Will Allen, Growth Management Director, explained that Stephen W. St.
Clair is requesting to rezone 0.9885 acres located on the south side of Old
Griffin Road currently known as the Competition Cycle Center. The
property is being rezoned from C-3 to C-4 to expand the facility and
provide better parking. The rezoning request is consistent with the
Comprehensive Plan and compatible with uses surrounding the area. The
Planning & Zoning Board recommend approval. There is a rezoning,
special exception and site plan portion to the request and the parking will
ya
be addressed under the site plan item.
Mayor Bertino opened the public hearing.

Don McNair, Architect for the project, explained that expansion will "t
improve the existing buildings by putting storage inside and creating a
very nice conceptual development of the property.

Special Exception request for use as a motorcycle sales, service and
f storage facility at 901 - 1001 Old Griffin Road. The request is for property +

within the C-4 zoning district. (Petitioner/Owner: Stephen W. St. Clair)
# Will Allen, Growth Management director, explained that the Special
Exception request is consistent with uses already in existence in the C-4
I >; zoning district. The Planning &Zoning Board recommended approval
with the following conditions:

1. No outside service permitted on the site;
2. Petitioner will dedicate the 25.02' x 98.10' portion of right-of-way
along Old Griffin Road adjacent to the proposed parking lot prior to
the issuance of a building permit.
r ; Mr. Allen advised that a third condition was proposed by Commissioner Y ;;
Mikes at the last meeting to have the petitioner dedicate the north side of

explained the drawing and site plan layout showing parking, storage,
improvements to ingress and egress, and landscaping along the frontage
of the property.
Mr. Allen presented a survey of the property and advised that a legal
opinion is needed to define the ownership of the north property area.
Karl Adler, Esq. recommended to have the title searched to determine a
title chain on ownership. Tim Ryan, Esq. mentioned that the petitioner
agree to provide a Quit Claim Deed for any rights he may have to the
` property.

Mayor Bertino opened the public hearing. Hearing no one speak in favor
or opposition, the Mayor closed the public hearing.

Commissioner Hyde recommended to pass the Special Exception with the
two conditions mentioned by Mr. Allen and then a third stipulation that the
petitioner work with Will Allen on landscaping improvements for the a
northern property. The City or the petitioner could then have a title search
?, processed later.
` Mr. St. Clair agreed to include landscaping improvements for the
estimated 400 feet but was not sure that he could properly maintain the
plants. l
r ! A motion was made by Commissioner Jones, seconded by Commissioner
-' Hyde to approve the Special Exception with the two conditions of no
outside service and a dedication of 25.02' x 98.10' portion of right-of-way
along Old Griffin Road adjacent to the proposed parking lot prior to the �r
issuance of a building permit.
t Mayor Bertino mentioned that the City wanted to obtain the property to the

' 1 north for public use because the land is worthless to the owner. Mr. St. f#
g Clair did not have a problem with using the property for public use and
dedicating the land if the title search shows ownership.
Commissioner Jones agreed to amend his motion, seconded by
Commissioner Hyde, to include the third condition that Mr. St. Clair will
j dedicate the property to the north to the City for public use if he has
x ; ownership rights.

' To clarify, Attorney Ryan stated that Mr. St. Clair agrees to dedicate the
land for public purpose by Quit Claim Deed if he presently has any
ownership rights. In the future, if the property becomes available for
purchase, Mr. St. Clair will not be restricted from purchasing and

6400 sq. ft. building addition and to provide better parking and
landscaping on the site.

Commissioner Hyde asked the petitioner to provide low maintenance
landscaping to the property to the north. Mr. St. Clair agreed to work with
Will Allen on a landscaping plan for that area.
A motion was made by Commissioner Hyde, seconded by Commissioner
Y. Jones to approve SP-10-96.

Alex Buchsbaum President of the Griffin Civic Association explained his
desire to fulfill a wish of Pat J. Meli to build a shelter over the Shuffle ,'
Board Courts at Patrick J. Meli Park with funds from the Griffin Civic r
Association. He requested the City to prepare plans for the roof over the
t : courts so that proposals and estimates could be taken to the Civic
Association for final approval The Griffin Civic Association meets on June
4 and their Board of Director Meeting is June 10.
City Manager Smith agreed to prepare design plans.

