A RESOLUTION OF THE CITY OF DANIA, FLORIDA, CONFIRMING
ZONING IN PROGRESS REGARDING ADULT ENTERTAINMENT
ESTABLISHMENTS; NOTIFYING ALL PROPERTY OWNERS THAT THE
CITY IS CONTINUING THE REVIEW OF ITS ADULT ENTERTAINMENT
CODE AND CONSIDERING EXPANSION OF LIMITATIONS ON
REGULATION OF ADULT ENTERTAINMENT ESTABLISHMENTS;
PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT ARE REPEALED TO THE EXTENT OF SUCH CONFLICT;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania City Commission previously determined that the negative
secondary effects of adult entertainment establishments may result in increased crime
rates, reduced property values and a decreased quality of life in nearby neighborhoods;
and
WHEREAS, The City of Dania, in a Resolution previously adopted, formally
expressed its intent to reduce the impact of negative secondary effects and improve the
quality of the City's commercial and residential zoning districts by limiting the locations of
establishments which offer adult entertainment; and

WHEREAS, the Dania City Commission previously determined that the City
planning staff, in consultation with the City Attorney, should review the City's existing
ordinances related to adult entertainment establishments with the purpose of insuring that
proper protection exists with regard to the negative secondary effects of such
establishments; and
WHEREAS, pursuant to Resolution No. 07-98, adopted January 13, 1998, the City
Commission determined that the City staff, within one hundred twenty (120) days from the
date of adoption of that Resolution, should present to the City Commission an ordinance
revising the present regulations, if such ordinance was found to be necessary and
appropriate; and

WHEREAS, by its adoption of the Resolution, the Dania City Commission intended
to place all property owners on notice that a comprehensive adult entertainment ordinance
was being considered and all land development and occupational license applications for
adult entertainment establishments would be required to meet the standards adopted in
such ordinance as may be presented and adopted by the City Commission pursuant to the
Resolution; and
WHEREAS, an extension of time within which to complete the tasks set forth in the
Resolution is necessary to allow the new City Attorney adequate time to thoroughly
analyze and evaluate recommendations for updated regulations;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA THAT:
Section 1. The above stated recitations are incorporated into and are a part of this
Resolution.
Section 2. The Dania City Commission renews its declaration and hereby declares
that development of zoning regulations are in progress for the regulation of adult
entertainment establishments as defined in the City of Dania Code of Ordinances. The
Dania City Commission, upon consultation with staff, will consider negative secondary
effects upon the residential population, city parks and facilities, schools and churches and
further consider a comprehensive adult entertainment ordinance to insure that the health,
safety and welfare of the City and its citizens are protected.
Section 3. All property owners are placed on notice that revised adult entertainment
regulations are anticipated to be presented to the City Commission within ninety (90) days
from the date of adoption of this Resolution.
Section 4. All property owners are placed on notice that any application for
development permits or occupational licenses for an adult entertainment establishment
shall be subject to review pursuant to the requirements of the ordinance in progress
pertaining to adult entertainment and any such occupational license or development permit
must be consistent with the terms of such ordinance.
Section 5. The adoption of this resolution shall be placed in a newspaper of general
circulation in Broward County in a one-eighth page advertisement on two occasions within
two weeks after the adoption of this Resolution. This Resolution shall also be posted in

the Growth Management Department of the City of Dania for the next one hundred
twenty (120) days.
Section 6. All resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 7. That this resolution shall be in force and take effect immediately upon
its passage and adoption.

The City Commission of the City of Dania declares that zoning
regulations are in progress for the regulation of adult entertainment
establishments as defined in the City of Dania Code of Ordinances. The
Dania City Commission, upon consultation with staff, will consider
negative secondary effects upon the residential population, city parks and
facilities, schools and churches and consider further limitations on the
regulation of adult entertainment establishments through a comprehensive
adult entertainment ordinance to insure that the health, safety and welfare
of the City and its citizens is protected. All property owners are placed on
notice that revised adult entertainment regulations are anticipated to be
presented to the City Commission within ninety (90) days from the date of
adoption of the resolution identified above, which was adopted May 12,
1998. All property owners are placed on notice that any application for
development permits or occupational licenses for an adult entertainment
establishment shall be subject to review pursuant to the requirements of
the ordinance in progress pertaining to adult entertainment and any such
occupational license or development permit must be consistent with the
terms of such ordinance.
