FOR SOUTHWEST SIDEWALK AND LANDSCAPE IMPROVEMENTS PHASE II; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA. Section 1. That the proposal for professional services with Berry& Calvin, Inc. for Southwest Sidewalk and Landscape Improvements Phase 11, as set forth in Exhibit"A" attached hereto and made a part hereof, be and the same is hereby approved, including the fee for services in an amount not to exceed $15,000.00 as set forth therein. EYORS - PLANNERS March 28, 1997 Mr. Michael Smith City Manager City of Dania 100 West Dania Beach Boulevard Dania, Florida 33004 RE: Proposal for Professional Services Southwest Sidewalk and Landscape Improvements Phase II City of Dania, Florida B & C No. 97-1723 Dear Mr. Smith: We are pleased to submit this proposal for Professional Services on the above referenced project located between Ely Boulevard and Phippen-Waiters Road in the City of Dania. Every effort will be made to complete this project by October 31, 1997. Please see the attached schedule. This proposal includes the following professional land surveying,civil engineering,and construction management services: SCOPE OF SERVICES Berry&Calvin,Inc, will perform the following services based on our understanding of the project requirements: I. Professional Land Surveying Services Perform surveying services as required to prepare satisfactory engineering drawings including: A. Perform cross sections on the west half of the right-of-way. Professional Civil Engineering Services Preparation of improvement plans and specifications for construction bidding: A. Conduct five (5) informational meetings with the College Gardens neighborhood association to discuss scope and progress of proposed sidewalk project. B. Conduct field investigation to determine precise sidewalk requirements and scope of work. C. Prepare design plans on AutoCAD 12 format, including design details for new sidewalks and the regrading of swales for drainage purposes on the west side of Ely Boulevard and the east side of Phippen-Waiters Road. D. Coordinate Community Development Block Grant(CDBG)requirements and forms with Broward County for insertion into the project's construction bid documents. E. Provide bid item quantity and cost estimates for preparation of the construction bid documents. F. Assist the City in obtaining bidders,review the bids and make recommendations on award of the bid. G. Assist in the solicitation of qualified minority contractors for the construction of the project. III. Construction Phase Services A. Perform services during the construction of the project consisting of review of shop drawings,periodic field observations consisting of five(5)hours per week,and review of pay requests. B. Review the contractor's use of subcontractors for compliance with CDBG requirements for female and minority participation. Services During Construction Construction Associate 4 100 $400.00 Construction Inspector 32 50 $1,600.00 Subtotal $7,450.00 Subconsultant- Holland Engineering, Inc. $7,550.00 GRAND TOTAL: $I5,000.00 ADDITIONAL FEES Additional services as required by the City of Dania which have not been included in this proposal will be addressed in a separate contractual agreement. Professional services required due to changes in the site plan initiated by the client, their representatives or other consultants (e.g. architects, landscape architects, etc.) after either design or preparation of the construction drawings has commenced will be billed as Additional Services. Any outside engineering services, studies, or laboratory testing not specifically mentioned in the Scope of Services will be the responsibility of the City of Dania. All municipal, permit, and agency fees as well as Title Certificates will be paid by the client. Reimbursable Expenses Berry & Calvin, Inc. and its subconsultants will be reimbursed for the printing of drawings and specifications, deliveries, federal express services, required travel time and travel expenses, long City of Dania B&C DOC:\PROPOSAL\971723\Invs0328.%pd Page 4 March 28, 1997 distance telephone calls, fax transmittals,and postage,as required. Reimbursable expenses will be invoiced directly to the City of Dania. CLIENT RESPONSIBILITIES The City of Dania or their representative shall be available to meet with Berry & Calvin,Inc. and provide decisions in a timely manner throughout the course of the project. The City of Dania will provide Berry&Calvin,Inc.with plans and other pertinent information which may be necessary to properly survey or engineer the site. TERMS OF AGREEMENT The terms of the Agreement shall be valid for the client's acceptance for a period of thirty(30)days from the date of execution by Berry&Calvin,Inc. after which time this contract offer becomes null and void if not accepted formally(evidenced by receipt of an executed copy of this document). All l rates and fees quoted in this document shall be effective for a period of six (6) months, after which i time they may be renegotiated with the City of Dania. All original documents shall be retained by Berry&Calvin,Inc.and will remain their property. This information is proprietary and will not be shared with others without prior written consent. The City of Dania may request reproducible copies of all original documents upon payment of all outstanding invoices, and at the client's expense. Invoices for work accomplished to date will be submitted twice monthly and are payable within thirty (30)days. The City of Dania will pay invoices upon receipt and understands interest charges of 1.5% per month will be applied to any unpaid balance past thirty(30)days. Berry&Calvin, Inc.may elect to stop work until payment is received.
