PUBLIC HEARINGS: 4.1 "AN ORDINANCE OF THE CITY OF DANIA, FLORIDA AMENDING IN ITS ENTIRETY SECTION 27-202, ARTICLE VII OF CHAPTER 27 OF THE CODE OF ORDINANCES OF THE CITY OF DANIA, FLORIDA ENTITLED IMPOSITION OF CHARGES" TO CAUSE SAID SECTION TO BE IN AGREEMENT WITH THE CODE OF REGULATIONS OF BROWARD COUNTY DEPARTMENT OF NATURAL RESOURCES PROTECTION; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE." After discussion, the motion was withdrawn by Commissioner Hyde. i Another motion was made by Commissioner Hyde, seconded by Commissioner Etling to deny the approval of this ordinance. Albert Jones presented concerns regarding the procedures used to apply for Community Development Block Grant funds. 7. EXPENDITURE REQUESTS - none REGULAR MEETING 6 JUNE 10, 1997 r 8. DISCUSSION AND POSSIBLE ACTION 8.1 Request for Letter of No Objection to amend the note on plat "Taco Bell at Dania" as requested by Charlie Jones, Fortin, Leavy, Skiles, Inc. (Continued from the May 27,1997, Regular Meeting) Charlie Jones represented the owner, Dominick Scotto. Mr. Jones stated that the guidelines for Taco Bell had changed and they were no longer interested in purchasing the property. He also stated that the owner has someone interested in putting a hotel there and is requesting approval to amend the note on the plat to change from a commerical fast food restaurant site to a hotel site. He stated that a Ramada Inn, Howard Johnson's or Travelodge would possibly be constructed on the site. A motion was made by Commissioner Etling, seconded by Commissioner Hyde to approve Item 8.1. The motion passed on the following roll call vote: Commissioner Bertino - yes Commissioner Etling - yes / Commissioner Hyde - yes Vice-Mayor Cali - yes Mayor Mikes - yes REGULAR MEETING 7 JUNE 10, 1997 r y \ 8.4 Discussion of Department of Transportation Agreement relating to conditions to sign variance (VA-06-97) approved March 25, 1997, for BVT Institutional Investments at 400 E. Sheridan Street (Publix Shopping Center). City Manager Smith withdrew this item for further review by the City Attorney. 8.5 Discussion of City beautification and neighborhood improvement projects. (Mayor Mikes) The Commission agreed that a workshop meeting be scheduled with the Dania Improvement Committee and neighborhood associations to discuss beautification and improvement projects within the City. 8.6 Discussion of cemetery plots and future availability. (Mayor Mikes) Mayor Mikes expressed his concern about cemetery plots being sold to non- residents, thereby making less plots available for Dania residents. He felt that Dania residents should have priority over non-residents. Commissioner Bertino also suggested that mausoleums be looked at. The Commission agreed that the Human Relations Board should review these concerns and make a recommendation to the Commission. 9. APPOINTMENTS 9.1 Four (4) members needed on the Airport Advisory Board. 9.2 One (1) appointment to Code Enforcement Board to fill Plumbing/Mechanical Subcontractor position due to declination received from James Rogers. 9.3 Four (4) members needed for the Community Affairs Advisory Board. 9.4 Four (4) members to the Dania Economic Development and Downtown Redevelopment Board. 9.5 One (1) member needed on Human Relations Board. 9.6 Seven (7) members on Marine Advisory Board. Mayor Mikes appointed Frank. B. Ventimiglia. 9.7 Four (4) members on Occupational License Review Advisory Board. REGULAR MEETING 8 JUNE 10, 1997 r "1 9.8 Two (2) member on Planning & Zoning Board. 9.9 Three (3) citizen nominations for Civil Service Board. 9.10 One (1) Commission appointment on General Employee's Pension Board for term expiring June 23, 1997, Richard Eglinas. Richard Eglinas was reappointed to this Board. 10. ADMINISTRATIVE REPORTS 10.1 City Manager- responded to comments relating to Community Development Block Grant program concerns. i 10.2 City Attorney - no comments 11. COMMISSION COMMENTS 11.1 Commissioner Bertino - commended Utilities Director Bud Palm and his crew regarding the fine job done on the drainage in the SE area. He congratulated the Dania Optimist on their groundbreaking. He also suggested that a workshop meeting be scheduled to work-up strategies for sidewalk repairs. 11.2 Commissioner Etling -was concerned about traffic back-up at John U. Lloyd State Park thereby making Dania Beach inaccessible on holiday weekends. 11.3 Commissioner Hyde - was concerned about trucks parking in the traffic lanes on Griffin Road. 11.4 Vice-Mayor Cali - commended staff and F.A.U. for the program put on for the advisory boards. 