HomeMy WebLinkAboutR-1998-074 i RESOLUTION NO. 74-98 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING A SPECIAL EXCEPTION REQUEST SUBMITTED BY NEXTELL COMMUNICATIONS, FOR PROPERTY LOCATED AT 1870 GRIFFIN RD. (AIRPORT HILTON HOTEL), DANIA, FOR A SPECIAL EXCEPTION USE TO ALLOW THE INSTALLATION ON THE HOTEL BUILDING OF A CELLULAR ANTENNA, ASSOCIATED STRUCTURE AND EQUIPMENT SHELTER AS PROVIDED FOR IN CHAPTER 28, ZONING; ARTICLE VIII, TELECOMMUNICATION TOWERS AND ANTENNAS, SECTION 33-308; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Zoning; Article VIII, Telecommunication Towers and Antennas, Section 33-308 provides for Stealth Towers as a Special Exception Use in districts zoned C-2; and; WHEREAS Nextell Communications has applied for a special exception use to allow the installation of a cellular antenna, associated structure and equipment shelter; and WHEREAS, the Planning & Zoning Board on March 18, 1998 recommended that the City Commission grant the special exception request for the installation of a cellular antenna, associated structure and equipment shelter based upon the criteria set forth in Chapter 28, Zoning, Article 6. Supplementary Use Regulations, Section 6.40, Special Exception Uses, of the Code of Ordinances of the City of Dania. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That that certain application (SE-17-98) submitted by Nextell Communications for a Special Exception Use to allow the installation, on the hotel building, of a cellular antenna, associated structure and equipment shelter as provided for in Chapter 28, Zoning; Article VIII, Telecommunication Towers and Antennas, Section 33- 1 308; which application is attached hereto and made a part hereof as Exhibit "A", is approved, and the appropriate city officials are hereby directed to execute same. Section 2 . That petitioner, Nextell Communications, agrees to the additional conditions to said Special Exception (SE-17-98) as follows: a. The petitioner agrees to provide $5,000.00 in median landscaping improvements to the Griffin Road/1-95 Interchange; b. The petitioner will fully comply with FCC and FAA Federal regulations with respect to the installation of the cellular antenna; C. The City of Dania will conduct a review of the structures' appearance every three (3) years. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. Virta, AICP Growth Management erect RE: SE-17-98 Stealth Antenna at Airport Hilton Date: April 22, 1998 i I This is a request for a Special Exception to allow for the placement of stealth cellular antennas and support structure on the roof of the Hilton Hotel building. The antennas are proposed to be the same color as the building rendering them virtually invisible to the casual observer. The accessory structure will also be colored to blend with the Hotel. This request was dependent on the passage by the City Commission of the amendatory language, which permits these uses as Special Exceptions in the C-2 Commercial District. The installation will be unmanned for the most part. There will be technical staff present for routine maintenance and emergency repairs. Therefor the proposed use should have very little impact on existing uses of the site. Staff recommended that the Planning and Zoning Board make a favorable finding in this regard. The Planning and Zoning Board is recommending that the City Commission approve this request. The City Commission may wish to recall that in approving a similar use for the Wyndam Hotel agreement was reached with the applicant to provide $5,000.00 to the City for landscaping of Griffin Road. The landscaping money was provided as offsetting mitigation for any deleterious visual impacts that will result from the use.
