TELECOMMUNICATIONS GROUP INTERLOCAL AGREEMENT WITH

Commissioner Jones expressed concern that the Telecommunications Act of r
} l 1996, recent)
r y passed by the legislature, has very few restrictions placed on it
v,' about who can conduct business. It was his understanding that cities will # `
} I continue to have right-of-way, infrastructure and utility rights but may lose
franchise fees.

5 : - A motion was made by Commissioner Jones, seconded by Commissioner Hyde
to adopt the resolution.
Commissioner Hyde expressed his opposition to the interlocal agreement based ;it`r
on his opinion that Telecommunications should not be regulated by cities.

Commissioner Jones mentioned that the interlocal agreement will provide a timea
frame for municipalities to review the new legislation in regards to franchise fees
for cities.

Mayor Bertino opened the public hearing. Hearing no one speak in favor or !
opposition, the Mayor closed the public hearing.
A motion was made by Commissioner Hyde, seconded by Vice Mayor Grace to
j amend the Ordinance by striking Section 9B on Page 10.

t Commissioner Hyde withdrew his motion. }
' Commissioner Hyde then amended Section 9, Subsection 513 to read "No more
i l y than 8 newsracks may be located in one location (two-hundred (200) foot space)
,
or more than sixteen (16) Newsracks for any one block". The motion was
seconded by Vice Mayor Grace.
City Manager Smith pointed out that Section 9, Subsection 5 already
q • incorporates the wording in the motion.
Commissioner Hyde withdrew the second motion and returned to the original
' motion to strike Section 96, seconded by Vice Mayor Grace.
The amended motion passed on the following roll call vote:

8.1 Request for a temporary tent for Tile International, Inc., 1190 stirling road from x'
September 2 to September 7, 1996. s
Will Allen, Growth Management Director, presented the request for a 20'x6O'
temporary tent for tile International, Inc. from September 2 to September 7. Staff F ,
7 ;` recommended approval as long as the required permits were obtained for z;
{ry building, electrical and fire.
A motion was made by Vice Mayor Grace, seconded by Commissioner Hyde to
I approve the request.

Will Allen, Growth Management Director, explained that an annual review is
required on auctioneer licenses according to the code and that the background
check through the Florida Department of Law Enforcement shows no record
against Ms. DeCosta. Mr. Allen clarified that the Division of Law Enforcement
Provides a state search only and that the City cannot conduct a national search.
Viviane DeCosta, ABC Thrift and Auction Store, presented background
information on her involvement with charity work for mentally retarded children.
She stressed her desire to use only licensed auctioneers for her business and
her willingness to change the store to a thrift store if parking becomes a problem.
d _ A motion was made by Commissioner Jones, seconded by Vice Mayor Grace to
approve the request for an auctioneer license for Viviane DeCosta, ABC Thrift
'? and Auction Store, 100 South Federal Highway with the conditions of a 6 months
G review on the license and auctions one night a week evenin s only.

Commissioner Mikes asked staff to review the legal language to ensure the 'I

j City's authority to include parking as a criteria for the license.

8.3 Report from Marine Advisory Board. �� ,
5 Craig McAdams, Chairperson Marine Advisory Board, presented the board's
r concerns regarding the need to remove the submerged broken pilings located
north of the pier and the need for something to be done to ensure better
f r' cleanliness at the pier. Other concerns listed were the shoaling on the C-10 a� y
t Canal and boat ramp launching at the I.T. Parker Center during low tide.
City Manager Smith mentioned that Coastal Systems was granted an extension
t to remove the pilings and that he would check with them on why this has not
been completed. Commissioner Hyde requested City Manager Smith to contact
' Ken Banks, DNRP, at 519-1200 as they are suppose to be the recipient of the
a pilings.

Commissioner Hyde mentioned the need for signage to be added on the
bulkheads on the canals so that Waterway Law Enforcement can locate
problems better. Mr. McAdams agreed to provide volunteers to put up signs if
the City can make the signs from their sign machine.
c The Commission agreed that a pressure cleaner is needed for the bait area at
the pier.

11. COMMISSION COMMENTS
11.1 Commissioner Hyde
Commissioner Hyde was sorry that Paul Demaio was unable to attend tonight's
meeting since the City passed the Resolution congratulating the Broward County
Library for being awarded "Library of the Year".
He encouraged residents to participate in the coastal cleanup for the beach area

on September 21.
}; Commissioner Hyde was pleased that the entire City Commission attended the
IGFA event held last Friday at the Graves Museum which will be very good for 4
the City.

11.2 Commissioner Jones ;
Commissioner Jones acknowledged St. Ruth Baptist Church for celebrating their
r 88th Anniversary and thanked those members who celebrated 50 years or more
service in the church. Condolences were expressed to Reverend Thigpen, Mt.
Zion Church, on the loss of his daughter due to a recent accident. ,
E Commissioner Jones commented on the IGFA event and mentioned his Q ' !-
% attendance at the Davie Dolphin Day.
{{ City Manager Smith advised Commissioner Jones that the engineers are
r evaluating the Emerald Lake Village property. Commissioner Jones asked to be r'
supplied with a tonnage report from Southern Sanitation. e
t t', Happy Birthday was extended to Addie Hatfield who turned 83 years old

11.3 Commissioner Mikes
' Commissioner Mikes was pleased with the IGFA presentation of the Bass Pro
+, project on Friday. He mentioned that Robert Flatley, previous City Manager, was
' { very involved with the project coming to the City.
11.4 Vice-Mayor Grace

Vice Mayor Grace was impressed with the Housing Authority's actions to hold a
party at the Saratoga Apartments where backpacks and gift certificates were
handled out. She attended the Fund-raiser held at Air Dania for the young man
who was killed recently in the phone booth and was glad to report that over
$2,000 was raised for his funeral.
She was appreciative that the entire Commission was in attendance at the IGFA
event at the Graves Museum.

