HomeMy WebLinkAboutR-1996-102RESOLUTION NO. 102-96 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING THE RENEWAL OF SOVEREIGNTY SUBMERGED LANDS LEASE BETWEEN THE CITY OF DANIA AND THE BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND OF THE STATE OF FLORIDA; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That that certain Renewal of Sovereignty Submerged Lands Lease between the City of Dania and the Board of Trustees of the lnternal lmprovement Trust Fund of the State of Florida; copy of which is attached hereto as Exhibit "A", be and the same is hereby approved, and the appropriate city officials are hereby directed to execute same. WITNESSETI I WHEREAS, on the I st day of April, l9!l the Lessor did grant to the Lessee, that certain Sovereignty Submerged Lands Lease No. 062100966, to be effective fiom April l. l99l through April l. 1996 (the ,,Lease,,); and WHEREAS, the Lease was recorded on Julv 7. 1992, in Official Records Book 19652, Page 0354, Public Records of Broward County, Florida; and WHEREAS, the Lessee has requested that Lessor renew the Lease and Lessor agrees to renew the Lease. NOW, THEREFORE, the Lessor and Lessee agree as follows: l. The Lease is hereby renewed from ADril I, 1996, the effective date ofthis lease renewal, to April l. 20Q1, th€ expiration date of this lease renewal. 2. All ofthe original terms and conditions ofthe Lease shall remain in full force and effect and binding upon the Lessee throughout the lease renewal period; except for the following: a. Paragraph 2l ofthe lease shall be changed to read 2 I . Renewal of lhis lease shall be at the sole option of the Lessor. Such renewal shall be subject to the terms, conditions and provisions ofmanagement standards and applicable laws, rules and regulations in effect atthattime. In the event that Lessee is in full compliance with the terms of this lease, the Lessee may apply in writing for a renewal. Such application for renewal must be received by Lessor no sooner than 120 days and no later than 30 days prior to the expiration date ofthe original or current term hereof. Theterm of any renewal granted by the Lessor shall commence on the last day ofthe previous lease term. Ifthe Lessee fails to timely apply for a renewal, or in the event the L€ssor does not grant a renewal, the Lessee shall vacate the leased premises and remove all structures and equipment occupying and erected thereon at its expense. The obligation to remove all structures authorized herein upon termination ofthis lease shall constitute an affirmative covenant upon the riparian upland property more specifically described in Attachment D, which shall run with the title to said riparian upland property, and shall be binding upon Lessee and Lessee's successors in tille or successors in interest. b. Attachment D, referenced in paragraph 2l above, is attached hereto and incorporated herein as part of 3. The Lessee, at its own expense, shall record this lease renewal in its entir€ty in the public records of Broward County within fourteen (14) days after receipt, and shall provide to the Lessor within ten (10) days following rhe recordation a copy oithe recorded lease renewal document in its entirety which contains the Official Records Book and pages at which this lease renewal is recorded.