8. DISCUSSION AND POSSIBLE ACTION
' 8.1 Law Enforcement Trust Fund request by Broward Sheriffs Office District II
Dania. (Staff)
City Manager Smith recommended approval of the BSO request.
Rick Frey, BSO, requested approval to expend $17,865 from the Law
rE, Enforcement Trust Fund which has a balance of around $112,000. The
expenditure will cover furniture for the new Crime Prevention/Community
Policing unit, equipment for additional bike patrol units, surveillance 't
equipment and Ident-A-Kid Reorder Kits.
} Commissioner Jones requested Chief Frey to provide a report on the °
effectiveness of the expenditures. Assistance City Attorney Ryan advised
that the funds from the Law Enforcement Trust Fund are segregated
funds to be used for law enforcement only. The City Commission cannot
' redirect those funds in other areas. Chief Frey advised that all }
expenditures are assets of the City of Dania and that his requests are for
` items used on a daily basis. k

yVice Mayor Grace asked whether the City Commission can request to use
the funds for special projects in the City. Chief Frey stated that the
by request would have to be approved by Sheriff Conchran and the funds
1 must be spent in accordance with State Statute guidelines. The final step
would be approval by the Broward County Commission. Vice Mayor r",
Grace questioned whether LETF are used for BSO junior achievement <
programs in other cities and whether this could be provided for Dania. ^t

t t Chief Frey advised that the State Statute would have to be reviewed and
the BSO legal counsel would have to review the request to ensure the
proper use of the funds. x'<,
f, 'y A motion was made by Commissioner Hyde, seconded by Commissioner
Jones to approve the expenditure of LETF as presented by BSO .
{ Vice Mayor Grace asked whether Dania children can have an opportunity
t to go to the Sheriff Youth Boys Ranch. Chief Frey agreed to check into
I the funding for the program. Chief Frey clarified that the BSO Community
Council, through community assistance, sponsored 50 kids in the Devil
Dogs Program through Dania Elementary. Other schools or organizations
' were welcomed to join in expanding the programs for children.

�r 1 *Youth In Government 1996 postponed until next year.
` City Manager Smith mentioned that the Youth In Government Program
was postponed as the schools were unable to provide enough studentsv it
this year. The program is being postponed until the beginning of the fall
school year and may be expanded with a "Kids Voting Program" in ? "`
`R 1 conjunction with the upcoming national elections. The Kiwanis Club and
Broward Legislative Delegation are also considering the possibility of 't
1 , r sponsoring the outstanding Youth In Government Participant to be a page
during the regular Legislative Session in the spring. Mr. Smith will be
back in touch with the Commission on a new date and time for the
'y program.
The Broward Sheriffs Community Council, the American Red Cross, and
the Dania Fire Department will be sponsoring a Hurricane Preparedness
1 , t
Seminar on May 30 at 8:00 p.m. .
The Dania Library will be celebrating its first Anniversary on June 1 from
�+ 10:00 to noon at the Graves Museum on Federal Highway.

11. COMMISSION COMMENTS
11.1 Commissioner Hyde
Commissioner Hyde advised that he is posting the current and all future
agendas on the internet. He will be submitting the URL for the unofficial
City of Dania Page to all the major search engines for public access.
+ He mentioned his obligations on June 1 with the Big Brothers and Big
. , a
Sisters Program which may deter him from attending the library event.

Commissioner Jones was encouraged with the changes that may be
made to the Youth In Government Program. s ,a
City Manager Smith was asked to check into the feasibility of using solar
lighting with FPL to see what the benefits may be to the City.

s City Manager Smith advised that the Modello Park Pool will be opening for ? a
recreational purposes on June 15. The City will be working withr ,
MADDADs and Friends of Children on the event. Mr. Smith agreed to
invite other civic organizations to become involved. Commissioner Jones
..: , suggested to use the Jeff Ellis Program for water safety training and rh sr+
lifeguard services.

Vice Mayor Grace mentioned the importance of the Library event and the

Vice Mayor Grace commended the Dania Fire Rescue for their
professional help in the emergency call for her daughter Cheryl. She
expressed appreciation to everyone for their support with cards and
telephone calls.

Mayor Bertino mentioned that Officer Chip Brockman and the East Dania
Neighborhood Association are helping kids this summer with a free
Summer Golf Program being held at Frosty's Driving Range.

