The program was established to impact street level narcotics and crime in the City. Results from the n �'= + ' program in the first four months: 146 arrests resulting in 126 felony charges and 100 misdemeanors, seizures of 4 vehicles, one weapon, over $300,000 in currency, $2500 1k worth of electronics, 21,554 grams of cocaine powder, 255 cocaine rocks and 88 grams x of marijuana. He felt that Section 1 r of the resolution as submitted is too restricting to the members. ;< ,a Vice Mayor Grace agreed that the Commission did not want to impose a ¢ limitation on the members. Will Alien, Growth Management Director, explained that the ordinance is being heard on first reading to rezone an approximate one acre of 4 property at 901 Griffin Road. The existing motorcycle shop on the south side of Old Griffin Road has existed since 1972. The request is to rezone from C-3 to C-4 to accommodate upcoming requests on May 28 to + ryc`. expand the existing building, construct a new building, allow storage on z the site to cleanup the property and move parking off the right-of-way. The Planning & Zoning Board recommended approval based on the y ;- rezoning being consistent with the Comprehensive Plan and surrounding t ' uses in the zoning district. t;z Commissioner Mikes mentioned that businesses along the south side of ';.` t Old Griffin Road have controlled a small strip along the waterfront on the ' Dania Cut-Off Canal for years. The request is for three pole signs on the site and the City Code allows two. ` MEBA has a sign at Federal and Dixie Highway and an existing double- " i face sign under the canopy in the middle of the entrance into the building. r MEBA wants to replace the double-face sign with two single-face signs. , Item 4.2 b has been withdrawn since MEBA agreed to the City's 50 sq.ft. M code requirement. Mr. Allen mentioned that he is currently drafting a new r �1. sign code and that this request will not conflict with his proposed changes. The proposed use is for the FAU Oceanographic/Ocean Engineering School and consistent with the 1996 Lease & Licensing Agreement approved by the City Commission on February 27, 1996. The Planning & Zoning Board recommended to include a condition to require FAU to follow normal City procedures if a building change or addition is requested in the future. irb C Don Hall, Esq., representing the Board of Regents/FAU, advised that the ' M 1996 Lease & Licensing Agreement has been under intense review by the , Board of Regents staff for the past 6 to 8 weeks. The Regents are 1 a ii concerned that they are paying 5.2 million dollars fora 50 years lease, , t` instead of a 99 year lease, and all improvements will revert to the City. { Discussions have been ongoing regarding a lease extension or obtaining an agreement from the City to purchase the improvements at the end of { the 50 year. A Board of Regents staff conference is scheduled May 24�h and a resolution must be reached before the 1996 Lease & Licensing Agreement expires on May 31, 1996. Mr. Hall mentioned that the City �t ? also wanted FAU to request a percentage of the operating profits from �• "II' Aragon Group, Inc. on the marina ' 1 fd- e Mr. Hall advised that the condition recommended by the Planning & Zoning Board is not necessary since it is covered by Paragraph 6 of the r (x 1996 Lease & Licensing Agreement. The University System is not subject f L to building permits or site plan reviews. Karla Coleman, FAU, assured the Commission that the Board of Regentsa : and the University are working with City staff in an effort to resolve the • t language in the lease. I Commissioner Mikes expressed his disappointment with the way that the i negotiations were handled by FAU since a State Law was used between two governmental agencies to keep the people of the City of Dania from i seeing the taxpayer funded appraisal results on the Seafair site. Mr. Hall clarified that the appraised value was disclosed at $5.2 million dollars. ryr . 4 Vice Mayor Grace opened the public hearing. Rick Sowden, Budget Advisory Board, asked for clarification on whether the exemptions for FAU will provide exemptions for Aragon Group, Inc.? - ' REGULAR MEETING MAY 14, 1996 ✓ 1 eS Y Will Allen, Growth Management Director, stated that the Special Exception being requested is a listed Special Exception use in the Open Space Zoning District. He then read the Code Section defining schools. Tim Ryan, Assistant City Attorney, advised that the Special Exception only applies to FAU's use of the property and that Aragon Group, Inc. is ' required to go through the normal City process on requests. Hearing no further comments, Vice Mayor Grace closed the public hearing. N, Commissioner Jones asked whether student housing will be allowed on the FAU facility? Mr. Hall stated that the lease deals with permitted uses and does not speak to housing. FAU would become a campus once A. housing was included which would then fall under the Master Planning7151 Process requiring a Development Agreement with the City. ;y Commissioner Mikes' asked for clarification on the Navy use facility for the site. Karla Coleman, FAU, advised that under the contact with the Navy the University System provides a sponsored research facility. Staff is requesting to solicit an RFP for a 3 year engagement so the company can appropriately allocate their costs. Vice Mayor Grace asked that the RFP include minority participation. City Manager Smith advised that the City encourages qualified SDBE (Small ' Disadvantaged Business Enterprises) to make application. Commissioner Hyde confirmed that Madsen, Sapp, Rodriguez & Mena are a minority firm. The building will be smaller, handicap 1 { accessible and located next to the concession stand. A few feet of the ¢ p " building will be used for storage and the City will be