WHEREAS, Florida Statutes provides for a uniform method for the levy, collection, es Y and enforcement of non-ad valorem assessments; and {r z' WHEREAS, the Citydesires to utilize the provisions set forth in Florida Statutes Itr� relating to the procedures for levy, collection, and enforcement of non-ad valorem assessments; and *,. Commencing with the tax roll of 1996 and rri continuing ` g year-to-year, unless and until the County shall receive timely written notice from the City electing to discontinue using the uniform method of collection of non-ad valorem 41 assessments, the County shall collect the non-ad valorem assessments provided to the j:SS,� 6t 3 tr Broward County Finance and Administrative Services Department from the City ty pursuant to the procedures set forth in Section 197.3632, Florida Statutes. SECTION 2. t` �x COMPLIANCE WITH UNIFORM METHOD. The City shall `tau StR aX comply, at all times, with the requirements, obligations, duties, and procedures set forth in al `"' Y J �Tzr Section 197.3632, Florida Statutes, as currently enacted or as may be amended from time- s, T to-time, and such requirements, obligations, duties, and procedures are incorporated herein y ,hob • by reference as if set forth in full. i? SECTION 3. COUNTYACTIONS ARE MINISTERIAL. This Agreement supersedes all prior ; ', r negotiations, correspondence, conversations, agreements, or understandings applicable to the matters contained herein, and there are no commitments, agreements or understandings concerning the subject matter of this Agreement that are not contained in ' this document. Accordingly, no deviation from the terms hereof shall be predicated upon fa ` t y any prior representations or agreements whether oral or written. No modification, amendment, or alteration in the terms or conditions containedekf <, herein shall be effective unless contained in a written document executed with the samef � � I formality and of equal dignity herewith. t"rs ti " Neither this Agreement nor any term or provision hereof or right hereunder shall be kqE ? , assignable by either party and any attempt to make such assignment shall be void. ® SECTION 6. NOTICE. Whenever either party desires to give notice unto the other, it must be given by written notice sent by registered United States mail, with return �� } Y. , 4 vYu 4yrri�. . t ? receipt requested, or by a nationally recognized overnight express mail service (e.g, s„F ; Federal Express), addressed to the party for whom it is intended, at the place last specified, ' z , and the place for giving of notice shall remain such until it shall have been changed b written notice in compliance with the provisions of this paragraph. Please place this revised Interlocal Agreement on the City Commission's Agenda as soon as possible. Once it has been executed by the City, forward two signed copies of the agreement to Sharon Thorsen, Assistant County Attorney, Governmental Center, Suite 423, 115 South Andrews Avenue, Fort Lauderdale, Florida 33301. Your transmittal should request Ms. Thorsen to take responsibility for causing the Chairman or the Vice Chairman of the Board of County Commissioners to execute the agreement, recording the agreement in the Public Records and sending a copy of the recorded agreement to you and us for our respective files. Please provide us a courtesy copy of your transmittal (including attachments) to Ms. Thorsen.
