RESOLUTION NO. 114-97
A RESOLUTION OF THE CITY OF DANIA, FLORIDA APPROVING
THE AGREEMENT WITH DOLPHIN FENCE OF SOUTH FLORIDA,
INC., FOR THE PURCHASE OF SUPPLIES, SERVICES,
EQUIPMENT AND MATERIALS FOR FURNISHING FENCING AND
INSTALLATION AT FROST PARK, MELI PARK AND MODELLO
PARK IN AN AMOUNT NOT TO EXCEED FIFTY NINE THOUSAND
SIX HUNDRED SIX DOLLARS AND N01100 ($59,606.00);
i PROVIDING THAT ALL RESOLUTIONS IN CONFLICT HEREWITH
BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Manager has determined that it is necessary to obtain the services of
Dolphin Fence of South Florida, Inc. for fencing installations at the Frost Park; Mali Park and
Modello Park; and
WHEREAS, the City Manager has determined that the city will realize a savings by
contracting with Dolphin Fence of South Florida, Inc., in an amount not to exceed Fifty Nine
Thousand Six Hundred Six Dollars And No/100 ($59,606.00); for furnishing fencing installation at
Frost Park; Mail Park and Modello Park; and
WHEREAS, the City Manager has determined that such services can be obtained at the
least cost to the city by accepting the bid submitted by Dolphin Fence Of South Florida, Inc., and
terms of the agreement with Dolphin Fence of South Florida, Inc., a copy of which is attached
hereto and made a part hereof as Exhibit"A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA, FLORIDA:

Section 1. That the City Manager be and he is hereby authorized to pay from the U.S.
Department of Justice Local Law Enforcement Grant the sum of ($59.606.00); for fencing
improvements.
Section 2. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

j AGREEMENT
THIS AGREEMENT, made and entered into this 12 day of August 1997, by and
between the City of Dania„ Florida, hereinafter called the Owner, and Dolphin Fence of
South Florida, Inc., a Florida Corporation, hereinafter called the Contractor.
WITNESSETH:
1. That the Contractor for the consideration hereafter fully set out, hereby agrees
with the Owner as follows:

That the Contractor shall furnish all the materials equipment and labor to
perform all the work necessary to complete the fencing and installation at
Frost Park, Modello Park and Meli Park for the City of Dania, Florida, all in full
and complete accordance to the following Specifications and Contract
Documents, which are attached hereto and made a part thereof, as if fully
contained herein:

2. That the Contractor shall commence the work performed under this Agreement
11 on a date to be specified in a write-in order by the Owner and shall complete all
work within 90 days after notice to proceed.
1 3. That the Owner hereby agrees to pay the Contractor for the faithful performance
of this Agreement, subject to additions and deductions as provided in the
Specifications of Proposal, in lawful money of the United States, the amount
of Fifty Nine Thousand Six Hundred Six Dollars and no1100 ($59,606.00)
based on the estimate quantities and unit, or lump sum prices contained herein.
4. That the Owner, within fifteen (16) days from the day of final inspection and
acceptance by the Owner, pay the Contractor the amount approved.
5. That upon submission by the Contractor of evidence satisfactory to the Owner
that all payrolls, material bills, and other costs incurred by the Contractor in
connection with the construction of the work have been paid in full, final
payment on account of this Agreement shall be made.
6. No additional work or extras shall be performed unless the same shall be duly
authorized by appropriate action of the Owner.
7. That in the event either party brings suit for enforcement of this agreement, the
prevailing party shall be entitled to attorney's fees and court costs in addition to
any other remedy afforded by law.
8. The Contractor shall guarantee the complete project against poor workmanship
and faulty materials for a period of twelve (12) months after final payment and