11.5 Mayor Mikes - attended the Optimist Club groundbreaking. He asked the City Attorney to research the financial situation of the Housing Authority. He was concerned about the City being prepared for Hurricane Season. At that time, the Second Continental Congress authorized a new flag to symbolize the new Nation, the Unites States of America; and WHEREAS, the Stars and Stripes first flew in a Flag Day celebration in Hartford, Connecticut in 1861, during the first summer of the Civil War. The first national observance of Flag Day occurred June 14, 1877, the centennial of the original flag resolution; and WHEREAS, by the mid 1890's the observance of Flag Day on June 14 was a popular event. Mayors and governors began to issue proclamations in their jurisdictions to celebrate this event; and WHEREAS, in the years to follow, public sentiment for a national Flag Day observance greatly intensified. Bud explains that money has been allocated for a study to review the accuracy of this fee, and as such, we should wait until this study is commissioned and completed. Berry and Calvin also recommend, as I have, to NOT change the rate for mini- warehouses from 0.01 to 0,05, 2s, without study and justification, this can be seen as arbitrary and capricious. I have also polled several other cities and the county to determine their methods of calculations. The majority of the cities, and the county, use the DNRP flow schedule, as I've proposed. The minority use either the size of the water meter, or their own schedule (as Dania does now). Jadoo, Dania Nursing Home, has submitted a petition for a text amendment to the Zoning Code which would allow existing nursing homes with a minimum of fifty (50) beds, the ability to operate and own adult living facilities in separate dwelling units, with 1 kitchen and bathroom facilities, that are occupied by no more than six (6) residents per dwelling unit. I He has also submitted a companion special exception request that would provide for the siting of eight (8) of these facilities across the street and adjacent to the existing Dania Nursing Home, which is also located in an RS-6000 zoning district and is currently operating as a non-conforming use. At the request of Mr. Richard Coker, council for the petitioner, an ordinance has not been prepared so that the Commission may determine the exact language to be included in the zoning text amendment as it pertains to providing: Definitions for "Special Residential Facilities" categories; providing a procedure to obtain a certificate of occupancy; determining density of special residential facilities; and to specify i providing development standards and conversion to other uses. The subject area is zoned RS-6000 and the predominant uses in the area residential, and predominantly single family uses. The Florida Statutes provide for the location of community residential homes for six (6) residents or less. However, there is a 1,000 foot separation between each of these facilities by State Statute. The intent of the Statute was to permit these facilities to exist in a residential setting thereby not providing more intensive uses than might be acceptable for single family residential neighborhoods. The property owners have acquired the parcels and provided significant renovations to the properties in anticipation of this proposed use. However, this use is not permitted in the zoning code of the City. Linked to the petition is a special exception request for the five (5) lots and eight (8) facilities on those lots. 1 I I Page 2 TX-34-96 The Planning and Zoning Board, at their April 16, 1997 regular meeting, recommended denial of the Text Amendment request and denial of the request for Special Exception use, by a 4-1 vote. The Special Exception Use Application is subject to the requirements of Section 6.40 of the Dania Code. These requirements are addressed as follows: (a) T7r2t the use is a permitted special exception use as set forth in the Schedule of Use Regulations. City of Dania, in Article 4 hereof. Upon the approval of the zoning text change, Special Residential Facilities I will be permitted without regard to the 1,000-foot distance requirement. (b) That the use is so designed, located and proposed to be operated that the public health, safety, welfare and morals will be protected. The eight(8) buildings proposed to be used by the applicant are to be used in conjunction with the existing Dania Nursing Home. The nursing home has been operated in a manner that has been a real positive factor for the existing neighborhood,and the proposed special residential facilities will be operated in the same manner. The properties will be maintained in a first class condition, and the use itself is a very low intensity use. The residents of the homes do not drive, and the only traffic generated will be by the employees and occasional visitors. The project's design will ensure privacy for the adjacent residential uses. In connection with the design of the special residential facilities,the applicant proposes to construct a 6-foot high wooden fence adjacent to all eadsting residential uses and to landscape the perimeter of the uses in accordance with the landscaping requirements for multi-family developments under the Dania Code. In addition, the special residential facilities are located in one compact area adjacent to the existing Dania Nursing Home, so that their impact will be minimal on the adjacent residential uses. The areas to be vacated are located adjacent to the Donna