able to use part of the concession stand for storage. A new fence will be installed to keep the r children protected from the alley and a covered picnic area can be utilized ;a between the two buildings. The construction is expected to be complete '. ' by October 15f Mr. Salvino asked the Commission to expedite the project ' r by foregoing additional requirements including a waiver on building permit x { fees. Commissioner Mikes asked Mr. Salvino to serve on the Parks & a. b i Recreation Board as his appointee. Owner: Ernest Bethel (Lot 6 and 7, B)k 3 College Tract.) City Manager Smith explained that Clarence Jones, citizen and City !! * F Firefighter/Paramedic, is acquiring the referenced property through a tax k" Iky sale. The City has agreed to waive interest and recording fees to reduce Er 1 the liens to $4850.00. Mr. Smith mentioned that the City has waived liens in the past for non-profit housing organizations when the City has entered < into a partnership. He did not recommend a full waiver since the City has incurred costs and since Mr. Jones will profit from the property. James Walker, Esq., representing Clarence Jones, explained that a home N f will be built on the property for the Jones' family and will not be used for business profits. S jJ, Vice Mayor Grace agreed with City Manager Smith's recommendation to reduce the amount but to collect costs incurred since liens have been ongoing since 1991. She mentioned her concern with waiving these liens and then setting a precedent for other citizens requesting waivers. Vice Mayor Grace mentioned that the City has waived fees for non-profit ,rt organizations like Habitat for Humanity and DEDC (Dania Economicjt` "k ? Development Corporation) because they built homes for needy recipients " and improved the area. i Commissioner Mikes agreed that the Commission has an obligation to the '! other taxpayers when lien fees are waived. The City cannot place itself in the position of waiving fees for private property owners who are also City + Employees. Mr. Walker understood the Commission's position on the matter and ` agreed to a 90 days period to pay the liens. He mentioned that the organization raises funds to help abused children. Rick Sowden, Budget Advisory Committee, thanked the Commission for establishing the Budget Advisory Committee even though they have been trying to get started since 1995. He assured the Commission that the members will provide expertise in varied fields, will not take an adversarial 47, position and will serve in an advisory capacity to the Commission. Irvl. 11.2 Commissioner Jones Ir Commissioner Jones mentioned that the Budget Advisory Board will work very closely with the City Commission and should not be restricted or limited from providing citizen input. Y i hE �1e1 A r„ Commissioner Jones commended BSO and staff from Dania Elementary j for the recent DARE program that provided drug awareness to students. He commended the tree planting at the beach by the Dania Improvement Committee and the College Garden Neighborhood Association for using CDBG funds to complete sidewalk improvements on the east side of Ely Vr • Blvd. The College Garden Neighborhood Association will be adopting Ely Boulevard and Waiters/Phippen road for a highway cleanup project on June 1 and promoting their logo contest. Commissioner Jones requested the City Manager to check the garbage contract to see what the City can do to improve the garbage and bulk n trash pickup by Southern Sanitation. , .•,�t Commissioner Jones was disappointed that Dania has nothing to submit r for the Broward Heritage Days historical sites like other municipalities. He ' asked staff to check into whether the Nyberg/Swanson House could be ;y`' i } added to the historical list of properties. BSO was commended for their visibility efforts in the southwest area after # the recent shooting that took place and Commissioner Jones stressed the ( need for more to be done to deter crime. Mall Construction Company relating to construction of the conference room. The k f request is to change the specification for storm shutters protecting the windows. Thea,, z storm shutter system specified in the project manual prepared by Jeffery Gross, Associates is for a panel type shutter. The requested change is for accordion shutters. The additional cost for the four windows is $1,493.00. ` The amount of the 'change order is the difference between the actual cost from 4 . suppliers for the purchase and installation of the two types of storm shutters. The storm shutters would be installed by the same firm which recently completed the shuttering of 4,4; the remainder of the windows and doors at City Hall. The cost of the accordion shutters ,} r totals $2,923.00 which is $1,493.00 more than allocated for the panel shutters. rf As previously mentioned, staff initiated the change order and recommends approval. There are several reasons that the accordion shutters are preferred over the storm ? T' panels. These reasons were explained to FEMA and they approved the more „ expensive shutter types in the recently completed grant. First of all, the accordion shutters match the other shutters on the first floor of City Hall. L s "< #, The specifications showing panels were prepared prior to the installation of the ^, accordion shutters on the rest of the building. Accordions are also preferred to panels for several other reasons. Panels must be 3 art , stored which take up space. Like most things panels may get lost or damaged. In event of a storm, panels must be retrieved and installed. Mall Construction from $140,000 to $141,493.00 and increase of 1.07 percent. The conference room is substantially complete. Besides the storm shutters, the last remaining item is to change the light fixtures to the specified energy efficient fixture.
