HomeMy WebLinkAboutO-1996-015ORDINANCE NO. 15-96 A ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING SECTION 4-36, ARTICLE II OF CHAPTER 4 OF THE CODE OF ORDINANCES OF THE CIry OF DANIA, FLORIDA, ENTITLED'ALCOHOLIC BEVERAGES", EXCLUDING MODELLO PARK AND PATRICK J. MELI PARK AS EXCEPTIONS TO THE PROVISIONS OF SAID SECTION; AND PROVIDING THAT ALL ORDTNANCES oR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That Section 4-36, Article ll of Chapter4 of the Code of Ordinances of the City of Dania, Florida, be and the same is hereby amended to read as follows: "Sec. 4-36. Alcoholic beverages upon public beach and other publicly owned areas prohibited with exceptions. "lt shall be unlawful for any person to drink, sell, dispense or manually possess any alcoholic beverage in an unsealed and/or open container upon the city's public beach and recreation area, as defined in Part 1, Article 1, Section 7 of the City of Dania Charter, or upon any other park, recreation area or publicly owned lands within the parking area or parking space adjacent to or abutting said beach, park recreation area, or other publicly owned lands within the corporate limits of the City of Dania, Florida. The provisions of this section shall not apply to the l.T. Parker Community Center at Houston Park, the leased area known as the Dania Beach Grille, the area of the Dania Fishing Pier (located above ground and above the water, but shall apply to the beach area underneath said structure), and the leased area commonly known as Sea Fair, which said leased areas are described in the existing 1996 Lease & Licensing Agreement between the City of Dania and Board of Regents of the State University System of Florida, copies of which are on file in the office of the City Clerk." 1 ORDINANCE NO. 15-96 section 2. Except as herein amended, all other provisions of said Section 4-36 of the code of ordinances of the city of Dania, Florida, shall remain in full force and effect. Section 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. section 4. That this ordinance shall be in force and take effect immediately upon its final passage and adoption. PASSED AND ADOPTED on First Reading on the 1Oth day of September, 1996.