Subdivision. The petition requests vacation of a canal right-of-way, an alley and an anchor easement located within the canal right-of-way. The portion of the canal right-of-way to be i abandoned commences approximately thirty feet (30') south of Griffin Road and is sixty feet (60') wide and one hundred and sixty feet (160') deep. The alley west of the canal also commences thirty feet (30') south of Griffin Road and is twenty feet (20') wide and one hundred and sixty feet (160') deep. The majority of the alley east of the canal has been abandoned through a previous vacation. This petition includes the remainder of the alley which is approximately five feet (5') deep. Finally, the applicant is requesting j vacation of an anchor easement located within the canal right-of-way. (See attached.) The canal has been filled in and replaced with a culvert structure as a requirement of the Oakridge development's surface water management permit. The anchor easement was needed to provide electric to the pump house, which has been demolished. The majority of the east 20' alley was vacated by O.R. 15647-358. Our proposed vacation will vacate the remaining 5' of the alley between the vacated alley and the Griffin Road right of way line, since that area no longer functions as an alley. The west 30' of the canal right of way and the entire 20' alley west of the canal will revert to the property owner to the west, who will in turn quit claim the 50' back to our client. A hearing is required to obtain such a license. The applicant has been given notice that this hearing is to be held at the June i 10, 1997 City Commission meeting. Section 12.5(d) lists the criteria by which the City Commission may refuse or revoke a Fortunetelling license. A copy of that criteria is attached. A background check is required to be completed by the Broward Sheriffs Office and FDLE concerning the applicant's moral character and business responsibility. Issuance and Revocation of License. i j (A) The City Commission of the City of Dania, Florida, is hereby authorized to grant or renew a fortunetelling, palmistry, clairvoyancy or astrology license for any period of time not exceeding one year to any individual applying therefor on a form to be provided for in Section (B) of this section and the filing by the applicant of the bond required by Section 5 of this I ordinance . Ordinance No. 20-90 a � 1 1 1 (B) The form on which application shall be made for a fortunetelling, palmistry, clairvoyancy or astrology license shall require the following information: ( 1 ) Name of applicant; (2) Residence and business address of applicant; (3 ) The length of time for which a fortunetelling, palmistry, clairvoyancy or astrology license is desired; (4) A statement as to whether or not the applicant holds, or has held a fortunetelling, palmistry, clairvoyancy or astrology license from any state, municipality, governing body or licensing authority; a list of such licenses and a statement of the time, place and by whom issued; a statement as to whether any state, municipality, governing body or licensing authority has ever refused to issue or to renew a fortunetelling, palmistry, clairvoyancy or astrology license to the applicant together with a full and accurate statement as to the reasons for any such refusal; and a statement as i to whether any state, municipality, governing body or licensing authority has every revoked a fortunetelling, Palmistry, clairvoyancy or astrology license held by the i applicant together with a full and accurate statement as to the reasons for any such revocation. (6 ) A photograph of the applicant, taken within 60 days immediately prior to the date of the filing of the application, which picture shall be 2" by 2" showing the i head and shoulders of the applicant in a clear and distinguishing manner, except that the city commission may waive this requirement with respect to an application for renewal of a fortunetelling, palmistry, clairvoyancy or astrology license by an individual holding an unexpired fortunetelling, palmistry, clairvoyancy or astrology license issued under this ordinance who has in a previous application under this ordinance complied with this requirement; (7) The fingerprints of the applicant and the names of at least two reliable property owners of the County of Broward, State of Florida, who will certify as to the applicant's good moral character and business responsibility, except that the city commission may waive this requirement with respect to an application i for renewal of a fortunetelling, palmistry, clairvoyancy or astrology license by any individual holding an unexpired license issued under this ordinance who has in a previous application under this ordinance complied with this requirement. 