A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING A
SPECIAL EXCEPTION REQUEST BY LEONARD MERCER
REPRESENTING DANIA INTERNATIONAL COMMERCE CENTER, INC.,
FOR PROPERTY LOCATED AT 1551 NW 1sT ST., DANIA, FOR A SPECIAL y
EXCEPTION USE TO ALLOW SAID PARCEL TO BE USED AS A
COMMERCIAL RECREATIONAL USE AS PROVIDED FOR IN CHAPTER
28, ZONING, ARTICLE 4.20 SCHEDULE OF USE REGULATIONS;
PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH
CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28, Zoning; Article 4, District Regulations; Section 4.10,
Schedules Of Regulations provides for Commercial Recreation as a Special Exception Use
In districts zoned I-G; and
WHEREAS, Leonard Mercer of Dania International Commerce Center, Inc., has
applied for a special exception use to allow the use of an 'Indoor Go-kart Facility" and
Video Arcade at 1551 NW 1" St., Dania; and
WHEREAS, the Planning &Zoning Board on July 15, 1998 recommended that the
City Commission grant the special exception request to allow an 'Indoor Go-kart Facility"
and Video Arcade, based upon the criteria set forth in Chapter 28, Zoning, Article 6,
Supplementary Use Regulations, Section 6.40, Special Exception Uses, of the Code of
Ordinances of the City of Dania.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1. That that certain application SE-37-98, for a Special Exception Use
allowing property located at 1551 NW Is' St, to be used as an "Indoor Go-kart Facility"
and Video Arcade, a copy of which is attached hereto and made a part hereof as Exhibit
1
"A" be and the same is hereby approved, and the appropriate city officials are hereby
directed to execute same with the following conditions:
1. Leonard Mercer, Dania International Commerce Center, agrees to construct
sidewalks along all fronting streets;
2. Leonard Mercer, Dania International Commerce Center, agrees that Dania
Beach Boulevard will be improved along the south property boundary of the Dania
International Commerce Center to acceptable standards of the City;
3. Leonard Mercer, Dania International Commerce Center, agrees that the
necessary right turn tapers will be constructed on Bryan Road improving turning onto Dania
Beach Boulevard;
4. Leonard Mercer, Dania International Commerce Center, agrees to replace
the Washingtonian Trees with Royal Palm Trees as designated on the site.
Section 2 . That all resolutions or parts of resolutions in conflict herewith be and the
same are hereby repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Re: SE-37-98 Special Exception for an Indoor Go-Kart Facility
Date: July 28, 1998
This request is for a special exception for a commercial recreation use in the
dock high warehouse project you approved at your last meeting. The total project is
comprised of 253,912 square feet of warehouse and 28,212 of office space. This
request is for the utilization of a portion of the warehouse area.
At the time of Site Plan approval the applicant indicated that they would be willing
to make certain improvements. Those improvements included the following:
1. Sidewalks will be constructed along all fronting streets.

2. That Dania Beach Boulevard will be improved along the south property
boundary of the Dania International Commerce Center to acceptable
standards of the City.
3. That the necessary right turn tapers will be constructed on Bryan Road
improving turning onto Dania Beach Boulevard.
The Planning and Zoning Board recommendation is that you act favorably on this
request. That as a condition of approval the applicant shall construct the necessary
improvements as listed above prior to the issuance of any Certificate of Occupancy for
the entire project. The recommendation is that the City Commission approve this
request.

OF THE CITY OF DANIA, FLORIDA
1 NOTICE IS HEREBY GIVEN that the Dania City Commission on August 11, 1998 at
7:30 P.M., or as soon thereafter as the matter may be heard, will conduct a public
hearing in the City Commission Meeting Room of the Dania City Hall, 100 West Dania
Beach Boulevard, Dania, Florida, to consider the following:
SE-37-98 - The request of Leonard Mercer / Dania International Commerce Center,
Inc., for a special exception use to allow said parcel to be used for a Commercial
Recreational use, as provided in Chapter 28; Zoning Article 4.20 Schedule of Use
Regulations; Special Exceptions under the I-G zoning category. The location of said
parcel is 1551 NW 1" Street, Dania. The petitioner is requesting to allow an indoor "Go-
Kart" facility and video arcade in the proposed warehouse development. Property is
legally described as: Block 8, Less the West 326.50 feet thereof (as measured at right
angles), of "Tigertail Grove Resubdivision", according to the plat thereof as recorded in
plat book 30 at page 20, of the public records of Broward County Florida.
ANY PERSON WHO DECIDES TO APPEAL ANY DECISION MADE BY THE
PLANNING AND ZONING BOARD AND THE CITY COMMISSION WITH REGARD TO
ANY MATTER CONSIDERED AT THIS MEETING OR HEARING WILL NEED A
RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSE MAY NEED TO
ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE WHICH
RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE
APPEAL IS TO BE BASED.