notification by the Owner.
9. The making and acceptance of the final payment shall constitute a waiver of all
claims by the Owner other than those rising from unsettled liens, from faulty
work appearing within twelve (12) months after final payment and Contractor
shall immediately correct any defects which may appear during this period upon
notification by the Owner.
10. The Contractor may requisition payments for work completed during the project
at monthly intervals. The Contractor's requisition shall show a complete
breakdown of the project components, the quantities completed and the amount
due, together with such supporting evidence as may be required by the Owner.
Each requisition shall be submitted in quintuplet to the Owner or Project
Manager for approval.
11. The engineer shall promptly notify the Contractor, in writing, if either the Owner
or engineer, after due investigation, has reasonable objections to any
subcontractor on such list and does not accept him. Failure of the Owner or
engineer to make objection within two weeks to any subcontractor on the list
shall constitute acceptance of such subcontractor. After acceptance, no
subcontractor shall be changed without written approval of the Owner and
} engineer.
12. The Contractor shall indemnify and save harmless the City of Dania, their
agents and employees from or on account of any injuries or damages, received
or sustained by any person or persons or on account of any operations
connected with the construction of this project; or in connection with the same;
or by use of any improper materials or by or on account of any act or omission
of the said Contractor or sub-contractor, agents, servants, or employees.
Contractor further agrees to indemnify and save harmless the City of Dania,
their agents or employees, against any claims or liability arising from or based
upon the violation of any federal, state, county or city laws, by-laws, ordinances
or regulations by the Contractor, his agents, servants or employees.
The indemnification provided above will obligate the Contractor to defend at its
own expense or to provide for such defense, at the City of Dania option, of any
and all claims of liability and all suits and actions of every name and description
that may be brought against the City of Dania which may result from the
operations and activities under this contract whether the construction operations
are performed by the Contractor, sub-contractor or by anyone directly or
indirectly employed by either. The execution of this contract by the Contractor
shall obligate the Contractor to comply with the foregoing indemnity provisions;
however, the collateral obligation of insuring this indemnity must be complied
with as set forth below.

13. The contractor will be required prior to execution of the contract by the Owner,
to furnish a certificate of insurance and will cause to be issued by the
Contractor's insurance carrier, an endorsement including the City of Dania as
named insured under such contract of insurance.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on
the day first written above, in two (2) counterparts, each of which shall without proof or
accounting for the other counterpart be deemed an original Contract.

FENCING SPECIFICATIONS
-_ CHAIN-LINK FENCING
I. GENERAL
A. Scope
This section covers the requirements for furnishing materials and constructing
chain-link fence as indicated on the attached drawings.
The fence shall be the product of a manufacturer who has demonstrated by
actual installations of a similar nature that its product is of the type required. The
Contractor shall include all supplementary parts necessary or required for a
complete and satisfactory installation within the true meaning and intent of the
drawings. All runs of the fence shall present the same general appearance and
the product of one manufacturer only will be accepted, except for items which do
not influence the appearance of the completed fence. No used, rerolled or open-
seam steel shall be permitted in posts, rails or braces.
II. MATERIALS
A. Fabric
Chain-link fabric shall conform to the requirements of AASHTO M 181 and shall
be a 2-inch mesh, 9 gauge, 6 feet, 8 feet & ten feet high with both selvages
knuckled. It shall be as follows:
1. Zinc-coated steel-galvanized after weaving.
2. The weight of coating of uncoated wire fabric shall be 2.0 ounces of Zinc
per square foot.
B. Fence Posts. Rails and *Braces
Pipe used for fence posts, rails and braces shall conform to the requirements of
Federal specifications RR-F-191 and shall have the dimensions as indicated
below:

