appraisal on the buildings. Mr. Flatley didn't expect to hear from Aragon Group on a counter proposal r, until after the appraisals were finished. Mayor Mikes mentioned that several research facilities in and around Dania have not provided business spin-off and that the citizens should not expect this from the FAU project as represented. Mayor Mikes also cautioned action to enter into a lease with a university who will be able to pursue special act procedures through the legislature which would leave the City with no control over vital city owned property. Commissioner Bertino agreed with Mayor Mikes that the current proposal from Aragon/FAU was not acceptable. He felt it was unfortunate that the appraisals are not finished on the property so that further facts and figures could be provided to the citizens on the Straw Ballot question March 14, 1995. A motion was made by Commissioner Hyde,seconded by Commissioner Jones to adopt the resolution approving Straw Ballot Question to be presented for consideration by voters on j REGULAR MEETING 3 FEBRUARY 15, 1995 r: 0.. March 14, 1995, General Election Ballot relating to assignment of Seafair Lease to Florida Atlantic University. I The motion passed on the following roll call vote: Commissioner Bertino-yes Commissioner Hyde-yes Commissioner Jones-yes Vice Mayor Grace-yes Mayor Mikes-yes i City Attorney Adler clarified for the public that this resolution does not approve any lease or agreement at this time but provides the Commission the opportunity to review a lease for 40 years with FAU and Aragon Group instead of the previous 30 year term. Commissioner Jones presented a plaque to Mrs. Peterman and included his personal ' comments on how she has been an inspiration in his life. Mrs. Peterman expressed her appreciation for being presented with the honor. 2.6 Mayor Mikes read the proclamation in its entirety declaring March 12, 1995, "Genevieve C. Ely Day." Kurt Ely came forward to provide his own comments about his mother's life and her contributions to bringing antiques to the City of Dania. City Attorney Adler commented on his friendship with Mrs. Ely and mentioned that she was responsible for creating a Recreation Department for children in the City. i REGULAR MEETING 4 FEBRUARY 15, 1995 x i Fill 4 3. BIDS 3.1"A RESOLUTION OF THE CITY OF DANIA, FLORIDA, ACCEPTING BID SUBMITTED BY THE MURPHY CONSTRUCTION CO. IN THE AMOUNT OF EIGHTY THOUSAND TWENTY-SEVEN AND NO/100 ($80,027.00) FOR CONSTRUCTION OF WHISKEY CREEK BOAT DOCKS; AND PROVIDING FOR I AN EFFECTIVE DATE." Dan Oyler, City Planner, explained that one bid was received from Murphy Construction for $80,027.00 for construction of Whiskey Creek Boat Docks and that the project is being funded from a Broward County grant for$50,000. He advised that Murphy Construction's bid was so high due to permitting requirements and that they are trying to reduce their price �4 1 to a more acceptable amount. -' A motion was made by Commissioner Hyde, seconded by Commissioner Jones to defer the l resolution for one month. EXPENDITURE REQUESTS 7.1 Approval of invoice from Bailey Hunt Jones & Busto in the amount of$1,209.08 for the ? 'uef period ending December 31, 1994, for airport related services. A motion was made by Commissioner Hyde, seconded by Commissioner Jones to approve the invoice from Bailey Hunt Jones &Busto for$1,209.08 for period ending December 31, 1994. The motion passed on the following roll call vote: j Commissioner Bertino-yes Commissioner Hyde-yes Commissioner Jones- no Vice Mayor Grace-no Mayor Mikes-yes REGULAR MEETING 5 FEBRUARY 15, 1995 s 1 (J I I 7.2 Approval of invoice from Curtis & Curtis in the amount of$11,008.74 for the period ending January 24, 1995, for airport related services. r , A motion was made by Commissioner Bertino, seconded by Commissioner Hyde to approve the invoice from Curtis & Curtis for $11,008.04 for period ending January 24, 1995. City Manager Flatley advised that the City will be conducting a Quasi Judicial Public Hearing at the next regular meeting February 28, 1995, which is a legal response to Broward County's recent action to take 97 acres of city property east of U.S. 1. Mr. Flatley explained that attorneys' Ed Curtis and Earl Gallop and a court reporter will be present at the public hearing. DISCUSSION AND POSSIBLE ACTION 8.1 A motion was made by Commissioner Bertino, seconded by Commissioner Hyde to approve the Acceptance of Certification of Primary Election results from the Broward County Canvassing Board. The motion passed on the following roll call vote: Commissioner Bertino -yes Commissioner Hyde-yes Commissioner Jones-yes Mayor Mikes-yes Vice Mayor Grace was absent from the room at this time. ITEM 8.4 WAS HEARD AFTER ITEM 8.1 8.2 WAS HEARD AFTER ITEM 8.3 8.2 Remaining items to complete the Dania Pier and establishment of an opening date and dedication ceremony. Kevin McCabe, Coastal Technology, explained that the pier is substantially complete at this time with some minor punch list items to be finished. He