Please place three items for the May 28, 1996 City Commission meeting concerning
the requests of Stephen W. St. Clair to construct a new building and expand the
Y existing building at 901 - 1001 Old Griffin Rd. for the use as a motorcycle sales, service
z and storage facility. The first item would be the second reading of an ordinance 1 '
proposing to rezone the .9885 acre site from C-3 to C-4. The second item would also
be a public hearing. This item is a request for a special exception use as a motorcycle ! '
. sales service and storage facility within the C-4 district. The third item is review of the r'
i proposed site plan for the 6,400 sq. ft. building for retail sales at 1001 Old Griffin Rd. 1.
y a; and a 1,294.98 sq. ft. addition to the building at 901-905 Old Griffin Rd.
It The Planning and Zoning Board reviewed each of these three requests at their April 24,
r 7 1996 meeting. The recommendations are to approve the rezoning, special exception l
and site plan.
The rezoning of this .9885 acre site was recommended for approval as the request is
= consistent with the Comprehensive Plan which designates the area commercial and the
proposed zoning and use compatible with the existing and proposed uses for
surrounding properties. It was found that the existing motorcycle shop on the site has
been operating since 1972. The purpose of the C-4 district indicates the district is
intended for retail stores, enclosed service establishments, storage facilities and
enclosed vehicle repair shops. The proposed use is for an enclosed shop which will
improve the existing situation.
The proposed rezoning is consistent with surrounding development and zoning which
include mixed C-3 and C-4 uses:

East - The lot immediately to the east along Old Griffin Rd. is zoned C-3 and serves as
the parking lot for the property to the east known as the 800 Marine Technical Center
which is zoned C-4.
North - Across the street to the north is the Dania Cut-off Canal. The area on the north
side of the canal is developed with residential uses.
South - The FPL transmission lines borders the south property line. This area is
approximately 290' wide. The lines in an area are zoned C-3. To the south of the FPL
„t lines is area zoned for residential uses.
' West - Immediately west is a warehouse complex on the MMCO Plat which is zoned C-
3. Continuing west is a mixture of C-3 and C-4 uses including storage yards and

The Planning and Zoning Board found that the special exception use proposed meets
the criteria for approval as found in Section 6.40 of the Zoning Code. The use of
motorcycle sales, display, service and storage is listed as number 3 in the C-4 district
list. It was also found that the use is designed to protect the health, safety, welfare and

morals of the community. The use is operating now as a non-conforming use. The 1
F! s' proposed addition and expansion will improve the existing situation by adding parking,
+ removing parking from the right-of-way, adding landscaping and placing storage inside i

It was also found that the special exception will not cause substantial injury to the value f
of other properties in the neighborhood as the use already exists and it is consistent
with the mixture of C-3 and C-4 uses already in existence. The special exception
complies with landscaping and screening requirements and meets parking
requirements.
Two conditions were suggested for approval of the special exception. Both were
agreed to by the petitioner. The first condition is that no outside service be permitted
on the site and the second is that the petitioner must dedicate the 25.02' x 98.10'

portion of right-of-way along Old Griffin Rd. adjacent to the proposed parking lot prior to

} The site plan was recommended for approval as it complies with all applicable
ordinances. A new 6,400 sq. ft. building would be constructed on the Griffin

Commercial Plat at the west side of the site. A 1,294.98 sq. ft. addition would be built
to the rear of the existing building on the east side of the site. Parking would be located
between the two buildings with two one-way driveways on Old Griffin Rd.. The existing
i` parking on the right-of-way of Old Griffin Rd. would be removed. A sidewalk would be
installed along the length of the frontage.

In 1996 District II established a new Safe Streets Unit to ? 5
address the problem of street level narcotics dealing. To ,47
further enhance the effectiveness of this unit it is necessary q
to purchase additional surveillance equipment to facilitate
' undercover narcotics transactions. In the past year the
Sheriff's Street Crimes Unit has operated a tremendously
successful program called "Showtime". Currently the equipment
} { necessary to operate this enforcement is provided by the
Sheriff's Technical Support Unit. The Street Crimes unit has
been very responsive to the needs of District II, however,

given the magnitude of our problem and the success of
s "Showtime" it is our objective to purchase the necessary
§ equipment to allow full time utilization within the City of

Technical Support Unit personnel who will provide the