The significance and impact of the Telecommunications Act of 1996 on all of our communities °4
cannot be over emphasized. No city can stand alone on this vital issue. The industry giants have
already spent millions of dollars on lobbyist that virtually wrote the laws and has paid more than
` nine (9) billion dollars to the FCC simply for the licenses to do business in our community. The i
battle for our R.O.W., public lands and tower sitings isjust beginning, There has been a variety of a{
responses from several cities in, and including, Broward Count ?, I

The most successful strategies have been developed in sophisticated parts of the country that have
recognized the wisdom of working together to provide a degree of uniformity in their respective
j ordinances. From a planning, legal and financial perspective, it simply makes good sense.

As you probably know, five cities (and more recently Broward County) were the first to receive
! r cable franchise proposals from BellSouth. The company is BellSouth Interactive Media Services y ,
{ ; (BIMS) which includes BellSouth, Ameritech, GTE Corporation, SBC Communications (formerly V
1 t,`
Southwestern Bell and The Walt Disney Company.
Their obvious game plan is to establish a strategic base in Broward County by cherry-picking
cking
growth cities from which they have a more realistic chance to get some immediate revenu s.some The
i cities are Coconut Creek, Coral Springs, Davie, Miramar and Pembroke Pines. Faced by this
urgency, these five cities are entering into an Interlocal Agreement to share the services of a
consultant, Mr. Joe Van Eaton, an attorney with Miller-Canfield (he was a featured speaker at the
Florida League of Cities Conference) who will work with us to prepare appropriate legislation

temporary tent adjacent to Tile International Inc, at 1190 Stirling Road. The 20' x 60'tent would be in the parking lot at the northeast corner of Stirling Road and Phippen / ~`
` Waiters Road. Section 33-44 of the Zoning Code requires that the City Commission f
approve businesses operating in tents, j
The request is for a sale on Monday, September 2 through Saturday, September 7.
> This is the first request made for a tent at this location. No extraordinary problems are
F. anticipated if the request is granted. It is recommended that approval be given.
Should the City Commission approve the request, a building permit will need to be
requested and approved by the Building Official and Fire Marshall. They check for the
I;S certificate of flame resistance on the tents and make sure the circulation of vehicles and
people is safe. An electrical permit is required if any power is supplied to the tents.

j An application for an auctioneer license from Viviane DeCosta of ABC Thrift and
Auction Store proposed for property at 100 S. Federal Hwy, is attached. This site is
within the Dania Shopping Center. The Fayva Shoe Store was formerly at this location.
Section 21-51 of the Dania Code of Ordinances requires that an auctioneer license be
reviewed and granted by the City Commission on an annual basis.
The City Commission conducts a hearing concerning the application. Notice of the
hearing is given in writing to the applicant with notice being mailed at least five days n
prior to the hearing date. The applicant may be represented at the meeting by counsel.
1 Please schedule this for the August 27, 1996 City Commission meeting. f
Section 21-52 (d) explains the criteria by which the City Commission may refuse or
revoke an auctioneers license. This criteria concerns the moral character and business
z responsibility of the applicant such as reviewing a history of fraud or crime convictions.
Section 21-52(c) indicates that such application shall be referred to the chief of police
who shall cause to be made an investigation and certify to the city commission whether
or not the moral character and business responsibility of the applicant is satisfactory. t_
Chief Frey of District ll, BSO indicates that he cannot perform this function for the City.
k! F ; A memo from Chief Frey explaining why such a background check can not be done is
' i attached. BSO referred us to the Florida Department of Law Enforcement (FDLE) as a
way to obtain a state criminal records report. The report on Ms. DeCosta indicates "no
record" based on the name and social security number. I am very uncomfortable with
this type of report. We do not have any expertise or experience in background
investigations. The background check only covers the State of Florida.

Dear Mike,
I would like to placed on the ajenda for the next city
commission meeting to make a quarterly report from the #
marine advisory board. The items to be presented come
from the minutes of our meetings and are as follows: _ n
1 . There exist disused concrete pilings on the north

side of the fishing pier that pose a threat to anyone that may venture near them. We reccommend they be
removed prior to an accident occurring. ;I
2. The fishing pier has rotting bait and fish residue on

�f the deck and should be recieving a regular cleaning. "
Due to the idstance to the rest rooms, guests are
urinating on the end of the pier and the smell is very
disturbing.
3. We reccommend a clean up of the banks of the
Dania Cut off Canal. Dead trees and debris line the
sides of the canal and it is very unattractive.
4. Shoaling has been reported on the east side of the

c-10 and the Dania Cut off Canal where they meet.
5. We are awaiting permission to erect a sign on the
intersection of the Dania Cut off Canal and the I.C.W.
To aid visitors and identify the canal.
6. The ramps at I.T. Parker have a hazard that needs to
be resolved in that a drop off exists beyond the concrete
I t ' slab and trailers get stuck on a regular basis. ,

may be necessary. The chief of the fire department shall be appointed by resolution
adopted by the city sommissien (manager). All subordinate officers, firemen
(firefighters) and employees shall be employed and appointed by the chief of the fire
