HomeMy WebLinkAboutR-1998-039 � RESOLUTION NO. 39-98 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING A REQUEST BY PAUL J. SMITH, REPRESENTING ENTERPRISE LEASING COMPANY FOR A SPECIAL EXCEPTION USE TO ALLOW FOR A RENTAL CAR AGENCY AT 801 S. FEDERAL HWY, DANIA; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 28, Zoning; Article 4, District Regulations; Section 4.10, Schedules Of Regulations provides for "Automobile Rentals (for establishments operating a rental fleet of ten or fewer automobiles and parking or storing of ten or fewer automobiles at the location requested)" as a Special Exception Use In districts zoned C 3 (General j' Business), provided that no such use shall be established within 1,500 feet from any other such use. and WHEREAS, Mr. Paul J. Smith, representing Enterprise Leasing Company has applied for a special exception use to operate a car rental agency with a rental fleet of ten or fewer automobiles at 801 S. Federal Hwy., Dania; and WHEREAS, the Planning &Zoning Board on February 18, 1998, recommended that the City Commission grant the special exception request SE-23-98, based upon the criteria set forth in Chapter 28, Zoning, Article 6. Supplementary Use Regulations, Section 6.40, Special Exception Uses, of the Code of Ordinances of the City of Dania. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That that certain application (SE-23-97), for a Special Exception Use to operate a Rental Car Agency with a rental fleet of ten or fewer automobiles (including the parking or storing of such automobiles) at 801 S. Federal Hwy., a copy of which is 1 RESOLUTION NO. 39-98 A attached hereto and made a part hereof as Exhibit "A" be and the same is hereby approved, and the appropriate city officials are hereby directed to execute same subject to compliance with the following conditions: 1. Applicant agrees that Southeast 81" Street will be closed in accordance with the City Growth Management Director's memorandum dated March 3, 1998 (the "memorandum", a copy of which is attached hereto and made a part hereof as Exhibit "B"); 2. Applicant will be responsible for the cost and installation necessary to close SE 8 Street in accordance with the memorandum; 3. Applicant agrees that the closure shall be done through the placement of large concrete pipes standing on end and planted with a material such as bougainvillea in accordance with the memorandum; 4. The application for the special exception filed with the City will be completed thoroughly prior to any sign off by any city official; li 5. Applicant shall provide, place, and maintain the planting material and pipes; 6. The City will conduct a review within two years after the date of this Resolution to determine whether there is a need to replace plant material (at the applicant's expense) and that the plant material is adequately maintained; 7. The City's Growth Management Director shall draw up a plan for locating the concrete pipes and said plan shall meet the specifications of the Public Works Director. it 2 RESOLUTION NO. 39-98 i I Section 2 . Virta, AICP Growth Management Director RE: SE-23-97 Enterprise Rent A Car Date: March 3, 1998 Agents for Enterprise Rent A Car wish to locate a rent a car agency on South U.S.1. The property is currently zoned C-3 which allows for the establishment of such a use as a Special Exception. The property in which they wish to locate is a vacant portion of an existing retail commercial building. Previous uses of this particular structure have principally been retail in nature. When this property was developed, it was designed to meet the minimum standards in effect in Dania at the time of its construction. Fortunately the builders provided parking in excess of requirements to accommodate the patrons and employees of the center. These excess spaces will in part be utilized as storage for inventory vehicles. RECOMMENDATIONS The site plan as submitted meets the requirements of the Dania Code. The Commission will remember, however, that neighbors to the east were concerned over perceived negative impacts of the shopping center. As a condition of approval for the Special Exception the applicant has agreed to assist in the closing of S. E. Eighth Street. The proposed closure would be done through the placement of large concrete pipes standing on end and planted with a material such as bougainvillea. Approval of this request should include the requirement that S. E. Eighth Street be closed, with the applicant being responsible for the cost and installation shall be subject to approval of the Public Works Director.