expressed his appreciation to Murphy Construction for their outstanding performance during the whole process and mentioned that a change order for a reduction in the contract amount will be presented at the February 28 Commission Meeting. Mr. McCabe stated that a percentage of Murphy's retainer will be held until the disposal of the debris is completed in accordance with their contract requirements. Mr. McCabe advised that the Temporary Bait and Tackle Shop trailer will be placed on the y' west end of the pier deck sometime this week and that other electrical and water issues need to be worked out until the water and sewer line extension is completed from the Seafair building " REGULAR MEETING 6 FEBRUARY 15, 1995 7P AL north to the Pier. He mentioned that bid proposals for extending the water and sewer lines are expected around March 1 and that construction could begin sometime in April and take 90 to 100 days to complete. City Manager Flatley advised that the opening of the pier is being coordinated with the One- Ton Tug for March 18 and that a pre-opening on March 1 will allow people to fish and to see how things are working before the formal o ening. Discussion followed on landscaping needs before the opening and whether it is cost effective to have Murphy install the landscaping instead of the reduction in the proposed Change Order. Dan Oyler, City Planner, mentioned that he already decided that funds for the landscaping could be deducted from the proposed Change Order from Murphy Construction and that he has additional funds from the FRDAP grant to combine a better landscape scheme with the help of city crew and community assistance. City Manager Flatley mentioned that a bronze plaque is being prepared for the grand opening of the pier. A motion was made by Commissioner Hyde, seconded by Commissioner Bertino to approve the plaque to read "The City of Dania Ocean Pier." The motion passed unanimously. Dan Oyler presented his recommendation to grant approval to expend $2,000 to provide concrete and wood benches for the pier. Mr. Flatley recommended to use contingency funds for the benches and advised that security is being provided at the Pier from 6:00 p.m. to 6:00 a.m. A motion was made by Commissioner Bertino, seconded by Commissioner Hyde to approve an expenditure of$2,000 for benches at the pier from the Contingency Fund. Pleasant AME Church for permission to hold a carnival on Hill Property. Vice Mayor Grace expressed appreciation to Mr. Bill Hill for allowing Mt. Pleasant AME .._ Church to hold their carnival on his property. She expressed appreciation to Mt. Zion, Mt. Pleasant and United Methodist Church of Dania for bonding together for this event since they are partly in Hollywood and Dania and presented a list of benefits to the City. v Will Allen, Growth Management Director,explained that the Greater Mt. Pleasant AME fir' Church has requested to hold a Hildebrand Carnival from Wednesday, February 22 to Sunday, February 26, 1995, at the northwest corner of Stirling Road and Phippen-Waiters Road. The request includes waiver of all permit fees which are estimated at $906.25 plus inspection fees at a minimum of$35.00 each to check the electrical wiring and inspection of tents under the South Florida Building Code. Mr. Allen explained that there are potential noise, traffic and security concerns since the property abuts residential property on the north and presented the following list of suggested conditions: 1) The site plan is suggested to be altered in the following manner: a) Limit access to Phippen-Waiters Road only, north of the antique store; b) Realign the site plan so that all parking is on the east end of the site j REGULAR MEETING 7 FEBRUARY 15, 1995 0 ji c) Install a temporary fence along the north property line to aid security and protect adjoining property; d) Provide trash containers as shown on site plan; e) Limit hours of operation to 9:00 p.m. on weeknights and 11:00 p.m. on weekend 2) BSO should be contacted to provide traffic control and security assistance. 3) Certificates of Inspection of the rides by the Department of Agriculture be supplied prior to opening and the rides and grounds be inspected and approved by the Dania Fire Department prior to opening. 4) The Certificate of Insurance be updated to include the City of Dania and property owner .' as additional insured. Mr. Allen clarified for Commissioner Jones that this is the normal procedure that is followed on any request to hold a carnival. In regards to the conditions, Lucy Thomas, Mt. Pleasant AME Church, explained that the carnival hours of operation are Wednesday and Thursday 5:00 p.m. to 10:00 p.m., Sunday 1:00 p.m. to 10:00 p.m., Saturday 1:00 p.m. to 11:00 p.m., and Friday will close between 11:30 and 12:00 midnight. She advised that the state inspection required on the rides from the Department of Agriculture and the fire and electrical inspections will be completed prior to Wednesday before the 5:00 p.m. opening. She could not guarantee that there would