AN ORDINANCE OF THE CITY OF DANIA, FLORIDA ,
AMENDTNG SECTTON 4 (J), ARTTCLE 3, PART il OF
THE CITY CHARTER REGARDING CONTRACTSFOR CONSTRUCTION, EXTENSION AND/OR
IMPROVEMENT OF PUBLIC WORKS UTILITIES;
AMENDING THE REQUIREMENT FOR
ADVERTISING FOR BIDS FOR CONTRACTS FOR
CONSTRUCTION, EXTENSION AND/OR
IMPROVEMENT OF PUBLIC WORKS UTILITIES
FROM $2,000 TO $15,000; PROVIDING THAT ALL
ORDINANCES OR PARTS OF ORDINANCES AND
ALL RESOUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT HEREWITH BE REPEALED TO THE
EXTENTS OF SUCH CONFLICT, AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Florida Statutes, Chapter 180.24 titled "Contracts for construction;
bond; publication of notice; bids." has been amended to increase the amount of
construction contracts that shall be advertised in a newspaper of general circulation
from $2,000 to $25,000, and
WHEREAS, the City Commission wishes to amend Section 4 O, Article 3, Part lll
of the City Charter, regarding contracts for construction, extension and/or improvement
of public works utilities to be consistent with the purchasing requirements authorized
for the other various departments of the city government,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA AS FOLLOWS:
1 ORDINANCE NO. 05-96
Section 1. That Section 4 O, Article 3, Part lll of the City Charter, be amended to
read as follows:
"To purchase supplies, services materials and equipment for the
various departments of the city government; and in such capacity
he shall have the right to purchase supplies, services, materials
and equipment for any department of the city in an amount up to
and including seven thousand five hundred dollars ($7,500.00)
whenever he deems it necessary and proper so to do. All
purchase of supplies, services, materials and equipment for the city
government in excess of seven thousand five hundred dollars,
($7,500.00) and in an amount up to and including fifteen thousand
dollars ($15,000.00) may be made by the city manager without
competitive bidding and without advertisement for bids if he is
authorized to do in advance by a resolution adopted by the city
commission. Contracts for the purchase of supplies, services,
materials and equipment for the city government in excess of
fifteen thousand dollars ($15,000.00) shall not be entered into or let
except by authorization and approval of the city commission, after
advertisement for bids in a newspaper published in Broward
County, Florida, which is generally circulated within the city limits of
the City of Dania, Florida, with such publication to be published
weekly for two (2) consecutive weeks with the first publication to be
not less than fifteen (15) days prior to the reception of bids.
However, during unusual conditions or emergencies, the city
commission may, by resolution, authorize the purchase by the city
manager of designated supplies, services, equipment and
materials in amounts in excess of fifteen thousand dollars
($1 5,000.00) without competitive bids and without advertisement
for bids.
That in addition to the foregoing, the city commission may, by
resolution, authorize the purchase of designated supplies, services,

equipment and materials in amounts in excess of fifteen thousand
dollars ($15,000.00) without competitive bids and without
advertising for bids if such purchases are made pursuant to a
competitive bid obtained within the last twelve (12) months by other
governmental entities such as the federal government, the State of
Florida or a Florida county or municipality."
Section 2. That all resolutions or parts of resolutions and all ordinances and
parts of ordinances in conflict herewith be and the same are hereby repealed to the
extent of such conflict.
Section 3. That this Ordinance shall be in full force and take effect immediately
upon its final passage and adoption.
