HomeMy WebLinkAboutR-1998-042 RESOLUTION NO. 42-98 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, AUTHORIZING THE CITY MANAGER TO PREPARE AND FILE AN APPLICATION WITH BROWARD COUNTY FOR AN ENHANCED MARINE LAW ENFORCEMENT GRANT COVERING THE FISCAL YEAR 1998-99; AND TO EXECUTE ALL DOCUMENTS RELATED THERETO AS THE AUTHORIZED REPRESENTATIVE OF THE CITY; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA; Section 1. That the City Manager, Michael Smith, is hereby authorized to prepare and file an application with Broward County for an Enhanced Marine Law Enforcement Grant for the fiscal year 1998-99, and to execute all documents related thereto as the authorized representative of the City. A copy of said grant application is attached hereto and made a part thereof as Exhibit "A", be and the same is hereby approved. Section 2. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 3. That this resolution shall be in force and take effect immediately upon its passage and adoption. Attached is a list of the areas that the Broward County Marine Advisory Committee feels are in need of supplemental law enforcement. Our desire is that law enforcement agencies utilize the Local Option Vessel Registration Fee approved by the Board of County Commissioners to supplement existing services in their area of jurisdiction. Coordination with other law enforcement agencies that have jurisdiction in Broward County is encouraged, and may be necessary, to enable the applicant agency to provide the enhanced needed coverage as desired. Innovative projects to improve boating safety in Broward County are enthusiastically encouraged! Over the years many complaints have been received from businesses, residents, and boaters themselves of violations of posted speed signs and alcohol related abuses within the waterway system. The five (5) miles of the Dania Cut-off Canal is patrolled sporadically by the Broward County Sheriffs Office and the Florida Marine Patrol. The patrolling that is provided is not sufficient to police the waterways. Therefore, the City of Dania is requesting your continued assistance in providing for enhanced law enforcement along the Dania Cut-off Canal. The City plans to contract with the Broward County Sheriffs Office to provide the city with Marine Patrol Officers and boats. The City receives general law enforcement services from the BSO under a contractual relationship. The Broward County Sheriffs Office would provide for a fully trained Marine Patrol Officer and boat during the hours of 9 am to 5 pm (8 hrs per day) on weekends. This would insure that our waterways are patrolled during the peak boating days of the week from October 1998 to September 1999. BSO will target Friday and Saturday evenings for Operation Under the Influence (OUI) enforcement. Since we would be using the Broward County Sheriffs Office for this service, they would be able to assist any jurisdiction in Broward County without regard to jurisdictional boundaries. In addition the City is requesting the addition of two education elements to the program. Part one would provide 50 hours per year of boating safety presentation to middle school students in the City of Dania (Olsen and Attucks Middle Schools) which would be conducted by marine patrol deputies. This program would introduce students to boating safety and direct interested students into Part two of the program. Part two is a ten (10) hour course to be offered at the BCC Watersports Training Facility at Dania's Tigertail Lake. This program is a partnership between the City of Dania, BCC, Broward County School Board, and the Center for Environmental Education and Research, Inc.(CEERI). DO NOT INCLUDE YOUR PROPOSED EMLEG APPLICATION FUNDING. PROVIDE DOCUMENTATION TO SUPPORT YOUR ANSWER. No funds are available for Marine Patrol services in the city's 1997-1998 budget. See Exhibit B. i i i i I 4. DESCRIBE NUMBER AND TYPE OF BOATS AND ENGINES (WITH ENGINE HOURS IF AVAILABLE) CURRENTLY FUNDED. No boats or engines have been funded through the city's grant. A 26' 1 Intrepid will be used, which was funded through the BSO EMLEG grant last year. 5 5. DESCRIBE HOW THE PROPOSED GRANT PROJECT WOULD IMPROVE BOATING SAFETY IN BROWARD COUNTY. The funding will allow BSO marine patrols to provide Broward County and 1 the City of Dania with improved boating safety where virtually none existed before. Through a contract with the BSO, the City of Dania has endorsed the concept of community policing which has proven to be successful in addressing crime in our community in a comprehensive manner. + The enforcement methodology utilized by the Marine Patrol unit of BSO follows the same principles. Marine patrol officers become familiar with waterfront business interest and the boating public. Effectiveness is measured not simply by the number of citations written, but also by emphasis on customer contact which includes verbal instruction and printed material in boating safety and rules of the waterway. The focus of the program is safety training. i 6. WILL THE AGENCY REQUESTING ENHANCED LAW ENFORCEMENT FUNDS PROVIDE FOR THE COST OF OFFICERS TO APPEAR IN COURT? YES By contracting with the Broward Sheriffs Office for Marine. NO X Patrol, no funding for court appearance will be required. 6 i 7. HOW WILL THE AGENCY REQUESTING ENHANCED LAW 1 ENFORCEMENT FUNDS MEET, OR INCORPORATE THE "ZONES AND TIMES OF CONCERN" (SEE EXHIBIT "A") IN THEIR GRANT PROPOSAL. The request for 1998-1999 provides for Saturday and Sunday enforcement 9am-5pm and special OUI enforcement targeting Friday and Saturday evenings. (208 hours have been set aside for the OUI program during the year). During periods of inclement weather and other circumstances which result in reduced boating traffic, patrols would be curtailed and hours would be used during peak hours which may include additional evening enforcement. See Exhibit C for detail breakdown of Saturday and Sunday enforcement. OUI enforcement times have yet to be determined. i �I i I 8. WHAT WOULD BE THE LEVEL OF ADDITIONAL SERVICE, ABOVE THE EXISTING BUDGETED LEVEL OF SERVICE, THAT THE APPLICANT COULD PROVIDE TO ENSURE ENHANCED MARINE LAW ENFORCEMENT? The City of Dania has no budget for providing funding for a Marine Patrol. However, the Florida Marine Patrol and The Broward County Sheriffs Office do patrol the Dania Cut-off Canal on a sporadic basis. The minimum level of service the city would like to provide would be during the "Times of Concern" as stated in Question 7 above. We could provide this service if this grant is awarded. r 7 i i 9. Part 1: The goal of this phase is to make all students aware of water safety issues (even those without watercraft), and to direct those with watercraft of plans to operate or ride in watercraft into Part 2 of the program. Part 2: To provide a structured educational curriculum which is necessary for youth 16 or under to obtain state license to operate watercraft with engine of 10 hp or more as required by Florida statute. Curriculum has been developed by CEERI in conjunction with the Broward School Board. The program will be taught by staff who have been trained by BCC School Board staff. The pertinent information is as follows: • the proposal deadline is March 16; • the two proposed projects are BSO Basic Boater Safety Training for middle school students and a 10 hour boating course required pursuant to Florida statutes. These projects would be funded in addition to man-hours for marine patrols and special OUI enforcement. • the City Commission has expressed its support in the past for previous EMLEG proposals • the proposal will be evaluated between April and June of this year and funding will be available beginning October 1; • we will apply for$46,500, the cost of funding the two courses, man-hours, and special OUI enforcement. Dania Beach Blvd. Dania, Florida 33004 Dear Mr. Smith, On October 1, 1988, the Broward Sheriff's Office entered into a contractual agreement to provide law enforcement services to the City of Dania. There are no current or past provisions in the contract for marine law enforcement. The Broward Sheriff's Office does provide limited patrol on the Dania waterways as a normal part of it's countywide jurisdiction.
