RESOLUTION NO. 112-98 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY RELIANCE HOUSING FOUNDATION, FOR PROPERTY LOCATED AT 20 NW 10T" CT, DANIA, ALSO KNOWN AS PARCELS 1 AND 2 OF THE TROPIC PARK SUBDIVISION; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF I RESOLUTIONS IN CONFLICT WITH THIS RESOLUTION ARE REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Reliance Housing Foundation has applied for site plan approval of a day care facility and extensive renovation of the existing Gulfstream Apartments at 20 NW loll Court., Dania, also known as Parcels 1 and 2 of the Tropic Park Subdivision; and WHEREAS, the Planning &Zoning Board on July 15, 1998, recommended that the I City Commission grant the site plan request (SP-43-98), based upon the criteria set forth in section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That that certain application (SP-43-98) for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit"A", is approved and the appropriate city officials are directed to execute same subject to compliance with the following condition: 1 RESOLUTION NO. 112-98 1. Applicant, Robert Jackson, Reliance Housing Foundation, agrees to comply with all requirements as specified by the City Fire I Marshal. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. Jackson, President C/o Reliance Housing Foundation 41 NW 10" Ct., Ste. 4 Dania, FL 33004 RE: Site Plan SP-43-98 Gulfstream Apartments Dear Mr. Jackson: I am in receipt of your letter (attached) dated July 27, 1998, regarding the closure at NW 10th Court between Tigertail Blvd. and Dania Beach Blvd. Although proper fire access roads and turning radii will be provided around the perimeter of the complex as shown on the current site plan, the closure at NW 10th Court by a fixed barrier is not acceptable. The closure of NW 10th Court creates a dead end road in excess of 150 feet. The actual distance as measured between Tigertail Blvd. and Dania Beach Blvd. is 627 feet. Dead end roads, as addressed by the South Florida Building Code, are required to have a fifty foot turn around cul-de-sac for fire access. (Please see attached code.) The closure of NW 10th Court without a turn around is not permitted by the Fire Code and is not in the best interest of the community or the citizens of Dania. I would suggest, as a reasonable alternative, that you consider a rolling or swinging gate. I will be happy to meet with you to discuss this issue at any time. Virta, AICP, Growth Management Director, City of Dania, Florida, as follows. I On May 27, 1998, we met with Michael Smith. City Manager, City of Dania. Florida to discuss the comments of the review of the site plan, indicating the planned N.W. 10° Court street closure between Tigertail Road and Dania Beach Boulevard. One of the comments that Mr. Smith addressed at this meeting was the Fire Marshals' request for an enlarged taming radius at the north end of N.W. 10"Court to allow for emergency vehicle turn- around area or, to increase the cornering radius of the east and west side drive paths. Our response at that meeting was that it is not practical or possible to increase the N.W. 10" Court turning radius due to the locations of the existing apartment buildings on both sides of N.W. 101, Court. We could, however,greatly increase the turning radius of the one-way asphalt paved drive paths which occur continuously along the east and west property boundary areas. This would allow emergency vehicles to enter from Dania Beach Boulevard along the east or west driveways and continue through to Tigertail Road, without the need to back-up at any point. Virta, AICP Growth Management Director FROM: Ed Tarmey Uvo— Fire Marshal RE: Gulfstream Apartments—SP-43-98 Date: July 24, 1998 The current site plan as submitted by Reliance Housing Foundation is indicating the closure of NW 10th Ct. between Tigertail Blvd. and Dania Beach Blvd. The closure of this road will prohibit Fire Department access and be in violation of SFBC Chapter 52, Section 5211.2(g)(2). The fire code pertaining to Fire Department access requires that dead end roads exceeding 150 feet have a turning area at the closed end no less than 100 feet in diameter. Unless the turning radius is provided at the closed end, no allowances for the closure of NW 10th Ct. is acceptable to my office. Smith, City Manager FROM: Terry L. vrta, AICP Growth Management Director RE: SP -43-98 Gulf stream Apartments Date: July 22, 1998 Reliance Housing Foundation has applied for site plan approval for a new community building and renovation of the existing Gulfstream Apartments. They have secured funding through the Florida Housing Finance Agency to carry out this work. Unfortunately they are on a very short time schedule in which to get the project permitted. I The site plan relies on the project