He recommended to have the City's Special Attorney, Earl Gallop, Esq. review the language before approving. (First reading of Ordinance) Vice Mayor Grace suggested to continue the ordinance until the Commission has had an opportunity to review the upcoming budget scheduled in July. The ordinance affects the Fire Department which is ( ; •' one of the City's major expenditures. ' E � j City Manager Smith explained that this ordinance implements contract r' language that has already been approved in negotiating the Collective ''. 3 Bargaining Agreement. The option will be exercised by individuals and iFbargaining not as a bar ainin unit. The sole cost 9 9 will be aid b the employee. .p y plo ee. The - City y of D., y Dania has no obligation to the Policemen in the plan for this ' benefit. Signed releases have been obtained from the 14 officers recognizing their full financial responsibility and clarifying that there will U not be any precedent set in relation to what the Fire Department , v= negotiates in the future. 1 Mike Brown, President of the Metro Broward Professional Firefighters, y explained that the ordinance will allow older employees to leave so that "M t new employees can be hired at a lessor cost and savings to the City. He didn't expect too many employees to take advantage of the benefit since t 1 ,n a cost evaluation found 21 months to cost $27,000 for one employee. tt� City Manager Smith explained that the total payroll will be reduced if some `f( n } of the higher paid long-term officers in the Fire Department exercise this k benefit. This is not like the HollywoodPlan incentivesre 6s yk i an where we Mi y� provided for employees to leave early as employees are going to pay for 4' the cost. r A motion was made by Vice Mayor Grace, seconded by Commissioner ' I Jones to adopt the ordinance on first reading. Mr. Allen advised that code violations are not part shy . of the criteria outlined in the Code for Auctioneers Licenses. Attorney �µ Ryan mentioned that the wording in the code relates to the operation of the business like parking or safety issues. The request is unusual and staff is requesting direction from the Commission as the petitioner would like to keep the structure on site for one year to develop their idea. No one from Builtmore Construction was present to respond to questions. A motion was made by Commissioner Hyde, seconded by Vice Mayor Grace to table the request until the petitioner can be present to provide s backup information. V { c II A City Manager Smith reported on the improvements being made to the southwest section of the City with the assistance from the College Gardens Neighborhood Association. F" Merita Mitchell, College Gardens Neighborhood Association, requested ;i Commission approval for the association to officially adopt Ely Boulevard and Phippen/Waiters Road. The association's intent is to work with the City Manager in beautifying the streets as they have with the exit ramps coming off Stirling Road and 1-95 through the Department of Transportation. Commissioner Hyde suggested to set up files on adopted streets and to p tis�l approve the request by Resolution. f A motion was made by Commissioner Jones, seconded by Commissioner Hyde to approve the request to adopt Ely Boulevard and Phippen/Waiters t� Road by the College Garden Neighborhood Association. r. + r k ♦Y.. i" � vi-t V� J �1. Residents are not abiding by the regulations for the trash pickup by mixing garbage items and making trash piles too large. The A '* City is going to start enforcing the guidelines and residents will be cited for special pickups. Vice Mayor Grace stressed the need for Southern Sanitation to advise the City when they are unable to stay within their trash pickup schedules. Vice Mayor Grace explained that Norman Abramowitz contacted her to represent the City of Dania and renew the City's membership at the Broward League of Cities. City Manager Smith advised that the City Commission generally agreed that the Florida League of Cities provides 5 ' more benefits. Commissioner Mikes and Commissioner Hyde opposed the membership renewal. hI Vice Mayor Grace requested City Manager Smith send a letter to the i Broward League explaining the City's reasons for not renewing the j membership. .. ADMINISTRATIVE REPORTS ' 10.1 City Manager ( *Workshop Meeting June 18, 1996, 7:30 P.M. - Discussion of Capital Improvements/Assessment Programs City Manager Smith advised that Ronald Zielinski has resigned from the Dania Housing Authority and that the appointment information will be included on the next agenda. City Manager Smith commented on the items scheduled for the Workshop Meeting on June 18., REGULAR MEETING 8 JUNE 11, 1996 t 1 I i a i y.. a � Il 1 , 11.2 Commissioner Jones Commissioner Jones agreed with Commissioner Mikes that there is a need to plan two ` or three years in advance on the City's financial position. Citizens were encouraged to attend the Youth Revival at St. Ruth's Baptist Church that is ongoing through June 14. Commissioner Jones commented on the Friends of the Library event that commended Paul DeMaio and Vito Mancino. Commissioner Jones mentioned the partnership with the School Board and the Center for Environmental and Educational Resources, Inc. He asked the Commission to consider the possibility