FOR CONSTRUCTION ADMINISTRATION SERVICES RELATING TO THE DREDGING OF THE DANIA CUT-OFF CANAL; AUTHORIZING APPROPRIATE CITY OFFICIALS TO ENTER INTO A CONTRACT WITH COASTAL SYSTEMS INTERNATIONAL, INC.; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA; Section 1. That that certain proposal of Coastal Systems International, Inc. for construction administration services relating to the Dredging Of The Dania Cut-Off Canal dated November 7, 1997, in the amount of$16,000.00 (Sixteen Thousand and no/100 Dollars, a copy of which is attached hereto and made a part hereof as Exhibit "A", be and the same is hereby approved and the appropriate city officials are hereby directed to execute same. Section 2. That the appropriate city officials are authorized to enter into a contract with Coastal Systems International, Inc. in the form attached hereto and marked Exhibit B. Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Section 4. The following are proposed terms of agreement of engineering services to be provided by Coastal Systems International.Inc.(Coastal Systems)for The City of Dania(City): PART I-CON.STRStCiioN ADAfl unRAliON Site visits by a Coastal Systems Engineer will be made during construction. Coastal Systems will perform site visits on a weekly basis as required by the City. Coastal Systems will document construction progress and will act as the City's representative throughout the construction period. Coastal Systems will review and approve the Contractor's periodic pay requests and will certify the project to FIND, the City, and Broward County upon its completion. Fees for Part I services are lump sum including expenses.............................................................................$16,000.00 GENERAL Coastal Systems will invoice the Owner on a percentage complete basis for this service. The City shall make Payment to Coastal Systems upon receipt of an invoice. Invoices not paid within thirty(30)days and not in dispute shall incur interest at a rate of IS percent per month. The City agrees to pay any cost of collection including reasonable attorney's fees incurred whether or not a suit is commenced or an appeal is taken. W I T N E S S T H This agreement shall constitute the terms and conditions under which the Engineer shall furnish all services necessary for construction administration services relative to the dredging of the Dania Cut-Off Canal (Project) , City of Dania, County of � Broward, State of Florida. SECTION ONE ENGINEER' S SERVICES A. Engineer agrees to provide all engineering and consulting services necessary for construction administration of the dredging of the Dania Cut-Off Canal by Subaqueous Services, Inc. B. Engineer will make on-site visits to monitor the construction administration of the project. The on-site visits will be made weekly as required by City. C. Engineer will document construction progress for the duration of the project. Y D. Engineer will act as the City' s representative throughout the construction period. E. Engineer will review the Contractor' s periodic pay EXHIBIB" "B" requests and determine whether such pay requests shall be '1 approved. a F. Engineer will certify the project to FIND, the City and to Broward County upon completion of the work. G. The parties agree that no additional work or extras shall be performed unless the same shall be duly authorized by the City in writing. SECTION TWO COMPENSATION A. City hereby agrees to pay to Engineer a total fee of SIXTEEN THOUSAND ($16, 000) DOLLARS AND NO1100 . B. The Engineer will receive progress payments on a i percentage complete basis for the above-described services . C. Engineer will submit to City periodic invoices detailing �I the percentage of services that have been completed. I D. City hereby agrees that within thirty (30) days from the day an Engineer' s approved Application for Payment is presented to the City, the City will pay the Engineer the invoiced amount. SECTION THREE MISCELLANEOUS A. In the event either party brings suit for enforcement of II art this agreement, the prevailing party shall be entitled to I attorney' s fees and court costs in addition to any other remedy afforded by law. .�J -2- B. The parties agree that this Agreement shall be governed by the laws of the State of Florida with venue lying in Broward County, Florida.
