Ralph Hernandez and Deputy Terry 1 Hanstein who are working with the DUI Enforcement Program. He asked that ' Sgt. Hernandez present an overview on the successes of the program and future "t objectives for the upcoming year. ! Sgt. Hernandez, explained that the grant was obtained from the State of Florida a' a `> Department of Transportation Highway Safety Fund. The grant was initiated by t the City of Dania on November 16, 1995, because the City was ranked the second highest in Broward County for alcohol related deaths. The grant ' provides one full time deputy with a fully equipped vehicle and an educational ' program for schools. Sgt. Hernandez advised that Deputy Hanstein has been ; certified as a DUI Instructor and educated on other techniques relating to the DUI process. Sgt. Hernandez mentioned that grant funding has been requested for the second year. Civic Associations were advised that BSO is available to make presentations to them on the DUI Program. tJ 1 Chief Frey mentioned that the program has been very successful and that the ' department is carrying out a heavy educational program on the subject. BIDS ° J ", 3.1 Staff recommendation on awarding RFP for Basic and Supplemental Life ' Insurance Plans. fi• , j City Manager Smith explained that Monica Griffith, Personnel Director, r ; advertised for an RFP to renew the City's life insurance contract 'y with the assistance of Mary Stanford, the City's Insurance Consultant. r Mary Stanford, Insurance Consultant, advised that the three companies who ' , ` 1t. ' submitted proposals were Royal Maccabees, Standard of Oregon and Trans- General. Royal Maccabees is being recommended because of its stability and rating in the insurance industry as well as its long term standing with other citiesy like Coral Gables, Sunrise and Cocoa Beach. The Royal Maccabees rate is the same as American Life which was the City's prior company. The City must ` change companies because American Life has merged with another company. ' b Even though Trans General's rate is the same as Royal Maccabees, it is not a being recommended because of recent downsizing in the company that shows instability and due to their 25% participation requirement for the supplemental life insurance. (Second Reading of Ordinance) City Manager Smith advised that the original "Alcoholic Beverage" ordinance ` excluded all parks from alcohol consumption with the exception of Modello Park w. a and Patrick J. Meli Park. The proposed ordinance removes those exemptions so k= that all parks are excluded from the consumption of alcoholic beverages. a. Commissioner Hyde clarified with the City Attorney that the City Commission will r '• >' still be able to entertain exceptions for serving alcoholic beverages for special y'' events at the parks. r, Mayor Bertino opened the public hearing. ` i Mr. Buchsbaum mentioned that the Griffin Civic Association has a few events +J that serve beer and wine. Mr. Buchsbaum was directed to bring any future requests to serve alcohol to the attention of the city manager so that the issue Gk h ' can then be brought before the City Commission. Hearing no further comments, the Mayor closed the public hearing. A motion was made by Commissioner Hyde, seconded by Commissioner Jones, to adopt the Ordinance on second reading. Section 4.202 requires a minimum side yard setback of 20'. 2) To construct a building addition which has a height of 47'6". Y Section 4.202 indicates the maximum height is not to yy exceed 35'. Will Allen, Growth Management Director, advised that the property is located on the north side of the Dania Cut off Canal and involves parcels A & B of the Trans World Plat. The Planning and Zoning Board recommended approval based on , the variances complying with the regulations in Section 10.13 of the Code. The ry a variance request fora 47'6" height on the building is needed to work on larger boats. The larger setback variance is needed to provide a fire lane and room for �y , '. Mr. Allen was 'T ,�f c pleased to mention that the EPA (Environmental Protection Agency) in Chicago is presenting Associated Marine Technologies with an award for the way that they deal with painting and dust control. r Scott A. Miser, President and owner of Associated Marine Technologies, Inc., requested approval of the variances to assist him in conducting his business in t the City of Dania. s Mayor Bertino opened the public hearing. Commissioner Mikes recommended placing a condition on the variance approval to require one more review by the Fire Department to ensure that all fire safety ' issues have been addressed. F�.. The proposed south side addition is 12,030 sq. ft. and the yr s north addition is 4,000 sq. ft. for a total of 29,888 sq. ft. on the site. . Will Allen, Growth Management Director, presented the site plan and r 7 k recommended approval. r , A motion was made by Commissioner Mikes, seconded by Commissioner Hyde, to approve SP-26-96 with the conditions included with the variances under 4.2. r4 1 Commissioner Hyde commended Associated Marine Technologies, Inc. for ; receiving national recognition by being awarded by EPA. y r r f V tAl a; Mr. Scott Miser, President of Associated Marine Technologies, Inc., mentioned ' that EPA is awarding around 25 marinas out of 1500 to 2000 across the country. J Y ` City Manager Smith mentioned that the business located on NW 1st Street is having problems relating to criminal activity, fire code violations, and site plan r, issues. There are also come minors hanging out late at night at the business which has caused a need to review the City's Curfew Ordinance. Mr. Smith mentioned curfew ordinances have recently been adopted by a number of cities in Dade and Broward County. The City's current ordinance provides for children under 18 to be off the streets by 9:30 p.m., but it has not been rigidly enforced since 1971. He requested direction from the Commission on whether they wish to enforce the ordinance or revise the curfew times. >, Vice Mayor Grace mentioned that the curfew ordinance in Dade County has not p` 4 worked very well. There was concern mentioned that police officers may be taken away from important law enforcement issues to arrest children. Vice Mayor Grace stressed the need to create activities at Modello Park as an } alternative to keeping minors off the streets. It will also help to work with h "; £ homeowners associations to help children in the community. ?� J l P 3. Attorney Adler stated his opinion that the curfew ordinance is good because it provides the police with discretion in arresting children. The ordinance also places the responsibility on the parents or adults to comply with the curfew requirements. ' Chief Frey, BSO, agreed with Vice Mayor Grace that it is not right to arrest ' children and that the root problem is with the families. HRS and BSO do not ` have the staffingrequired to hold juveniles. Chief Frey recommended to address q J Y ` f the problem by working with the neighborhood organizations, churches, MUPA .r and MADDADS to keep the children with their families. a Discussion followed on the business being cited for public nuisance and the rir difficulty that BSO has with tying crime to the location. Chief Frey mentioned ' ;t that BSO is working with ATF (Alcohol Tobacco & Firearms) to shut down some x. " of these businesses. Commissioner Mikes suggested to have the Mayor send a yev t letter encouraging ATF to take action. 4h• 1..1Yy Commissioner Hyde recommended to draft an ordinance that would hold the ' property owner responsible for violations committed by persons who are renting the property. Other suggestions were to deny their occupational license from t being renewed or pulling the liquor license. tt . City Attorney Adler suggested to allow him time to research NIMLO for ordinances dealing with this type of problem. Mr. Peterman came forward to state his willingness to serve again and attend the election meeting scheduled October 9, 1996. A motion was made by Vice Mayor Grace, seconded by Commissioner Hyde to adopt the resolution appointing Jimmy Peterman to the Committee for Community Development. The motion passed unanimously. �3 x, 8.3 Request by Mamie Gooden-Lee to waive interest and recording fees on liens applied to property purchased at public auction previously owned by Lillian Jones and Mack Richardson (folio #0234-01-265). 1 � City Manager Smith recommended to continue the item since the petitioner is not present. �1 Commissioner Mikes requested that an ordinance be prepared by the City 4s Attorney requiring a 4/5 vote of the Commission on waiving City fees or debts. Commissioner Jones agreed that the city should not waive liens for individuals t . 1 Kr a" buying property and making a profit. City Manager Smith clarified that the petitioner is asking for a waiver on interest and recording fees and not the actual cost. A motion was made by Vice Mayor Grace, seconded by Commissioner Hyde to continue the item to the next regular meeting. The motion passed unanimously. 8.4 Request by Betty Baron Bernstein to waive liens applied against tax folio #0233-13-001 upon donation of property to Dania Economic w. . Development Corporation. A motion was made by Vice Mayor Grace, seconded by Commissioner Hyde to waive liens in the amount of$3,941.64. y; } Commissioner Mikes reminded the Commission that there is a policy to obtain a financial statements from any organization receiving or waiving tax payer funds. Vice Mayor Grace stated that there would be no problem with DEDC submitting "• the records. t". 7•` " Mayor Bertino clarified with the City Manager that Mrs. Bernstein is going to i donate the property to DEDC for the waiver of these liens and that she will not receive an exchange of money. City Manager Smith stated that Mrs. Bernstein owns several properties that also have liens filed against them and that it is his ` understanding that the property is only being donated. COMMISSION COMMENTS j d 11.1 Commissioner Hyde - Commissioner Hyde commented on the positive meeting with the Dania Marine t` Trade Association today and thanked the City Manager for his efforts with the organization. }ry ;t. 11.2 Commissioner Jones - Commissioner Jones mentioned a letter received from Clara Randall advising j that she can no longer continue as crossing guard at 10th Court/1st Street for Collins Elementary School children. Discussion followed on the need fora a { ' crossing guard at the location and the City being responsible for incurring the t µ, cost. w In response to Commissioner Jones, City Manager Smith advised that there are ar 23 agencies participating in the Telecommunications consortium. There have also been inquiries from Metro Dade County wanting to join the consortium. Mr. ` Smith expected to have the model ordinances ready by the beginning of October # and advised that representatives from the telecommunications industry are a expected to speak at the October 10 meeting. Mr. Smith clarified that the ra intentions of the consortium are not to thwart the efforts of the communications ' industry to bring the technology forward. The consortium wants to ensure that public right-of-ways are protected and that the equitable revenue streams derived from telecommunications remain in tact. She understood the position salary to be around $6,000 a year with no x`^ benefits. City Manager Smith advised that crossing guards have to be sent for extensive training under state law for insurance purposes. He agreed to review the request in preparation of the budget meeting tomorrow night. ts'; On Saturday, Vice Mayor Grace was honored at the Pier 66 Hotel by the Linx Corporation along with seven other black females. Bud Palm, Utilities Director, was asked to remove dead palm tree limbs near Modello Park. zM •yµ r Vice Mayor Grace expressed her dissatisfaction with the comments made by Fort Lauderdale Commissioner, Carlton Moore, in a recent newspaper article ;' `I ' regarding the proposed homeless facility. r, ' q ti Vice Mayor Grace presented a request to use the City's bus and obtain s donations from businesses to purchase tickets for children to attend a concert at ? BCC Community College being held September 28. She mentioned that $600 is needed by Friday. (H� r r? ,; Vice Mayor Grace was pleased to say that her daughter is out of ICU. 11.5 Mayor Bertino Y Mayor Bertino mentioned the need to do something about the zoning on K Sheridan Street. He asked that staff contact FPL and Southern Bell regarding r, t1 ' the problem with multiple poles in one location. f ! Mayor Bertino mentioned that the County Commission may be under the impression that the City of Dania may want to have a choice between a Work ' i c Release Program or a Homeless Shelter. Mayor Bertino restated the City's position that neither option is acceptable. District regulations are outlined in Article V of Chapter 2 of the Dania Code of Ordinances. The district was established to be eligible for grant funding for planning grants which were available at the time. Dania received $30,000.00 from DCA for >` technical support in preparing the Safe Neighborhood District Plan. The legislature did j not fund such districts after the first year. Now such special districts have to pay annual i F'= fees of $175.00. Since the district is inactive, it is suggested that the district be dissolved. The Safe Neighborhood Committee was abolished in 1993 by Resolution F 4 i v` No. 76-93. In discussing this matter with a representative of DCA, it was indicated that dissolution of these boards has been quite common as no state funding is available. If you concur, an Ordinance dissolving the district by repealing Article V of Chapter 2 should be prepared. While Trans-General probably would accept current enrollment, we believe there is significant risk as to whether the City will be able to maintain a iufficient level of enrollment to prevent cancellation by the insurer in the future. Supplemental Life is optional and may be selected or refused by employees at each annual open enrollment period. Since this is the first anniversary date of the Cafeteria Plan installed January 1, ?• 1996, employee participation is an unknown factor. The City historically has experienced problems with employees expressing interest in { purchasing supplemental life coverage, but failing to follow through with enrollment when ( 'j the opportunity is presented by the City. This is a serious consideration since cancellation f due to insufficient enrollment would impact everyone enrolled in the Supplemental Life t ; coverage as part of their Cafeteria Plan Elections. Seizure and confiscation. (a) Upon the arrest of any person charged with the violation of any of the provisions of this division, it shall be the duty of the arresting officer to take into his custody any such machine, apparatus or device and their contents, an the chief of police at the place of seizure shall make a complete and correct list and inventory of all such things -taken into his custody and deliver a true copy of the list of such articles to the person from whom such articles may have been seized. L Each City may elect to implement a "blue bag" process for recyclables generated at single family residential dwellings > Y ellmgs within the boundaries of each of the , respective Cities for delivery to the Corporation aggregated with other Acceptable Waste as defined in the SWDA. As a further consideration, the Corporation agrees to set the surcharge for disposal of residue under the S WDA at a rate of$1.50 per ton beginning January 1, 1996 � subject to all the terms and conditions as provided in the SWDA. 4.
