RESOLUTION NO. 37-98
l A RESOLUTION OF THE CITY OF DANIA, FLORIDA,
ACCEPTING A SPECIAL WARRANTY DEED FROM THE
HUMANE SOCIETY OF BROWARD COUNTY, INC. , TO THE
� CITY OF DANIA, CONVEYING A PORTION OF LOT 1,
BLOCK 13 , OF HIGHLAND PARK UNIT NO. 2,
ACCORDING TO THE PLAT THEREOF AS RECORDED IN
PLAT BOOK 12 , PAGE 29, OF THE PUBLIC RECORDS
OF BROWARD COUNTY, FLORIDA; PROVIDING THAT ALL
RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF
SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Humane Society of Broward County, Inc. , a Florida
not for profit corporation, owns a parcel of unimproved real
property which is adjacent to the Bass Pro development and the
Humane Society' s existing facility on Griffin Road in the City of
Dania; and
WHEREAS, a portion of the Humane Society' s real property
identified as Lot 1, Block 13, HIGHLAND PARK UNIT NO. 2, Plat Book
12, Page 29, Broward County Records, which property is described
with particularity in the Special Warranty Deed attached to this
resolution and marked Exhibit "A", is needed by the City of Dania
in the construction of the access road from Anglers Avenue into the
Bass Pro development; and
WHEREAS, the Humane Society of Broward County, Inc. has agreed
to convey the property described in Exhibit "A" to the City of
Dania in connection with the City' s agreement to lease to the
Humane Society of Broward County, Inc. certain vacant property ,
identified as Lot 13 and a portion of Lot 12, Block 13, of HIGHLAND
RESOLUTION NO. 37-98

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1 . That the Special Warranty Deed from the Humane

Society of Broward County, Inc . to the City of Dania, conveying a
portion of Lot 1 in Block 13 of HIGHLAND PARK UNIT NO. 2, Plat Book
12, Page 29, Broward County Records, which property is described
more particularly in the Special Warranty Deed, marked Exhibit 'A '
and attached to this resolution, be and the same is hereby
accepted.
Section 2 . That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed to the extent
of such conflict .
Section 3 . That this resolution shall be in force and take
effect immediately upon its passage and adoption .

SPECIAL WARRANTY DEED
THIS SPECIAL WARRANTY DEED made this day of February, 1998, by THE
HUMANE SOCIETY OF BRO WARD COUNTY,INC.a Florida not for profit corporation,having
its principal place of business at 2070 Griffin Road, Fort Lauderdale, Florida 33312, hereinafter
called Grantor, to THE CITY OF DANIA, a municipal corporation, whose address is 100 West
Dania Beach Boulevard, Dania, Florida 33004, hereinafter called the Grantee:
WITNESSETH: That said Grantor,for and in consideration of the sum of Ten Dollars and
other valuable consideration,receipt whereof is hereby acknowledged,hereby grants,bargains,sells,
aliens, remise, releases, conveys and confirms unto the Grantee, it successors and assigns, all that
certain parcel of real estate situate in Broward County, Florida, described as follows:
A portion of Lot 1, Block 13, HIGHLAND PARK UNIT NO. 2,
according to the plat thereof as recorded in Plat Book 12,Page 29,of
the Public Records of Broward County, Florida being more
particularly described as follows:
COMMENCE at Northwest comer of Lot 1, Block 13;
THENCE on an assumed bearing of North 89°59'39" East on the
North line of said Lot 1,48.44 feet to the POINT OF BEGINNING;
THENCE continue North 89°59'39"East on said North line, 1.56 feet
to the Northeast comer of said Lot 1;
THENCE South 00°00'21"East on the East line of said Lot 1, 125.00
feet to the Southeast comer of said Lot 1, said point being on the
North right-of-way line of Pine Street as shown on said plat also
being the South line of said Lot 1;
THENCE South 89°59'39"West on said North right-of-way line and
the South line of said Lot 1, 35.00 feet to a point on the arc of a
tangent curve,concave to the Northeast;
THENCE Northwesterly on the arc of said curve having a radius of

15.00 feet, a central angle of 15°04'42" and an arc distance of 3.95
feet to a point on the arc of a non-tangent curve, concave to the

THENCE Northeasterly on the arc of said curve having a radius of
246.00 feet, a central angle of 30°38'00" and an arc distance of
131.52 feet to the POINT OF BEGINNING.
Said lands situate, lying, and being in the City of Dania, Broward
County,Florida and containing 3,298 square feet(0.0757 acres)more
or less.
SUBJECT TO taxes and special assessments for the year and all subsequent years,to zoning
j restrictions and other requirements imposed by governmental authority, and to easements,
iconditions, reservations,restrictions and limitations of record.
TOGETHER WITH all the tenements,hereditaments and appurtenances thereto belonging
or in anywise appertaining. TO HAVE AND TO HOLD, the same in fee simple forever.
AND THE GRANTOR does hereby wan-ant the title to said land and will defend the same
against the lawful claims of all persons claiming by,through or under the Grantor.
IN WITNESS WHEREOF, the Grantor has caused these presents to be executed in its
name and its corporate seal to be hereunto fixed by its proper officer duly authorized,as of the day
and year first above written.
