A RESOLUTION OF THE CITY OF DANIA, FLORIDA,
DECLARING PROPERTY LEGALLY DESCRIBED AS LOTS
5, 6, 7, 8, 9, AND 10 OF MCKENZIE EYSTER
ADDITION, A SUBDIVISION, ACCORDING TO THE
PLAT THEREOF AS RECORDED IN PLAT BOOK 8, PAGE
9, OF THE PUBLIC RECORDS OF BROWARD COUNTY,
FLORIDA, TO THE SURPLUS PROPERTY NOT NEEDED
FOR PUBLIC USE; DESCRIBING ALL IMPROVEMENTS
LOCATED UPON SAID PROPERTY; PROVIDING FOR THE
CITY' S INTENTION AND DESIRE TO SELL OR
OTHERWISE DISPOSE OF SAID PROPERTY; PROVIDING
THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS
IN CONFLICT HEREWITH BE REPEALED TO THE
EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Dania obtained title to property
described as Lots 7, 8, 9 and 10 of McKenzie Eyster Addition,
with a street address of 1506 South Dixie Highway, Dania,
Florida, through foreclosure of a Dania code enforcement lien and
the city procured the certificate of title from the Clerk of
Court dated January 18, 1989; and
WHEREAS, the City of Dania obtained title to property
described as Lots 5 and 6 of McKenzie Eyster Addition, with a
street address of 1510 South Dixie Highway, Dania, Florida, by a
Sheriff' s Deed dated September 16, 1997 ; and
WHEREAS, the subject property is vacant land without
municipal improvements or structures located thereon; and

1 WHEREAS, the subject property has remained vacant and
without any active use by the city during its period of
ownership, excepting only a commercial structure on Lots 9 and 10
which has been demolished and removed by the city; and
WHEREAS, the City Commission of the City of Dania determined
� said property is no longer needed for public purposes and should
be sold or otherwise disposed of by the city.

NOW, THEREFORE, be it resolved by the City Commission of the
City of Dania, Florida:
jSection 1. That the real property described as Lots 5, 6,
7, 8, 9 and 10 of McKenzie Eyster Addition, a subdivision,
according to the Plat thereof recorded in Plat Book 8, Page 9, of
the Public Records of Broward County, Florida, with a street
address of 1506 - 1510 South Dixie Highway, Dania, Florida, is no
longer needed for public premises and is declared surplus
property.
Section 2 . The above-described real estate shall be offered
for sale by the city to the public at a time not less than thirty
(30) days nor more than sixty (60) days after adoption of this
Resolution and a notice shall be published by the city of its
intention to offer said property for sale by sealed bids in
accordance with the city charter.

Section 3. That all Resolutions or parts of Resolutions in
conflict herewith be and the same are hereby repealed to the
extent of such conflict.
Section 4 . That this Resolution shall be in force and take
effect immediately upon its passage and adoption.
PASSED AND ADOPTED THIS 25TH DAY OF NOVEMBER, 1997.

upon defendant Hubert H. Smith of the Notice of Sheriff' s Sale
dated August 7, 1997 .

Service return receipts for delivery of the notice of sheriff' s
sale upon subordinate lienholders identified as State Farm Mutual
Automobile Insurance Company, Lumberman' s Mutual Casualty
Company, General Motors Acceptance Corporation, AT&T Capital
Leasing Services, Inc. , Florida Medical Center, Inc. ,
