HomeMy WebLinkAboutO-1996-002ORDINANCE NO. 02-96 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, RELATING TO REVIEW OF DEVELOPMENTS OF REGIONAL IMPACT, PROVIDING FOR REVIEW AND ADVERTISING FEES; PROVIDING FOR SEVERABILITY, PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA FLORIDA; WHEREAS, Chapter 380, Florida Statutes, known as the Florida Environmental Land and Water Management of 1972, provides for the review and local action on applications for the development of large-scale developments, which are referred to as Developments of Regional lmpact (DRl), and WHEREAS, Florida municipalities incur substantial, non-budgeted costs in complying with the statutory review and advertising responsibilities; and WHEREAS, Florida municipalities have the home rule power under Section 2(b), Article Vlll of the Florida Constitution and Section 166.0'l 1, et seq., Florida Statutes (the Municipal Home Rule Powers Act) to impose DRI fees to recover the actual costs of reviewing and acting on applications for development approval and the advertising costs; and, WHEREAS, the City Commission finds that it is in the public interest to establish a DRI fee NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE 1 CITY OF DANIA, FLORIDA; ORDINANCE NO. 02-96 Section 1. A DRI fee shall be charged by the City of Dania for all applications submitted to the City under the authority of Section 380.06, Florida Statutes. The DRI fee is intended to reimburse the City for the direct and indirect costs of reviewing applications under Section 380.06, Florida Statutes, and for the costs of advertisements. Direct and indirect costs include, by way of example, but not as a limitation, the costs of consultants, such as engineers, traffic experts, environmental consultants, special counsel, and city employees engaged in the review of the applications and related documents, analysis of development impacts and preparation of mitigation measures. Section 2. The applicant shall pay to the City of Dania a DRI fee to be determined by the City Manager at the time an application is filed with the City, or as soon thereafter as is practical, and paid prior to the time that review commences on the application. The amount of the fee is intended to reimburse the City for its actual costs. The City Manager shall be guided by the following schedule: Minimum application fee $10,000.00 Maximum application fee $65,000.00 Non-substantive amendmentto DRI $ 4,000.00 Advertising $ 1,500.00 A non-substantive amendment to a DRI is an amendment to an existing, effective DRI development order that relates only to procedure and timing of development, or to determining whether a proposed change is a substantial deviation. Section 3. ln the event the DRI fee does not cover the cost of the review, the City Manager shall issue an invoice to the applicant for the additional cost. The invoice 2 ORDINANCE NO.02.96 shall be paid prior to the time that the City Commission takes final action on the application. lf the DRI fee is not paid for any reason, the City Attorney shall file a lien on the property for the unpaid amount. The unpaid amount shall accrue interest at the rate of '1 .5% per month. The City Attorney may commence lien foreclosure proceeding at any time after the lien is recorded and any amount remains unpaid- Section 4. lf any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not effect the validity of the remaining portions of this ordinance. Section 5 That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 6 That this ordinance shall be in force and take effect immediately upon final passage and adoption. PASSED AND ADOPTED on first reading on the 12th day of March, 1996.