C. Wire Ties
Wire ties for fastening fabric to posts, rails and braces shall be 6 gauge
- .� aluminized wire.
D. Miscellaneous Fittings and Hardware
Miscellaneous fittings and hardware shall be of design standard with the
manufacturer. Miscellaneous fittings and hardware furnished for use with
other than aluminum allay fabric shall be zinc-coated steel.
III. INSTALLATION
A. Welding
Structural members of gates which are in contact shall be fully welded by a
method that will produce a continuous weld on all side and faces of joints at
exposed edges. Surplus welding material shall be removed.
B. Installing Posts
Posts shall be spaced not more than 10 feet apart and shall be set in concrete
bases 12" in diameter x 36" deep. The top of the concrete bases shall be
slightly above the ground, trowel finished, and sloped to drain away from the
posts. Holes of full depth and size for the concrete bases for posts shall be dug
to the size and depth as specified. Posts settings shall be done carefully so
that posts shall be vertical and in true alignment and rigidly secured in position.
Concrete shall be 2,500 psi, 28 day compressive strength.
On terminal (end, corner, pull and brace) posts, the post tops and brace rail
clamps around the posts shall be placed before setting the posts in concrete
bases.
For gate posts, if the ground is not level, the upgrade post shall be set first to
get the proper height for the downgrade post. The concrete bases for end,
corner, pull and brace posts shall be placed first and allowed to cure for 7 days.
Stretcher bar bands and truss bands shall be spread and slipped on end,
corner, pull and brace posts as the next operation. Post tops are then inserted
on all other posts. No extra compensation shall be made for rock excavation.
C. Installing Top Rails
To start the installation, a length of top rail shall be run through the first couple
of post tops; a rail clamp shall be assembled on the end corner. The end of the
rail already placed shall be butted into the clamp and fastened. The top rail
shall be installed along the run of the fence and the various sections joined with
sleeve couplings. At not more than every 100 feet an expansion coupling shall
be placed to take care of expansion and contraction of the rail. The rail shall be
clamped in the end or corner at the end of the run of the installation of top rail.
The top rail shall follow the lay of the ground.

D. Installing Braces
All horizontal braces shall be attached together with truss rods at all terminals
(end, corner and pull) posts to the brace posts.
E. Installing Fabric
The fabric shall be unrolled on the outside of the fence line with the bottom
(twisted, unknuckled) edge of the fabric against the posts. The various rolls
shall be spliced by bringing the ends close together and weaving in a picket in
such a way that it will engage both of the roll ends and catch with each twist
each separate mesh of the end pickets of both rolls of fabric. The fabric shall
be raised and tied loosely to the top rails with a temporary tie wire at intervals of
about 20 feet. The fabric shall be installed by a standard method of wire
attachment or with wire fasteners not less than 24" g.c., whichever spacing is
less.
Standard chain-link fence stretching equipment shall be provided for stretching
the fabric before tying it to the rails and posts. The stretching and tying
operations shall be repeated about every 100 feet until the run of fence is
completed.
VERTICAL PICKET FENCING
I. GENERAL
A. Scope
This section covers the requirements for furnishing materials and constructing
vertical picket fencing as indicated on the attached drawings.
The fence shall be the product of a manufacturer who has demonstrated by
actual installations of a similar nature that its product is of the type required. The
Contractor shall include all supplementary parts necessary or required for a
complete and satisfactory installation within the true meaning and intent of the
drawings. All runs of the fence shall present the same general appearance and
the product of one manufacturer only will be accepted, except for items Which do
not influence the appearance of the completed fence. No used, rerolled or open-
seam steel shall be permitted in posts, rails or braces.
II. MATERIALS
Tubing used for fence posts, pickets and rails shall comply as follows:

III. CONSTRUCTION
A. All members which are in contact shall be fully welded by a method that will
produce a continuous weld on all sides and faces of joints at exposed edges.
Excess welding material shall be removed,
B. Fence panels shall be black oven-baked and/or powder-coated. Field welds
shall be chipped and wire-brushed clean to remove all slag and burned
coatings. Field welds shall be primed with red lead primer and top coated with
two coats of black spray enamel to match fence finish.
C. Fence shall consist of V square tube to be welded into 1" x 2" channel, tubes
being vertical and channels being horizontal. Tubes (pickets) shall terminate
inside channel and not extend beyond or through. Tubes shall be installed at
5" center-to-center spacing. Fence panels as constructed shall be 10' tall and
6' long. Panels shall be welded to 2 ''/a' square tube posts which shall be of
sufficient length to extend 3' into ground and extend to top of panels. Posts
shall have cups welded on top to seal end of tube opening.

