HomeMy WebLinkAboutR-1996-067RESOLUTION NO. 67-96 A RESOLUTION OF THE GITY OF DANIA, FLORIDA, AUTHORIZING THE CITY MANAGER TO PREPARE ANO FILE AN APPLIGATION WITH BROWARD COUNry FOR AN ENHANCED MARINE LAW ENFORCEMENT GRANT COVERING THE FISCAL YEAR 1996-97; AND TO EXECUTE ALL DOCUMENTS RELATED THERETO AS THE AUTHORIZED REPRESENTATIVE OF THE CITY; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA; Section 1. That the City Manager, Michael Smith, is hereby authorized to prepare and file an application with Broward County for an Enhanced Marine Law Enforcement Grant for the fiscal year 1996-97, and to execute all documents related thereto as the authorized representative of the City. A copy of said grant application is attached hereto and made a part hereof as Exhibit "A", be and the same is hereby approved. Section 2. . That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 3. . That this resolution shall be in force and take effect immediately upon its passage and adoption. Attached is a list of the areas that the Broward County Marine Advisory Committee feels are in need of supplemental law enforcement. Our desire is that law enforcement agencies utilize the Local Option Vessel Registration Fee approved by the Board of County Comnnissioners lo supPlement existing seruices in their area of jurisdiction. Over the years many complaints have been received from business, residents, and boaters themselves of violations of posted speed signs and alcohol related abuses within the wateruay system. The five (5) miles of the Dania Cut-off Canal is patrolled sporadically by the Broward County SherifFs Office and the Florida Marine Patrol. The patrolling that is provided is not sufficient to police the waterways. Therefore, the City of Dania is requesting your continued assistance in providing for enhanced law enforcement along the Dania Cut-off Canal. The City plans to contract with the Broward County Sheriffs Office to provide the city with Marine Patrol Officers and boats. The City receives general law enforcement services from the BSO under a contractual relationship. The Broward County Sheriffs Office would provide for a fully trained Marine Patrol Officer and boat during the hours of 9 am to 5 pm (8 hrs per day) on weekends. This would insure that our waterways are patrolled during the peak boating days of the week 216 from hours October, '1996 to September, 1997. BSO will target Friday and Saturday evenings for Operation Under the lnfluence (OUl) enforcement. Since we would be using the Broward County Sheriffs Office for this service, they would be able to assist any jurisdiction in Broward County without regard to jurisdictional boundaries. ln addition the City is requesting the addition of two education elements to the program. Part one would provide 50 hours per year of boating safety presentation to middle school students in the City of Dania (Olsen and Attucks Middle Schools) which would be conducted by marine patrol deputies. This program would introduce students to boating safety and direct interested students into Part two of the program. Part two is a ten (10i hour course to be offered at the BCC Watersports Training Facility at Dania's Tigertail Lake. This program is a partnership between the City of Dania, BCC, Broward County School Board, and the Center for Environmental Education and Research, lnc. (CEERI). The City seeks to have 240 students complete the program. TOTAL PROJECT GRANTS COSTS REQUESTED $ 45.140 LIST ALL PROJECT ELEMENTS, QUANTITIES AND ESTIMATED COSTS, PROPOSED BY THE APPLICANT. WHAT IS THE CURRENT LEVEL OF MARINE I.AW ENFORCEMENT FUNDING? PROVIDE DOCUMENTATION TO SUPPORT YOUR ANSWER. At the present time, the City of Dania contracts with the Broward County Sheriffs Office (BSO) for Law Enforcement within the City. The Contract with BSO does not include regular marine patrol services. The only law enforcement on the waterways of the City of Dania is on a sporadic basis by the Florida Marine Patrol and BSO. (See attached letter from BSO). 4 1. WHAT IS THE CURRENT LEVEL OF MARINE LAW ENFORCEMENT FUNDING? INCLUDE PREVIOUS YEAR EMLEG FUNDING SEPARATELY. PROVIDE DOCUMENTATION TO SUPPORT YOUR ANSWER. Funding for Marine Law Enforcement is cunently provided through EMLEG funds only. Allocation for FY 1995-1996 was $35,040. 2. WHAT IS THE CURRENT STAFFING LEVEL AND HOURS OF MARINE PATROL SERVICE PROVIDED. INCLUDE PREVIOUS EMLEG STAFFING LEVELS AND HOURS OF MARINE PATROL SERVICE SEPARATELY. PROVIDE ADEOUATE DOCUMENTATION TO SUPPORT YOUR ANSWER. See Exhibit A (Attached). 3. WHAT IS THE LEVEL OF FUNDING AND STAFFING FOR YOUR AGENCY IN YOUR PROPOSED FISCAL YEAR 1996-1997 BUDGET.DO NOT INCLUDE YOUR PROPOSED EMLEG APPLICATION FUNDING. PROVIDE DOCUMENTATION TO SUPPORT YOUR ANSWER. No funds are available for Marine Patrol services in the city's 1996-1997 budget. See Exhibit B. 4. DESCRIBE NUMBER AND TYPE OF BOATS AND ENGINES (WTH ENGINE HOURS IF AVAILABLE) CURRENTLY FUNDED. No boats or engines have been funded through the city grant. A 26' lntrepid will be used, which was funded through the BSO EMLEG grant last year' 6 5. DESCRIBE HOWTHE PROPOSED GRANT PROJECTWOULD IMPROVE BOATING SAFEry IN BROWARD COUNTY. Through the award of this grant to the city of Dania, Broward county and the city of Dania will continue to be provided with improved Boating Safety where virtually none existed before. Through its contract with the BSO, the city of Dania has endorsed the concept of community policing which has proven to be successful in addressing crime in our community in a comprehensive manner. The enforcement methodology utilized by the Marine Patrol unit of BSO follows the Same principles. Marine patrol offtcers become familiar with waterfront business interesi and the boating public. Effectiveness is measured not simply by the number of citations written, but also emphasizes customer contacts which are used to provide verbal instruction and printed material in boating safety and rules of the wateruay. The focus of the program is safety training. 6. WILL THE AGENCY REQUESTING ENHANCED LAW ENFORCEMENT FUNDS PROVIDE FOR THE COSTS OF OFFICERS TO APPEAR IN COURT? YES - NO _X_ By contracting with the Broward Sheriffs Office for Marine Patrol, no funding for court appearances will be required. 7 7. HOW WLL THE AGENCY REOUESTING ENHANCED LAW ENFORCEMENT FUNDS MEET, OR INCORPORATE THE "ZONES AND TIMES OF CONCERN" (sEE EXHIBIT "A) lN THEIR GRANT PROPOSAL. The request for 1996-1997 provides for Saturday and Sunday enforcement 9am-5pm and special OUI enforcement targeting Friday and Saturday evenings. (216 hours have been set aside for the OUI program during the year). During periods of inclement weather and other circumstances which result in reduced boatirig traffic, patrols would be curtailed and hours would roll forward to be used during peak hours which may include additional evening enforcement' see Exhibit c for detail breakdown of saturday and sunday enfc'rcement. oul enforcement times have yet to be determined. 8. WHAT WOULD BE THE LEVEL OF ADDITIONAL SERVICE, ABOVE THE EXISTING BUDGETED LEVEL oF SERVICE, THAT THE APPLICANT couLD PROVIDE TO ENSURE ENHANCED MARINE LAW ENFORCEMENT? The city of Dania has no budget for providing funding for a Marine Patrol. However, the Florida-l\Iarine patrol and The-Browaid County Sheriffs Office do patrol the Dania Cut-off canal on a sporadic basis.
