Mayor Bertino opened the public hearing. Hearing no one speak in favor or {
® opposition, the Mayor closed the public hearing.
City Manager Smith reported that the Safe Neighborhood Plan was set up in I
1988 through a Community Development Block Grant. Very little activity has
( taken place with the plan since its implementation. If the district is not abolished, i
t the City needs to pay the $175.00 annual fees.
A motion was made by Commissioner Hyde, seconded by Vice Mayor Grace, to
deny the ordinance.

® Will Allen, Growth Management Director, advised that the Planning & Zoning
Board recommended approval of the Taco Bell Corporation plat. The plat
conforms with all platting requirements and the Dania Comprehensive Plan. The
petitioners are currently in compliance with City Code in regards to the 80' right-
of-way on Federal Highway; however, the Broward County Trafficway's Map
requires a width of 106'. In the future when the site plan is presented for
development, the petitioners will need to address the width requirement.

City Manager Smith mentioned that a consortium with Broward County and

normal reasons for rear yard setbacks do not exist. Mr. Allen distributed photos
of the 31 lots at Natures Cove and advised that 15 lots have been permitted.

Mr. John Ligotti, owner, explained his desire to retain uniformity in the design of
the 31 homes prepared by his architect which requires a change in the 20'
setback to 18'on the five lots. He confirmed that swimming

8.1 Discussion of amending City Charter to allow the city manager to hire and fire „
department heads. (Commissioner Hyde)
The City Commission discussed the need to schedule a workshop meeting to
review the recommendations presented by the Charter Review Board in regards
to changes in the Charter. Commissioner Hyde mentioned his intentions to
include the city manager issue on the next regular meeting agenda for action

Commissioner Mikes requ.=.sted staff to survey cities and obtain copies of
contracts regarding the city manager hiring and firing department head. He
asked that the information be supplied to the City Commission prior to the next
+ + meeting.
8.2 Discussion of amending City Code to allow the sale of alcoholic beverages by
businesses with alcoholic beverage licenses beginning at noon on Sunday.

n Commissioner Hyde mentioned that discussion took place at the last regular
Commission Meeting regarding a request by Dania businesses to change thetime from 1:00 p.m. to 12:00 noon on Sunday to serve alcoholic beverages. It
was mentioned that Dania would then be in conformity with surrounding oV j
communities.
Discussion followed on noon being the earliest time to consider to change the fsr* +
' y time to serve or sell alcoholic beverages and there being a need for the public to x �*
buy beer in the grocery stores prior to Sunday for sports activities. - [,

10.1 City Manager - Discussion of December meeting dates

City Manager Smith recommended to cancel the December 10 and December `
24 regular meetings due to the National League of Cities Convention and the
Christmas Holidays. He recommended to schedule one meeting on December
17. i
k A motion was made by Vice Mayor Grace, seconded by Commissioner Jones, to
cancel the regularly scheduled meetings in December and schedule a Special
x r Meeting on December 17. The motion passed unanimously.
City Manager Smith advised that the General Employees AFSCME Association

has requested to amend their collective bargaining agreement by trading the

r November 11 holiday for December 23 to provide three days off for the
` ! Christmas Holiday.
The City Commission generally disagreed with city services being shut-down for ?
that length of time and that Veteran's Day should be honored on November 11. ,
< City Manager Smith agreed to handle the matter with the union. `

Commissioner Mikes requested to have Earl Gallop review the Project
Alternatives presented by Broward County on the expansion of the airport and
prepare a draft letter by November 18 stating the City's position on the
alternatives. '

Mayor Bertino was hopeful that the School Board is going to remove the old
Olsen Middle School building so that some of the flooding can be relieved in the
area near the new Olsen Middle School and Meadowbrook Condominium. He
was concerned that there is a need for a new pump and generator to handle the
emergency flooding for the lakes at Meadowbrook. Bud Palm, Utilities and
Public Works Director, agreed to get pricing on the items and bring back to the
Commission.