IV. INSTALLATION
Posts shall be spaced 6' center-to-center. Posts shall be set in concrete bases 12"
:) in diameter x 36" deep. The top of the concrete bases shall be slightly above the
ground, trowel finished and sloped to drain away from the posts. Holes of full depth
and size for the concrete bases for posts shall be dug to the size and depth as
specified. Concrete shall be 2500 psi, 28 day compressive strength.
Posts shall be of sufficient length to extend 3' into the ground and extend to the top
of the panels. Posts shall terminate under the top rail (1" x 2" channel) or have a cap
welded or secured into the open end of the top of the tube to prevent water intrusion.
Panels shall be installed level, starting with the bottom rail not less than 2" nor more
than 4" above the ground at the upgrade post. Where the ground is level, the panels
shall be +/-4" above the ground. If the ground is not level, the upgrade post shall be
i first to establish the proper height for the downgrade post. Panels shall be installed
in such a manner that the spacing between the first and last pickets and the posts is
less than 4", but equal on both ends and consistent throughout all panel installations.

SUPPLEMENTARY CONDITIONS
1. Qualifications of Bidders
No proposal will be accepted from, nor will any Contract be awarded to, any person
or firm who is a defaulter, as surety or otherwise, upon any,obligation to said Owner,
or who is deemed irresponsible or unreliable by Owner.
Owner shall have the right to investigate the financial condition, experience record
and equipment of each prospective bidder and determine to Owner's satisfaction the
competency of each to undertake the Project. All information requested by Owner to
assist in this regard shall be furnished by Contractor within five days of such request.
2. SubContractors and Principal Material Manufacturers
The apparent low bidder and such other bidders as Owner may request in writing,
shall submit to Owner a fist of aff subContractors and other persons and
organizations (including those who are to furnish the principal items of materials and
equipment) proposed for any portion of this project in conformance with the
"Instructions to Bidders." When this list is approved, no deviations shall be allowed
from that list without the written consent of the Owner.
Insurance
(a) Public Liability and Property Damage Instructions
The Contractor shall take out and maintain during the life of this contract such
Public Liability and Property Damage performing work covered by this contract
from claims for damages for personal injury, including accidental death as well
as from claims for property damage which may arise from operations under this
contract, whether such operations be by himself or by any subContractor or by
anyone directly or indirectly employed by either of them, and the amounts of
such insurance shall be as follows:
The limits of public liability provided by such policy or policies shall be no less
than Five Hundred Thousand Dollars ($500,000) for injuries including wrongful
death to any person and subject to the same limits for each person and an
amount not less than One Million Dollars ($1,000,000) for damages on account
of all occurrences.
(b) Workmen's Compensation Insurance
The Contractor shall take out and maintain during the life of this contract
Workmen's Compensation Insurance as provided by the laws of the State of
Florida.
(c) Contingent Liability
The above policies for Public Liability and Property Damage Insurance and
Workmen's Compensation Insurance must be so written as to include
Contingent Liability and Contingent Property Damage Insurance to protect the
Contractor against claims arising from the operations of sub-Contractors.
All insurance policies required herein shall contain a provision whereby the
company executing the same shall obligate itself to notify the Owner in writing,
at least 15 days before any alteration, modification or cancellation of such
policies becomes effective.
Special hazards such as, but not limited to, explosion, collapse and
underground shall be covered by rider or riders to the Comprehensive General
Liability Insurance Policy or Policies herein required to be furnished by the
Contractor to provide coverage for all types and conditions of construction
necessary to be performed under this contract.
3. Liquidated Damages
It shall be the Contractor's responsibility to complete the work within the time
specified on the Bid Form or a penalty of $100.00 a day will be imposed thereafter.
Contract time shall begin from the date of Notice to Proceed.
4. Licenses
Contractor shall provide copies of Broward County Certificate of Competency, City
and County Occupational License in which the business is located, and a Broward
County Occupational License. Contractor shall register these licenses with the City
Building Department.
5. Permits
A separate permit will be required for each separate location. Permit fees will be
waived by the City, however state or county fees must be paid.
6. Payment
Payment will be made in full upon request and receipt of approved final inspection by
the City of Dania Building Department, approval by the City of Dania Parks and
Recreation Department and receipt of invoice by the City of Dania Finance
Department.

