HomeMy WebLinkAboutO-1996-004ORDINANCE NO. 04-96 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING THE DEVELOPMENT ORDER FOR THE DESIGN CENTER OF THE AMERICAS DEVELOPMENT OF REGIONAL IMPACT ADOPTED BYCIry OF DANIA ORDINANCE NO 20, AS AMENDED BY CIry OF DANIA ORDINANCE NO. 04-84, CIry OF DANIA ORDINANCE NO. 22-84, CIry OF DANIA ORDINANCE NO. 05-87, CITY OF DANIA ORDINANCE NO. 02-88, CIry OF DANIA ORDINANCE NO. 23-90 TO MODIFY CERTAIN CONDITIONS RELATING TO THE DEVELOPMENT OF THE DESIGN CENTER OF THE AMERICAS DEVELOPMENT OF REGIONAL IMPACT AND TO MODIFY THE PHASING SCHEDULE DESCRIBED IN THE DESIGN CENTER OF THE AMERICAS APPLICATION FOR DEVELOPMENT APPRoVAL; PRoVtDtNG THAT ALL TERMS AND CONDITIONS OF THE DEVELOPMENT ORDER SHALL REMAIN IN FULL FORCE AND EFFECT, EXCEPT AS AMENDED BY THIS ORDINANCE; PROVIDING FOR SEVERABILITY; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania previously adopted a Development Order (the "Development Orde/') by Ordinance No.20 on September 13, 1983, approving with conditions the Application for Development Approval for the Development of Regional lmpact known as the Design Center of the Americas; and WHEREAS, the Development Order was subsequently amended by City of Dania Ordinance No. 04-84, adopted on April 24, 1984, City of Dania Ordinance No. 22-84, adopted on September 25, 1984, City of Dania Ordinance No. 05-87, adopted on April 14, 1987, City of Dania Ordinance 02-88, adopted February 9, 1988, and City of Dania Ordinance No. 23-90, adopted on May 8, 1990, and City of Dania Ordinance No. 47-91 , adopted on December 17, 1991;and 1 ORDINANCE NO. 04-96 WHEREAS, the Application for Development Approval approved by the Development order, described a phasing schedule for the development of the Design Center of the Americas; and WHEREAS, such phasing schedule has been subsequenfly modified by amendments to the Development Order, the last modification being made by City of Dania ordinance No. 47-91 which provides that the phasing schedule set forth therein shall be used in determining whether any future change in the phasing schedule constitutes a substantial deviation pursuant to section 380.06 (19), Florida statutes; and WHEREAS, the City of Dania has received a request from the Developer of the Design Center of the Americas to amend the Development Order, as amended, in order to further modify the phasing schedule described in the Application for Development Approval; and WHEREAS, the City of Dania has reviewed the proposed modification to the phasing schedule described in the Application for Development Approval pursuant to the criteria enumerated in Section 380.06(1 9), Florida Statutes (1995), and has determined that such proposed modification does not constitute a "substantial deviation" from the approved Development Order, as amended, requiring further development of Regional lmpact review. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. Section 4. lf any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this ordinance. Section 5. This item is a public hearing. A copy of the public hearing notice is attached. An extension of the time period for beginning of construction and operations of Phases 3 and 4 of this four phase development is requested. Please note that both the Department of Community Affairs and South Florida Regional Planning Council have found the proposed change does not create a substantial deviation. lt is recommended that findings be made that the proposed time extension does not create a substantial deviation and that the development order be amended. The proposed changes to the DRI development order are to extend the dates for construction and subsequently the operations of Phase 3 and 4. Phase 3 consists of 260,000 sq. ft. of showroom space and 120,000 sq. ft. of office space. Phase 4 is 190,889 sq. ft. of showroom space. When completed, the DCOTA DRI will consist of one million sq. ft. of showroom space, 180,000 sq. ft. of office space and 250 hotel rooms. The time extension requested is essentially five years. The attached submitted shows Phase 3 having operations being in 2000 as opposed to 1994-95 and operations for Phase 4 begin in 2003 rather than 1997-98. Section 380.06 of Chapter 380 of Florida Statutes (1995) deals with DRI's. Subsection 19 of this section deals with substantial deviations to a DRl. The proposed changes do not meet or exceed any of the thresholds which would cause the change to be considered a substantial deviation. The proposed changes to the development order does not increase the density of the development but changes only the timing of the development. According to Section 380.06(19Xc), "An extension of the buildout of a development, or any phase thereof, of 5 years or more but less than 7 years shall be presumed not to create a substantial deviation." PHASING SCHEDULE Page2 It should be noted that the development order adopted on September 13, 1983 was last amended by ordinance no. 47 -91 adopted December 17, 1991 . ln that ordinance a section was adopted indicating that the phasing schedule adopted in 1991 was to be utilized in determining whether any future change in the phasing schedule constitutes a substantial deviation pursuant to Section 380.06(19), Florida Statutes. A proposed change to a development order is done by local government but is also reviewed by the regional planning agency or the state land planning agency prior to the public hearing at which the proposed change is to be considered. The local government is advised in writing prior to the public hearing whether there is any objection to the proposed change. No objection letters were filed by both DCA and the South Florida Regional Planning Council. It is recommended the proposed change to the DCOTA DRI Development order be approved. The proposed ordinance adopting the revised phasing schedule finds that the proposed modification meets the criteria enumerated in Section 380.06(19), Florida Statutes (19g5) and does not constitute a substantial deviation. There are no additional regional impacts created by the time extension. The alternative of not extending the time period only results in the remainder of this project, which has proven to be of substantial benefit to Dania, not being built.