not be any noise problems and asked the City for assistance in providing the temporary fence that has been requested in the conditions. Ms. Thomas explained that the security and traffic control has been worked out with BSO with the help of some citizens and that the trash concerns will be handled. Chief Frey, BSO, suggested to move the carnival to the west end of the property and parking on the east so that access could come from the north side along Phippen-Waiters Road due to ' congestion on Stirling Road. Ms. Thomas explained that the insurance certificate will include the Crty of Dania and Mr. Hill as additionally insured and Mr. Allen requested that she contact Allied Specialty Insurance as they had not been notified as of this date. Parker for Las Vegas Night& Black History Night. Mike Smith, Personnel Director, mentioned that the Community Center Board reviewed the policy on waiving fees for using the I.T. Parker Center for non-profit or anizations and decided it would be too hard to choose the most worthy organizations. The board thought it would be better to waive the fees on events that are co-sponsored by the City. A motion was made by Commissioner Bertino, seconded by Commissioner Jones to co- sponsor the Dania Optimist Club and Kiwanis Club Las Vegas Night on March 10, 1995, and Dania Activity Committee Black History Program on February 17, 1995, at the I.T. Parker Community Center. The motion passed unanimously. i 9. APPOINTMENTS 9.1 Commissioner Bertino continued his appointment of I member to the Airport Advisory Board to the next regular meeting. 9.2 Appointment of 4 members to the Unsafe Structures Board A motion was made by Commissioner Hyde, seconded by Commissioner Bertino to reappoint Frank Hill as General Contractor, Harry Hipler as Attorney and Sam Jolly as Plumber on the Unsafe Structures Board. The motion passed unanimously. The appointment of the Real Estate Appraiser was continued. 9.3 The Commission continued the appointment of 1 member to the Downtown Redevelopment Agency and Dania Economic Development Board to the next regular meeting. 9.4 One more citizen nomination needed from Commission for employees to hold an election for Civil Service Board. A motion was made by Commissioner Jones,seconded by Commissioner Bertino to ' nominate Boisey Waiters Jr. as the third citizen nomination for the Civil Service Board election. The motion passed unanimously. 10. ADMINISTRATIVE REPORTS City Manager 10.1 Workshop to be scheduled for February 21 (7:30 p.m.) to discuss BSO (Vice-Mayor Grace), education advisory committee (Comm. Jones), Banyan Property development, beach cleaning machine, occupational license fee adjustment, fire fee adjustments, etc. REGULAR MEETING 9 FEBRUARY 15, 1995 - I 10.2 Quasi Judicial Hearing on the airport expansion issue will take place on February 28, 1995, (7:30 p.m. -9:30 p.m.) at Dania City Hall, City Commission Chambers. Mayor Mikes read the title of the resolution for the hearing. 3 City Attorney Adler congratulated Vice Mayor Bobbie Grace for being nominated to the •' Women's Hall of Fame. i 11. Commissioner Jones mentioned that Southern Sanitation is not picking up garbage and missing some of the addresses on their route. ki Commissioner Jones mentioned that he is working with BSO on the problem with delivery r businesses who will not deliver in certain sections of the City after 5:00 p.m. 11.4Vice-Mayor Grace ' Vice Mayor Grace thanked Jones Intercable for airing the "Candidates Night" on February 8, u 199 5, and took a few minutesg to acknowledge employee Charlie Thomas for his 20 years with ? '; ` the City of Dania. Vice Mayor Grace commented on her attendance at the opening ceremony of the Sea Escape .> a m Building across from the old Hollywood Federal Building. She reminded thep ublic of the ? y ;. Black History Pro&ram being held at 7:30 p.m. on February 17 at the I.T. Parker Center. She asked staff to look into why the grass is still not down on NW 1 Street and to ensure that trees and hedges are planted. '-- Vice Mayor Grace invited the public to attend Old Fashioned Day on Sunday at Bethel Baptist Church and mentioned her appreciation for being one of the 33 women being nominated for the Womens Hall of Fame during Women's History Month. Vice Mayor Grace expressed appreciation to all of those who were involved in the recent j Primary Election process and encouraged the public to vote in the upcoming General Election. 