I' GENERAL REQUIREMENT:.
1. LINE AND GRADE
The Owner has provided vertical control for layout of the work in the form of bench
marks located adjacent to the work. From these bench marks, and from horizontal
controls provided by the Owner, the Contractor shall establish all working points, lines
and elevations.
2. PROTECTION AND RESTORATION OF SURVEY MONUMENTS
The Contractor shall be! responsible for protecting and restoring all land and property
corners, such as section corners, % section corners, property corners or block control
points and for maintaining all horizontal aa.d vertical control points. All surveying work
shall be the responsibility of the Contractor and shall be performed under the
supervision of a Florida Registered Land Surveyors. Survey points that will be
destroyed during construction shall be properly referenced and replaced at the
Contractor's expense with permanent monuments approved by the Owner.
3. UTb_ [r" LOCATION
The .contractor shall notify each utility company two weeks prior to the start of
construction to arrange for pcsi,ive underground location, relocation or support of its
utility, where that utility r.,Gy be in conflict with or endangered by the proposed
construction. All charges by utility companies for temporary support of its utilities shall
§ be paid for by the Contractor. All costs of permanent utility relocations to avoid conflict
shall be the responsibility of the Contractor and the utility company invoived.
The Contractor shall schedule his work in such a manner that he is not delayed by the
utility companies relocating or supporting their utilities. No compensation shall be
made for such loss of tirne.
It shall be the Contractor's responsibility to verify the known locations. He shall fully
understand that certain structures may not be located precisely as shown, or may be
omitted entirely.
The position of certain structures and utilities diiecriy affects the proposed
construction. Therefore, to insure that the proposed work can acrucn!ly be positioned
as planned, the Contractor shall make any excavation necessary for location of
structures and utilities prior to construction of that particular portion of the project.
All overhead, surface or underground structures and utilities encountered in tiench;mg
whether shown on the Plans or not are to be carefully protected from injury or
displacement. All damage to such struct,Ares is to be completely repaired within s
reasonable time; needless delay will not be tolerated. The City reserves thu rig.a to
remedy such damage by ordering outside parties to make such repairs at t!:e expense
of the Contractor.

All such repairs made by the Contractor are to be made to the satisfaction of the utility
owner; all damaged water or gas pipes must be replaced or prevented from leaking.

All repairs are to be inspected by the utility owner prior to backfilling.
4. EQUIPMENT
All construction equipment necessary and required for the proper construction of this
project shall be on the construction site, in first-class working condition, and shall have
been approved by the Owner before construction is permitted to start. The Contractor
shall provide such tamping tools and equipment as are necessary for the proper
compaction of the backfill.
5. STORAGE SITES
The Contractor shall be furnished, on the job site, suitable areas for field offices,
material storage and equipment service and storage as directed by the Owner. The
Contractor shall maintain these areas in a clean, orderly condition as not to cause a
nuisance in the area.

2.9. Finish;
A. All fencing and components fabricated from structural steel and or malleable iron shall
be hot dipped galvanized undercoated inside and outside to assure maximum
corrosion resistance coated.
B. Preparation;
1. All metal shall be thoroughly rinsed in warn water to produce a surface that Is water
free.
2. All metal shall be etched In a Iron phosphate pre treatment at 130 mg to Insure
positive finish adhesive.
3. All metal shall be thoroughly rinsed in a clean water rinse to remove chemicals that
would prohibit positive adhesion.
4. All metal shall be chromate seal baked to assure a professional finished surface
prior to painting.
C. Paint;
1. All metal shall receive a polyester resin based powder coating applied by an
electrostatic spray process that shall achieve a dry film thickness or not less than
2.5 mlls. All paint finished shall be over baked to achieve a metal temperature of
450 for 20 minutes.
2. The factory finish shall be fully protected by the contractor during transport to the site.
The owner reserves the right to reject fencing products,that in the owners option,are
damaged and finish surfaces that would cause premature paint failure.