1 (C) Before issuing a fortunetelling, palmistry, clairvoyancy or astrology license to- any individual applying therefor the city -3- i i Ordinance No. 20-90 i V commission shall refer the application to the Broward County Sheriff 's Office who shall cause to be made such investigation of the applicant 's moral character and business responsibility as he deems necessaryfor the protection of the public good, except that ! the city commission may waive this requirement with respect to an application for renewal of an existing license by any individual holding an unexpired fortunetelling, palmistry, clairvoyancy or astrology license issued under this ordinance if an investigation of such applicant 's moral character and business responsibility j has previously been made under this section in connection with a prior application for such license under this ordinance. The j Sheriff or his deputy, shall cause the investigation herein provided for to be made within a reasonable time and shall certify to the city commission whether or not the moral character and business responsibility of the applicant is satisfactory. (D) A fortunetelling, palmistry, clairvoyancy or astrology license may be revoked by the city commission or an application for issuance or renewal of such license may be refused by the city ! commission, if they determine after notice and hearing: 1) That the applicant or license-holder is not an i individual of good moral character and business jresponsibility; or I 2) That the application of the applicnt or license-holder contains any false, fraudulent or misleading material 1 statement; i 1 -4- Ordinance No. 20-90 i J s , 3 ) That the applicant or license-holder has perpetrated a fraud upon any person whether or not such fraud was 1 perpetrated in the conduct of the business in the City j of Dania, Florida; or 4 ) That the applicant or license-holder has violated any of the statutes of the State of Florida relating to fortunetelling, palmistry, clairvoyancy or astrology; or 5) That the applicant has been convicted of any crime or misdemeanor involving moral turpitude; or 6 ) That the applicant or license-holder has conducted his or her business in the City of Dania, Florida, in an unlawful manner or in such a manner as to constitute a breach of the peace or a menace to the health, safety or general welfare of the public. (E) Notice of the hearing provided for in sub-paragraph (D) above shall be given in writing to the applicant or license-holder i as the case may be. Such notice shall be mailed, postage prepaid to the applicant or license-holder as the case may be at his last known address at least five days prior to the date set for hearing. The applicant or license-holder as the case may be shall i have the right to be represented at such hearing by counsel . j Section 3 . Judicial Remedy by Circuit Court Any person aggrieved by any decision of the city commission { may, within 30 days from the date of rendition of such decision, apply to the Circuit Court for the Seventeenth Judicial Circuit in i - i -5- Ordinance No, 20-90 s , y t and for Broward County, Florida, for a review of such decision of i the city commission, which said review shall be limited to a petition at common law for a writ of certiorari . I Section 4. License Fees . The fees for a fortunetelling, palmistry, clairvoyancy or astrology license shall be in the sum of One Thousand Dollars ($1 ,000.00 ) for each twelve month period or fraction thereof. Section 5. Bond. Every applicant for a fortunetelling, palmistry, clairvoyancy or astrology license shall file with the Clerk-Auditor of the City of Dania, Florida, a surety bond running to the City of Dania, Florida, in the amount of One Thousand Dollars with surety acceptable to and approved by the city commission conditioned that the said applicant, if issued a fortunetelling, palmistry, clairvoyancy or astrology license will comply fully with all the provisions of the ordinances of the City of Dania, Florida, and the statutes of the State of Florida and will pay all damages which may be sustained by any person by reason of any fraud, deceit, negligence or other wrongful act on the part of the licensee, his agent or employees in the conduct of the licensee 's business. A liability insurance policy issued by an insurance company authorized to do business in the State of Florida which conforms to the above requirements may be permitted by the city commission in its discretion in lieu of a bond. Section 6. Place of Conducting Activities. j No fortunetelling, palmistry, clairvoyancy or astrology I -6- I j Ordinance No. 20-90 i activities shall be conducted within any of the residential areas of the City of Dania, Florida , or other areas not zoned for such activity. Section 7. New Applications and Renewals The provisions of this ordinance shall apply to all new applicants for occupational licenses for fortunetelling, palmistry, clairvoyancy or astrology activities and for all renewals of licenses issued for fortunetelling, palmistry, clairvoyancy or astrology activities that are in effect at the time of the effective date of this ordinance. Section B . Penalties. i Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not exceeding $500 or by imprisonment in the county jail not exceeding 90 days, or by both such fine and imprisonment. Each