of utilizing a safety training course at Tigertail Lake Park for deserving individuals from Dania who want to learn water sports. Classes would start on July 6 and continue July 13, July 20 and July 27. ' Commissioner Jones mentioned that street lights seem to be out throughout the City. ` City Manager Smith advised that the City is in touch with FPL on a regular basis. Mr. a, Smith thought that service is most like affected by the cut backs at FPL. 11.3 Commissioner Mikes lM Y I =f a Commissioner Mikes recommended to prepare a five year financial projection to have a IF better handle on the City's necessary costs. Z i City Manager Smith advised that FPL has filed a Motion with the Court and that Bruce y Johnson, the City's Liability Attorney, is handling the case. The Wackenhut case is ' expected to be heard on a Trial by Judge basis soon and depositions may be scheduled this week. f� Y .tl Y 1 r 11.4 Vice-Mayor Grace Vice Mayor Grace expressed appreciation for those who have been so supportive with her daughter's recent illness, , i City Manager Smith advised Vice Mayor Grace that he addressed the problem with the t` Halley Family and that another letter is being sent out. The Northwest Byrd Point Civic Association is holding their first Father's Day Banquet at Modello Park at 8:00 p.m. on Friday and tickets are $10.00. Vice Mayor Grace asked that the concession stand be checked for safety at Modello Park since summer programs are starting. Will Allen, Growth Management Director, clarified that a public hearing is being conducted to hear the Special Exception request involving 4.446 acres of property on the north side of Sheridan Street. Properties directly impacted by the request are located on the south limits of the City, vacant land east and west along Sheridan Street that is zoned C-2 -commercial use and the residential development known as the Sheridan Ocean Club. The petitioner, FPL Company, is requesting to locate an electrical substation on the site owned by r DOM Inc. (Diocese of Miami.). The public hearing was advertised in the Sun F 1 Sentinel and notice was placed on the property. Mr. Allen explained presented the definition of essential services as stated in r" Chapter 28, Article 2 "Definitions" number 23 of the City of Dania Zoning Code „=r as follows: SCYP Essential Services. Public utility facilities related to the water, sanitary sewer, storm drainage, solid waste, telephone, cable 6 television, gas and electrical collection or distribution systems r , serving the City but not including buildings housing employees; or public safety facilities such as fire and/or police stations. Mr. Allen advised that the criteria for a Special Exception is found in Chapter 28, Section 6.40 of the Zoning Code and that the City Commission has the ability to approve or deny the special exception or approve with conditions. Ronald Mastriana, Attorney for ll FPL, presented aerial maps showing the location and surrounding areas. He explained that FPL had two alternatives (1) Develop the Liberia site for a4 { substation and increase the capacity of the existing substation or (2) Develop a T ;} substation on the proposed Prospect site. FPL chose the Prospect site because '" r k the cost would be in excess of a million dollars to develop the Liberia substation r + ' a• and increase the existing substation with additional transmission lines. = Law governing FPL: I Mr. Mastriana advised that FPL is mandated by the Florida Legislature to provide " k sufficient power to citizens. The Public Service Commission is responsible for rl < the regulation of each FPL site and to ensure that each site does not , in anyk. ' way, affect the public welfare. In addition, the Department of Environmental t+ u a= ` Protection has exclusive jurisdiction in the regulation of electric and magnetic fields associated with all electric transmission, distribution lines and substation facilities. Therefore, these two entities govern the affects of each substation in r i ` regards to the public. He further explained that the City signed a franchise agreement with FPL in 1978 3 which mandates FPL to provide electric service to the City of Dania and provides for substations located in the City of Dania to service citizens outside the City i according to Ordinance No. 173. J4 Ys A short video was heard at this time. After being sworn in, the following individuals spoke. REGULAR MEETING 6 MARCH 26, 1996 ; & r A y MW5 y R t . 3 Michael Hernandez, Senior Engineer South Area Planning, Distribution Planning for FPL, presented growth forecasts determining his recommendation to construct the Prospect Substation. !'4 ` Attorney Mastriana clarified that Mr. Hernandez presented reasons why a j substation is needed in the City of Dania and why the substation is an essential j service. Ronald M. Rowars, Rowars & Tapper, P.A., representing the Southeast Dania ' Coalition of Concerned Citizens, explained that the coalitions a non-profit group . formed for this issue. Mr. Rowars cross-examined Mr. Hernandez. Mr. Hernandez discussed the measured low growth from 1992 to the summer of l 1995 for the Prospect load area and the entire City of Dania. He distributed a j i 1r "Population Forecast by Jurisdiction" report produced in 1995 by the I ;� Comprehensive and