A RESOLUTION OF THE CITY OF DANIA, FLORIDA, AUTHORIZING THE
PROPER CITY OFFICIALS TO REQUEST THE FLORIDA DEPARTMENT
OF TRANSPORTATION TO CONVEY SURPLUS PROPERTY
(SPECIFICALLY, A PORTION OF PARCEL B OF "THE NCL PLAT") TO
THE CITY OF DANIA TO BE UTILIZED FOR THE PURPOSE OF
PROVIDING A PUBLIC ROADWAY, SUCH PROPERTY BEING
IDENTIFIED IN THE LEGAL DESCRIPTION AND SKETCH ATTACHED TO
THIS RESOLUTION AND LABELED AS EXHIBIT "A"; PROVIDING THAT
ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT ARE
REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Florida Department of Transportation ("FDOT") acquires properties
for transportation facilities for the citizens of the State of Florida; and
WHEREAS, FDOT is permitted by law to convey real property that FDOT no longer
needs and determines to be surplus to other public entities to further the public needs of
the State of Florida; and
WHEREAS, the City can utilize FDOT's surplus property described on the attached
Exhibit "A" as a public road; and
WHEREAS, it is in the best interest of the citizens of the State of Florida to gain the
most transportation benefit from properties acquired with public funds; and
WHEREAS, the City is requesting, in connection with the development of the
Sportsman's Park project, that FDOT convey to the City the surplus property described on
the attached Exhibit"A" (specifically, a portion of Parcel B of"the NCL Plat"); and
1 WHEREAS, the surplus property sought for the project is proposed to be conveyed
i to the City for the purpose of providing a public roadway;
I NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
I Section 1. That the foregoing recitals are true, correct and incorporated into this
Resolution by this reference.

Section 2. That the City requests that FDOT convey title to the surplus property
described on the attached Exhibit "A" (consisting of three [3) pages, which property
description is incorporated by this reference) to the City pursuant to Section 337.215(4)(h),
Florida Statutes.
Section 3. That the surplus property to be conveyed to the City by FDOT will be used
for the purpose of providing a public roadway which will be in the best interests of public
transportation in connection with the development of the Sportsman's Park project, located
within the City of Dania.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.