violation shall constitute a separate offense and shall be punishable as such hereunder. Section 9. Separability If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this ordinance. Section 10 . Codification. { The provisions of this ordinance shall be included in and i I -7- i Ordinance No. 20-90 i I incorporated in the Code of Ordinances of the City of Dania , Florida, as an addition or amendment thereto, and shall be I appropriately renumbered to conform to the uniform system of the code. Section 11 . That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be repealed to the extent of such conflict. i Section 12. Sheridan Street (Publix Shopping Center) Request for a variance from the Sign Code, Section 3-33 (m) for the construction of a double sided illuminated pole sign containing 150 total square feet. I Leigh Kerr, Planning Consultant for the City, advised that BVT Institutional Investments is requesting a variance for a 150' sign where a 50' is permitted for property located in the Sand Piper Bay Shopping Center at the northwest corner of SE 5'" Avenue and Sheridan Street. The property is presently zoned C-2. i Bill Bonilla, BVT Institutional Investments, requested approval of the variance for the sign in an effort to attract more business into the shopping center. Mr. Bonilla explained his difficulty in coping with the many violations from the previous owner and expressed his intention on working with the City to resolve the problems. Mayor Mikes opened public hearing. Richard Shodrick, 410 SE 14 Street, Sandpiper Bay Townhomes, explained the ongoing problem with trucks parking in the back of the shopping center and running their refrigeration units all night. Mr. Shodrick mentioned his efforts to contact the BSO, City staff and owners of BVT in Tampa to stop the private truck owners from parking at the shopping center and disturbing area residents. Mr. Bonilla mentioned his efforts to obtain "Tow Away' signs to deter the trucks from parking. Discussion followed on the ineffectiveness of citing the vehicles with tickets when the owner is not around. Commissioner Bertino thought that once the "Tow Away" signs are posted and authorization is received from the petitioner to tow the vehicles, the problem will come to a close. John Bruckner, Meadowbrook Lakes Condominium, mentioned that he has experienced similar truck parking problems in his neighborhood and that the provisions in the noise ordinance need to be addressed to rectify the problem. Vito Mancino stated that the owner has the responsibility of stopping tresspassers from parking on his property and that this is not a City responsibility. Hearing no further comments, the Mayor closed the public hearing. Commissioner Etling suggested to include a condition to the variance that the petitioner provide authorization for the towing. He commended the petitioner for providing information from the tenants that the lack of proper signage does cause a hardship to businesses in the shopping center. Commissioner Bertino questioned the petitioner on whether he would consider completing the sidewalks for citizens to walk to the shopping center and asked for an explanation on the proposed landscaping around the sign. Mr. Bonilla agreed to install the sidewalks and presented a landscaping plan for the public to a view that will be property landscaped by an engineer. Mr. Bonilla agreed to install 10 royal palms around the perimeter of the shopping center in the middle of the swale to better the appearance. Commissioner Etling suggested an extension from the sidewalk out to the street in order for people to access the sidewalk from the east because of the drainage problem that exists on the swale. Mayor Mikes suggested to install the sidewalk up near the property line for the dryest land. City Manager Smith suggested to have the Public Works Department work with the property owner to come up with a joint resolution to the standing water problem. Vice Mayor Cali asked for a commitment from the petitioner to have "No Parking" signs erected by Friday to assist the residents of Sandpiper Bay. Mr. Bonilla agreed to the request. A motion was made by Commissioner Bertino, seconded by Commissioner Hyde, to grant the variance contingent upon: 'Tow Away" signs being constructed by Friday, the City being given permission to tow any vehicles in violations of the"Tow Away" signs, sidewalks being constructed in compliance with city staff recommendations, property landscaping being added to the sign and at least ten royal palms being added to the swale area in a radius around the shopping center. Victor Lohmann, Planning &Zoning Board, advised that one of the issues that arose with the Planning &Zoning Board was to include into the variance that the petitioner forego any additional pole signs that would meet the 50 square foot sign limitation on the property. Mr. Bonilla agreed to the commitment. Commissioner Bertino included the condition for no additional pole signs as presented to the motion. Commissioner Hyde agreed and seconded the motion.