Neighborhood Planning Division for Broward County's Evaluation and Appraisal Report. Commissioner Mikes was concerned that the report was based on the 1990 City Master Plan which did not include the j acquisition of all properties along SE 5th Avenue for park area nor the proposal for the expansion of the South Runway at the Fort Lauderdale-Hollywood z International Airport which could decrease population. Mr. Mastriana advised that the data from this report was presented at the Planning & Zoning Board �± Meeting. The data was based on actual growth in usage in Dania which determined the 5% growth and the difficulty in providing reliable service by 1998. Anthony Stevens questioned why FPL cannot locate the substation in 'r Hollywood? Mr. Mastriana clarified that there are five substations outside the City of Dania that service the City of Dania. Under current conditions, almost 50% of Dania's power will come from outside the City. A portion of the Prospect • t side will service the City of Hollywood but there are also two substations in the City of Hollywood that service Dania. " 7, q Commissioner Hyde confirmed with Mr. Hernandez that the measured growth r ; number was 4.5% for Dania from 1992 to 1995 and that the 8% referred to the i measured growth in the Prospect area (SE 6th Street to Taft Street and from the Atlantic Ocean to 1-95.) Attorney Mastriana explained that FPL reviewed sites in a mile and a half radius from the existing Dania Substation and found no other vacant lots approximately five acres that could be secured except for the Prospect site. Mayor Bertino asked whether the existing facilities could be expanded to take care of the projected power needs? Mr. Hernandez advised that another substation would have to be built in addition to the existing station in the southeast area of Dania. The Liberia site is a possibility but is not recommended because of cost and size. The Public Service Commission requires FPL to be cost effective in their expansion efforts and the 5 acre Prospect site provides a better aesthetic site for the substation. Mr. ' Hernandez stated that the locations of the Hollywood substations are too far away to provide reliable service to Dania. FPL began searching for a new site in 1993 to address the power projections. Ralph Edmondson, Supervisor of Transmission Lines and Substation Siting and Permitting, discussed costs effectiveness of the Prospect site. . y.• Attorney Mastriana advised that the second special exception requirement • relates to protecting the health, safety, welfare and morals. The substation has ? no adverse impact to the area for traffic, water, or sewer since it will be an r: unmanned facility. j n Attorney Mastriana introduced real estate appraiser, Bruce Rowe, and asked that I he present the third requirement relating to the use not causing substantial injury 4 to value of other property in the neighborhood. { I Bruce Rowe, President of Rowe Research, explained that he was hired to determine the affect either positive or negative on having property next to the proposed substation or any FPL substation. Mr. Rowe used the Dania A Substation on SE 5th Avenue in his survey because it is similar to the proposed }' site. He conducted a 100% survey of housing prices and sales around the r; > substation over a 30 year period (1965 to 1995.). The data showed that house ` prices near the substation increased in value at the same rate as other houses in a 30 year period. Mr. Rowe concluded that as long as a substation is visually I r protected there would be no adverse effect to property values. � . i Alex Cabiscus, Sheridan Ocean Club, disagreed with Mr. Rowe's survey results Y stating he would not have purchased his house in January had he known about • . the proposed construction of the substation. + > 'r t Attorney Rowars concluded that Mr. Rowe's survey did not include every substation in Broward County and that he only considered the Dania substation neighborhood in his evaluation. Property owners in the neighborhood disagreed with the results of Mr. Rowe's survey. Attorney Mastriana advised that the Dania Substation was chosen in Mr. Rowe's survey to provide a thorough analysis for Dania. David W. Martino, Landscape Architect, discussed the forth issue, landscape and screening. He explained that in preparing the landscape plan for the proposed Prospect Substation, the goals were to effectively hide the substation from the adjacent residential properties, create a landscape plan that utilizes the REGULAR MEETING 8 MARCH 26, 1996 1 fV• itis • > y natural features of the site to comply and exceed current City Code and maintain safety standards set by the National Electric Code. Mr. Martino provided a landscape drawing on the final product and presented photos of the existing conditions. Christopher Cutro, Cutro & Associates (Land Development Consulting), representing the Coalition, cross examined Mr. Martino in regards to removal of mangroves, landscape materials being used, buffering protection from all views, anticipated mangrove growth and maintenance of the landscaping plan. Gregg A. Hall, FPL Environmental Specialist, corrected his earlier statements i that FPL made a formal submittal for a Special Exception Zoning to the City of �a Dania in April 1995 which was three