WHEREAS, Article V of Chapter 2, of the Code of Ordinances of the City of I' C
Dania, Florida, heretofore enacted pursuant to the authority of Section 59 Chapter 87-
243, Laws of Florida, provides for the formation of Safe Neighborhood Improvement
Districts within the City of Dania; and
WHEREAS, the Act, comprised of Sections 55-73�- inclusive of said Chapter 87-
- 3 i �243 provides that the governing body of a municipality may adopt an ordinance 5

authorizing the formation. of local government neighborhood improvement districts; and
y' WHEREAS, it has been found that said Safe Neighborhood District within the
City of Dania has since been an inactive district; and
t; WHEREAS, The Dania Safe Neighborhood Committee was abolished by the kt
Dania City Commission in 1993 by Resolution 76-93.
' Wa NOW, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE
` CITY OF DANIA, FLORIDA:
r Section 1. That Chapter 2 of the Code of Ordinances of the City
y of Dania,
Florida, entitled "Administration" be and the same is hereby amended by repealing
thereto Article V, entitled "Safe Neighborhood Improvement Districts".
Section 2. That except as herein amended, all other provisions of said
Chapter 2 shall remain in full force and effect.

} { The second reading of an ordinance which amends the text of the Zoning Code is
scheduled for public hearing at the October 22, 1996 City Commission meeting. This
text amendment can be classified as a "housekeeping" revision. The proposed '
ordinance clarifies that the intent of adopting the Broward County Zoning Code was to
i u allow land to retain the zoning classifications and permitted uses which were in effect at
the time of annexation. It also indicates that the intent was not to have Section 39-167
apply in annexed areas. This section concerns the authority for Broward County to s s
locate "County uses".
{ ' The proposed ordinance was prepared under the direction of Earl Gallop. Mr. Gallop t, v

will be at the public hearing to explain the ordinance. The preamble of the ordinance
explains the reasons for the amendment. The ordinance clarifies that the code is
administered by the City of Dania not Broward County. Specific sections of the county
code are adopted and are to be codified.
The Planning and Zoning Board reviewed the proposed amendment at their September
25, 1996 meeting and recommends approval.

The Planning and Zoning Board reviewed this request at their September 25, 1996
meeting. The recommendation is to approve the plat as it conforms to plating

across Federal Highway, a variety of commercial uses along both sides of Federal
Highway , and a mixture of residential uses to the Southwest.

The plat dedicates 25' of right-of-way for SW 10 Street making a total width of 50' along
the south side of the property. This width is consistent with the requirement of Section
z5.14 of the Zoning Code. The plat includes a non-vehicular access line for the frontage
along Federal Highway except for the northerly 12'. The plan is to share a driveway

Date: October 16, 1996
Public hearings are scheduled for the October 22, 1996 City Commission meeting „ ,q
concerning the request of Regal Homes, Inc. for variances from Section 6.52 (a) (5) of
the Dania Zoning Code. The requests concern the rear yard setbacks for five homes
proposed along the north perimeter of the development known as Residences of ! 1
Natures Cove which is located on the east side of SE 5 Avenue between SE 7 Street
and SE 10 Terrace. This development was approved as a cluster single family
' development. This type of development requires smaller individual lots but requires `
common open space. A variance was previously granted to allow a perimeter setback
of 20 feet along the north perimeter of the development rather than the 50 feet setback
which is required. The request is to construct homes on these five lots which have a
'. setback of 18 feet. The five lots are 701, 705, 709, 713, and 717 Nature Cove Road
which are Lots 21, 20, 19, 18 and 17 of the development.
The Planning and Zoning Board reviewed these requests at their September 25, 1996
meeting. The Planning and Zoning Board , after hearing the evidence presented,
recommends approval of the variances as the requests conform to the criteria for
granting variances as listed in Section 10.13 of the Zoning Code. It was found that
there are unique circumstances in these cases which are not applicable to other lands.
There will be no development of adjoining lands as the abutting property is in public
ownership. The reasons for a rear yard setback such as providing adequate light and
air, fire separation, proper open space, etc. do not really exist. This is why the original
variance was approved. The footprints of the buildings in this development do not fit
into the 20 feet setback and they are trying to achieve a uniform development.

NOTICE IS HEREBY GIVEN that the City Commission of the City of Dania, Florida on, October 22, 1996, or
as soon thereafter as the matter may be heard, will conduct a public hearing in the City Commission Meeting
Room of the Dania City Hall, 100 West Dania Beach Boulevard, Dania, Florida, to consider the following
proposed Variance request.

VA-27-96 - The request of Regal Homes, Inc., as owner, for a variance from the perimeter setback or rear
ryard setback requirements for 701, 705, 709, 713 and 717 Nature Cove Road. The request is for an 18 feet
setback from the north perimeter of the development known as the Residences of Natures Cove on the east
side of SE 5 Avenue between SE 7 Street and SE 10 Terrace. This development has been approved as a
cluster single family home development per Section 6.5 of the Dania Zoning Code. A perimeter setback of not I 'less than 50 feet is required by Section 6.52 (a) (5) of the Dania Zoning Code.