11.5Mayor Mikes Mayor Mikes mentioned that there were a number of candidates in this past election and congratulated Commissioner Hyde for being the highest vote getter. He encouraged people to vote in the upcoming General Election and commended those who were responsible for the ' professional way the Candidates Night was handled. The institution opened its doors to the public in 1962 to combat catastrophic diseases which afflict our children. St. Jude Hospital is non-sectarian, { non-discriminatory, and covers all costs of care beyond those reimbursed by insurance. At St. Jude, scientists and physicians are working side-by-side seeking not only a better means of treatment, but also the causes, cures, and prevention of these terrible killers. All findings and information gained at the Hospital are shared freely with doctors and hospitals all over the world. Thanks to St. Jude Hospital, children who have leukemia, Hodgkin's disease, sickle-cell anemia, and other child-killing diseases now have a better chance to live. The Bike-A�Ihon program this year is dedicated to nine-year-old Shauna Richters. Shaun was diagnosed with Wilins' tumor, a malignant growth on her left kidney, in December 1990. Surgery successfully removed the tumor, and Shaun returns Lo St. Jude Hospital every six months for check-ups. She celebrated her last chototherapy treatment with a present she had eagerly looked forward to: a new bike. I recently learned that on January 24, 1995 the City of Dania adopted e Resolution No. 16-95 which directed that a straw ballot question concerning this transaction be presented to the voters of the City of Dania on March 14, 1995. 1 The language of the straw ballot question refers to an extension of the lease so as to give Florida Atlantic University a total of 30 years. Pursuant to Chapter 235, Florida Statutes, the University cannot construct or operate improvements on leased land unless the term of the lease is 40 years or more. I know that the results of a straw ballot election are not binding, however, I think that voters should be presented with a question which accurately reflects this transaction. Scheduling must be requested by the principal or president of the P.T.O. and approved by the recreation director. r DEPOSITS FOR RESERVATIONS A fifty percent deposit must be made at the time a reservation for use of the facility or any part `err thereof is requested. This deposit is non-refundable unless the person paying same cancels the reservation, in writing, on or before sixty (60) days prior to the reservation date, however refund is subject to a $40 administrative charge which will be deducted from the deposit. SECURITY DEPOSITS Security deposits are refundable if the following conditions have been met: 1. No damages to the premises have resulted from the use of the center. 2. No rules of the center(such as the no-smoking rule) have been violated. 3. The premises are properly cleaned and the furniture and furnishings are properly arranged and/or stored. r' The costs of cleaning the premises (if necessary) or the repair or replacement of damaged property shall be deducted from the security deposit. Sterling Collins introduced his daughter Kimberly Ford, an advertising instructor at Miami Dade Community College, who presented samples of brochures. The board thought the materials presented were excellent and it was suggested that Mike Smith '''• get in contact with Kimberly to review same. Murphy construction has been asked to review the plans and the permits in order to reduce the cost of the project to an acceptable level. The benches would then be used in our parks. I have contacted and visited several companies with the following results: 15 - sets of concrete ends @ 98.00 a set= $1,470.00. 15 - sets of 2 x 6 p.t. lumber with holes and pegs @ 120.00 a set = $1,800.00 Total cost of 15 benches = $3,270.00 The City can purchase the required 2 x 6's, pegs and drill the holes for a lot less than $1,800.00. Material cost is estimated to be around $500.00. Therefore it is recommended that, if the Commission wishes to have benches on the pier that the city buy the concrete ends and make the 2 x 6 seats and back ourselves. CHURCH FOR k APPROVAL OF A CARNIVAL, FEBRUARY 22-26 AT STIRLING ROAD AND PHIPPEN-WAITERS ROAD DATE: February 14, 1995 The attached documents serve as the request of the Greater Mt. Pleasant A.M.E. Church to host the Hildebrand Carnival from Wednesday, February 22 to Sunday, February 26, 1995. The location requested is for the northwest comer of Stirling Road f y and Phippen-Waiters Road on the 300' x 630' parcel owned by Mr. C.F. Hill. There is an antique store located at the southeast corner of the site. The request includes p' waiving of all permit fees. Section 33-44 of the Dania Code of Ordinances indicates uses such as carnivals arenot permitted unless approved by the City Commission. City staff members have 7" reviewed the request and suggestions are made should the City Commission approve i v., the request for this carnival. Fees are requested to be waived. Chapter 15, Licenses normally requires a license in the amount of$781.25 for a carnival as well as another$25.00 per day for concessions. For the five day event, the license fees would normally total $906.25. There would also be fees for inspecting the electrical wiring and inspecting any tents which may be used. These inspections are required by the South Florida Building Code. (S.F.B.C.). Copies of appropriate sections are included for review. These fees are minimal ($35.00 minimum fee for each inspection.) The licensed electrical