years before the projected need of the substation facility. d Attorney Mastriana advised that the fifth issue relates to the use being compatible with adjoining development and the intended purpose of the district in tf which it is to be located. Mr. Hall responded to the capability issue as follows: The proposed substation will include a one acre filled pad, a concrete support ' foundation to help support the electrical equipment and an access drive. There will be a 7 foot high chain link fence to enclose the facility with V-extension s, r' brackets to support barbed wire which is part of the variance request. All of the wY equipment, inside the fenced enclosure, is designed to transform, regulate and '; a• ;t distribute electricity to homes, businesses and schools. The height of the } equipment inside the facility is generally in the 20 to 25 feet range and the < ' bushings on top of the transformers are 28 feet. Outside the fenced enclosure, a single concrete pole will bring the transmission service into the station which is f roughly 40 feet high. The landscape design is extensive and will be very effective in buffering the substation. The substation will generate virtually no noise and will be unmanned. Attorney Mastriana advised that the sixth issue relates to adequate off-street x P parking and loading being provided and that ingress and egress is so designed as to cause minimum interference with traffic on abutting streets. There is no !; parking impact since the site provides ample room for a one manned vehicle r checking meters once a week as well as maintenance vehicles. No traffic impact will exist entering from Sheridan Street. Attorney Mastriana advised that the seventh special exception requirement provides that the use conforms with all applicable regulations governing the ` district where located, except as may otherwise be permitted for planned unit developments. Mayor Bertino stated that FPL will have an opportunity to cross examine these p Y experts. Attorney Mastriana requested information on the number of members in the coalition, shareholders, membership registration and the person who handled the incorporation. Mr. Rowars advised that the Coalition is comprised of several homeowners associations, residents of southeast Dania, the Master Association of Sheridan Ocean Club, the Sheridan Ocean Club Homeowners Association, "• the Watermark Condominium Association, the Villas of Sheridan Ocean Club and property management companies. Mr. Mastriana asked Mr. Rowars to provide, for the record, confirmation as to exactly who the members are and how they have determined their membership in the coalition. Mayor Bertino accepted the study for evidence from Mr. Melei to be held with the City Clerk Department. Mr. Melei agreed to provide a copy to the petitioner. s �v Mr. Melei explained that his use of Paired Data Set Analysis (the highest form of o- r$ adjustment proving methodology that is available to appraisers in the market .:_ .1... place) where two or more market sales are compared to derive an indication of the size of the adjustment for a single characteristic. Mr. Melei then reviewed the Paired Data Sets #1, #2, #3, #4, #5 and #6 which gave evidence in their respective analysis indicating a downward pressure on residential real estate caused directly by an adjacent FPL substation. Attorney Mastriana clarified that 12 sales were used in Mr. Melei's Comprehensive Study and that none of the 12 sales include the southeast Dania substation. Mr. Cutro > mentioned that when landscaping and the health concerns with power lines are removed, it comes down to a question of compatible use. Historically, utility uses have been separated from residential uses because they are an industrial use. The area along Sheridan Street that is being impacted by this proposed ; •` ` substation use is now defined as a residential use. As a Planner, he opposed I ' the approval of the Special Exception and urged the City Commission to review the use very carefully for compatibility with the residential community that now t exists. f >' Attorney Mastriana advised that according to the Dania Code "Essential Uses" are permitted in all residential zoning as a Special Exception and that the J " majority of power needed will serve residential communities. Henry Graham, LES, requested that the residents near the Liberia site be notified properly so they have an opportunity to speak for or against the rf ' substation should FPL consider the two acre Liberia site as an alternative. This past Saturday, June 8, we registered over seventy new junior l :x? golfers to this inaugural program. Every Dania neighborhood, and every Dania school was represented by the parents and children in attendance41 at Frostie's Golf Driving Range. k l Sheriff Ron Cochran was our guest of honor in attendance, as was Chief Rick: Frey, Deputy Richard Tarrant, and Deputy Chip Brockman. Let � me say that Sheriff Cochran was mightily impressed with the way the City f ` � of Dania came together to wor{; towards a singular goal : That of provid- ing worthwile goals for our community's children. ; When we of the East Dania Neighborhood Watch initially conceived f the idea of a Summer Youth Golf Program, it was Mayor Bertino who II wholeheartedly came to our support .
