HomeMy WebLinkAboutR-1997-109 RESOLUTION NO. 109-97 A RESOLUTION OF THE CITY OF DANIA, FLORIDA, AUTHORIZING THE CITY TO INCUR COSTS ASSOCIATED WITH VACATING ROAD RIGHT-OF-WAY AND AMENDING EASEMENTS ALONG PORTIONS OF SOUTHEAST 5T" AVENUE INCLUDING ROADWAY AND NON-ROADWAY RELATED STORMWATER MANAGEMENT PURPOSES BEGINNING IN THE MULTI- FAMILY ZONED PARCELS ABUTTING THE SOUTHEAST 5T" AVENUE EASEMENTS; PROVIDING THAT ALL RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Southeast 5th Avenue in the City of Dania has been removed from the Trafficways Plan of Broward County, Florida; and WHEREAS, the strip of land within the west right-of-way line of said Southeast 5th Avenue is no longer needed for the expansion of said road; and WHEREAS, the City Commission desires to vacate the majority of said strip of land to the adjoining property owners excepting some easements which will be retained by the City; and WHEREAS, the City of Dania city Commission has established a Stormwater Utility Fund for stormwater management purposes; and WHEREAS, roadway and non-roadway related stormwater management is a major public concern in this southeast area. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA. Section 1. That the City Manager is hereby authorized to incur costs associated with beginning the vacation process of right-of-way, including roadway and non- roadway stormwater management related purposes and other possible non-roadway 1 RESOLUTION NO. 109-97 purposes, beginning in the multi-family zoned parcels abutting the Southeast 5t" Avenue easement. Section 2. That the City Manager be and he is hereby authorized to pay from the Stormwater Utility Fund an amount not to exceed $25,000.00 Section 3. Dania Beach Boulevard Dania,FL 33004 RE: 5'Avenue Right-of-Way Dedications CG&A Project No. 92-1101.60 Dear Mr. Smith: Attached are tables summarizing the research conducted to determine the right-of-way easements associated with 5' Avenue. Many of the adjacent properties were found to have varying easement widths "dedicated to the perpetual use of the public for proper purposes." The process that the City would need to consider in vacating these right-of-way easements would require contacting each property owner and discuss the City's intention to eliminate any possibility of the County widening 5' Avenue. If the property owners agree to the vacation, it would be in the City's best interest to have the easements dedicated to the City. There are probably many legalities involved that the City would need to consider. However, Calvin, Giordano, & Associates are available to assist the City in any way to process the easement vacations.