contractor is required to patrol the temporary installation per Section 4511.2 of the S.F.B.C. 17 b y Page 2 Greater Mt. Pleasant A.M.E. Church - Carnival The proposed location is a concern in that it abuts residential property on the north property line. There are potential problems with noise, traffic and security. The following suggestions are made to address these concerns: 1) The site plan is suggested to be altered in the following manner: a) Limit access to Phippen-Waiters Road only, north of the antique store. This is suggested for several reasons including that there are curbs around the perimeter of the site which would make ingress and egress difficult. Allowing access onto Stirling Rd. would be considered a traffic hazard, with turning j movements onto Stirling Rd. b) Realign the site plan so that all parking is on the east end of the site. This is consistent with one access point and concentrates traffic control. c) Since there are residential units along the north side of the site, a temporary fence along the north property line could aid security and help protect the adjoining property. d) Trash containers should be shown on the site plan. e) If permitted it is suggested that the hours of operation be limited since the site does abut a residential area. Perhaps 9:00 p.m. should be the latest on weeknights and 11:00 p.m. on the weekend nightly. 2) BSO should be contacted to provide traffic control and security assistance. This is normally done through "detail' duty and is at the cost of the applicant. Based on the site plan submitted, this would require 4 officers (2 traffic and 2 security). If the site plan is changed as suggested, this can be reduced to 3 officers (1 traffic and 2 security.) 3) Certificates of inspection of the rides by the Department of Agriculture should be supplied prior to opening. The rides and grounds should be inspected and i t approved by the Dania Fire Department prior to opening. 4) The certificate of insurance needs to be updated to include the City of Dania and the property owner as additional insured. Allied Security Insurance, Inc. is the insurance provider. The church /company is insured but they have no record of n, R' naming Dania as an additional insured. The insurance company indicated they only had to be contacted by Greater Mt. Pleasant A.M.E. to add Dania and the owner. This item is scheduled for review at the February 15, 1995, City Commission meeting. Traveling circuses, carnivals, outdoor shows, etc.; approval to operate by chief of police. The operation of any type of traveling circus, carnival, outdoor show and like amusements o: a transient nature in the city shall be governed by the following provisions: Supp. No.34 1780 i F I ZONING APPENDIX § 33.225 (1) Traveling circuses, carnivals, outdoor shows, amusement parks, devices and to exhibitions, and all such operations, avocations or businesses operating under tents or in temporary buildings or structures shall not be permitted in the city except upon approval of the chief of police and city commission. (2) Nothing herein contained is intended to apply to local shows or amusements 1 held in theaters. auditoriums or permanent buildings in the city. Further, nothing herein contained is intended to apply to any amusement park established in the city on a permanent basis prior to the effective date of this y= chapter and located in an AP district. Specifically, without limitation on the foregoing, this section shall apply to traveling shows, carnivals, fairs, exhibitions and the like which are transient in nature and which operate only for temporary periods. The area reserved for off-street parking shall be hard-surfaced. Where the parking area is hard-surfaced the same shall consist of a good rolled rock base, well tamped, J and topped with asphaltic concrete in accordance with the paving specifications of the City of Dania. Occupancy of a given structure or premises shall be prohibited until the required parking area has been improved, inspected and approved. Sec. 33-214. Marking of spaces; entrances and exits. In all zones or districts other than single-family districts, the parking area shall be marked, either by painted lines, precast curbs, or in a similar fashion, indicating the individual parking spaces or stalls and in accordance with the further requirements: (4) Entrance and exits. All egress and ingress to off-street parking areas shall be so designed as to prohibit backing out of vehicles into public right-of- ways. Mr. Flatly, whereas our church is located in Hollywood, our pastor and his family live at 720 S.W. 2nd Pl., Dania. This property is owned by Greater Mt. Pleasant A.M.E. church and we recognize this commission as our elected city officials. More than 30% of our members live and or own property and businesses in Dania. Personally, my husband's family have owned and operated a business in Dania for nearly fifty years. So you see, Mr. Flatly our ties with the city of Dania go beyond the physical location of our church.
