BE IT RESOLVED BY THE CIry COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 'l . That the renewal of that certain Agreement between the City of Dania and the City of Hollywood for maintenance and trash removal services at Dania Beach; copy of which is attached hereto as Exhibit "A", be and the same is hereby approved for a one year period beginning October 1, 1996, and ending September 30, 1997. Section 2. That said payments shall be adjusted in an amount equal to the cost of living index as published by the Bureau of Labor Statistics, Department of Commerce, United States Government, with the publication for the month of September as the base for such adjustment as outlined in Section 3 of the said agreement. Section 3 That this resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED this I day of R.COMMISSIONER ATTEST CITY CLE -AUDI o AJc. dL CITY ATTORNEY RESOLUTION NO. 101.96 APPROVED AS TO FORM AND CORRECTNESS: .( c/ S'',1./ 7 BEACH MAINTENANCE AGREEMENT THIS AGREEMENT is made and entered into in Broward County, Florida, as of the 12th day of September, 1995, between the City of Hollywood, Florida, a municipal corporation of the State ol Florida (hereinafter referred to as "Hollywood"), and the City of Dania, Florida, a municipal corporation of the State of Florida (hereinafter relened to as "Dania"). WITNESSETH: WHEREAS, Dania owns Dania Beach and is considering proposals to maintain it; and WHEREAS, Hollywood has submitted a proposal to Dania to maintain Dania Beach; and WHEREAS, the parties wish to enter into an agreement pursuant to which Hollywood will maintain Dania Beach for a specified amount of compensation; N0W, THEREFORE, in consideration of the mutual terms and conditions, promises and covenants hereinafter set forth, Hollywood and Dania agree as lollows: 1. Maintenance. Hollywood shall maintain Dania Beach for the term of this Agreement. The responsibilities of Hollywood underthis Agreement shall be limited to the following tasks: A. Beach Grooming Dragging the beach daily, ii. Raking and removing the seaweed as needed, Screaning the sand as needed (at least once a month), ':)(i{lBlT "A" I B. Trash Bemoval i. De-littering the beach daily, Removing garbage daily from approximately ttirty 55-gallon codainers located at the beach and parking lot directy adiacent to the beach, l[.Disposing of fie garbaqe lrom fie beach in any legally allowable manner. Hollywood shall have no furfier responsibility wifir ]espect to Dania Beach. 2. Term. The term ol fiis Agreement shall be 1 year. Renewable for two successive I year periods. 3. Pavment. Dania shall pay to Hollywood for the above-described beach maintenance services he sum of $29,254 per year, payable in equal monfily installments beginning 0ctober 1 , 1995; provided however, fiat at tre beginning of fie second and each subsequent year of tris Agreement, said payments shall be adjusted in an amount equal to the cost of living index as published by the Bureau of Labor Statistics, Departnent of Commerce, United States Govemment, with fie publication for fie month of September as the base for such adjustnent. 4. Permits. Any and all permits that are required lor the services to be performed pursuant to tris Agreement shall be obtained by Dania at its sole cost. 2 5. Force Maieure. Any restiction of beach maintenance services resulting from an act of God, lire, stike, accidenl, casualty, insunection, riot, or civil or military auhority shall not constiUte a breach of tris Agreement on fie part of Hollywood. 6. Prior aoreement amendments. This document supersedes all prior negotiations, conespondence, conversalions, agreement, or understandings applicable to the matters contained herein. Accordingty, no deviation from fie terms hereof shall be predicated upon any prior represenhtions or agreement whether oral or written.