utilizing NW 10"' Court as a part of the project. In order to do this the applicant will have to gain approval from the City Commission to make use of this right of way. As of this date there has not been an application filed to gain this approval. Because of the magnitude of the changes being proposed, the site is required to come up to the current landscape code. The site plan submitted does not reflect the minimum requirements of the City Code. The project will have to meet the following requirements for areas adjacent to the public right of ways: a. A ten-foot buffer is required between the abutting right of way and vehicular use area. b. Landscaping must include one (1) tree for each thirty (30) lineal feet as measured along the abutting right of way. c. A continuous hedge, wall or other durable landscape barrier shall be placed no closer to the vehicular use area than five (5) feet and shall be maintained at three (3) feet minimum height. Also landscaping is required along adjacent properties as follows: a. The buffer is to be five (5) feet wide. b. The landscaping must include one (1) tree for every forty (40) lineal feet. c. A continuous hedge, wall or other durable landscape barrier shall be placed no closer to the vehicle use area than two and a half (2.5) feet and must be maintained at a minimum of three (3) feet but no higher than five (5) feet. I These buffers are not counted toward meeting the parking lot landscaping requirements. Interior landscaping requirements shall be at twenty (20) percent of the vehicle use area. A recommendation of approval has been made to the City Commission by the Planning and Zoning Board that you approve this request subject to it meeting all requirements of the City Code with the exception of parking. Any approval also needs to recognize that it is the intent of the petitioner to utilize NW 10th Court as a part of the site. Reliance Housing Foundation is a nonprofit organization formed to develop affordable housing for low and very low income people. We have purchased the 96 unit Gulfstream Apartments, which as you know is the largest and most deteriorated property in the Modello Park neighborhood. We have been successful in obtaining financing for a complete renovation of the property. The renovation includes new pitched roofs, replacement of all windows and doors and total renovation of apartment interiors, including new kitchens and baths. We also will build a community building on the vacant portion of the property. The renovation portion of the project does not require site plan approval, however the new community building does require site plan approval. Our financing is in place and consists of the following: Florida Housing Finance Corporation tax exemptbonds $3,500,000 Low Income Housing Tax Credits 2,080,000 Federal Home Loan Bank Grant 500,000 Housing Finance Authority of Broward Cty. Loan 100,000 Reliance Housing Foundation 450,000 Total $6,630,000 Florida Housing Finance Corporation awarded us the tax exempt bond allocation in their most recent competitive application cycle. Gulfstream was ranked first out of over 40 applicants, most of which were much larger and sponsored by big for profit developers. The competition for these funds is very fierce. We are required to close the bond financing within the next few weeks in order to preserve our allocation of tax exempt bonds. A requirement of closing is that we have building permits. Our permit application for the renovation of the 96 apartments is well underway with the City and should be completed in time. Because we are a small nonprofit organization we have been strapped for predevelopment funding which has caused a delay in plan preparation for the community building. This building represents less than 10% of our renovation budget. However,they are unwilling to do that. The result is that in order to preserve our financing and proceed with this project we will have to obtain site plan approval for the community building at the July 15th Planning and Zoning meeting and subsequently, City Council approval at the July 28th meeting. The approval could be subject to satisfactory resolution of any outstanding issues and final review of the staff prior to issuance of building permits. If you can accomodate us in this manner it would give our architect and engineers the time to address any outstanding issues, prior to issuance of permits, but without having to come back in August for final approval, which would cause us to loose our financing. I know that this is an imposition on the staff and the commission. We have tried our best to avoid this situation. This is the final link in a long and complex process to finance this project, which I believe is important to the City and of immense benefit to the Modello Park neighborhood.
