SPECIAL MEETING
AUGUST 16, 1999
MAYOR BERTINO CALLED THE MEETING TO ORDER AT 7.30
P.M.

Commissioner Etling, seconded by Commissioner Cali, made a
motion to excuse Vice-Mayor McElyea and Commissioner Mikes
from this meeting. The motion passed unanimously.
1. Discussion of proposed developer's agreement with Michael A.
Shiff Associates regarding Dania Beach/Gatsby Hotel.
City Manager Smith mentioned that Michael A. Shiff Associates has
submitted a proposed Developers Agreement listing possible
incentives for the City to become involved in revitalization of the
neighborhood surrounding the Dania Beach/Gatsby Hotel. Due to
the City's involvement in Main Street revitalization and grant funds
forthcoming from the ISTEA (Intermodal Surface Transportation
Efficiency Act) grant program, City Manager Smith thought that the
City Commission may want to consider moving up the City's time
table on plans for improving Dania Beach Boulevard and Federal
Highway to coincide with the hotel project.
Mr. Smith presented the City's concerns in the Developers
Agreement as follows:
✓ Purchasing Agent- It would not be legal for the City to be
purchasing agent.

✓ Fetish Box- Bruce Kodner is not interested in entertaining a
lease with the City for the property operating as the Fetish
Box, which has a 15-year lease. The only option would be
for the City to buy-out the lease.
✓ Permitting fees -The project is expected to run $75,000.00 to
$100,000.00.
✓ FPL lines— It is expected to be very costly to bury FPL
power lines. The cost would not be determined until the City
finds out what is underground.
Michael A. Shiff explained that many options were pursued on
developing the hotel site. After intense research and study, it was
determined that the best use would be to develop a Conference
Center and hotel for holding small meetings and wedding events.
There are plans to combine some of the existing rooms into suites,
renovate and upgrade the existing hotel, and apply for National
Register historical status. The hotel will be created in a Roaring
20's theme and will include over 4,000 square feet of meeting
space, a catering kitchen, a jazz/blues lounge, and 26 new rooms
on two levels. Each room will be a one-bedroom suite with a
sitting/office area. Continental breakfast will be offered in the dining
room and four spa suites will be located on the bottom floor of the
hotel. The existing liquor store will be removed and possibly
relocated on the property across the street. Internet users were
encouraged to visit the project at the website GatsbyHotel.com.
As shown on the rendering drawings, Mr. Shiff explained that the
hotel will be focused inward with a rose garden, orchid displays,
gazebo, two glass rooms overlooking the gardens for wedding
ceremonies and meetings, and an exercise room. He stated that
Dania Beach Hospitality Corporation owns the property across the
street and that the hotel site is under contract with a projected
closing date of September 1.
Mr. Shiff presented drawings showing brick pavers at the
intersection of Federal Highway and Dania Beach Boulevard, Royal
Palm trees, low planting of flowers and bushes down the center
median along Dania Beach Boulevard, and the duplication of
landscaping along the hotel property. Mr. Shiff suggested lantern
type fixtures being bolted to the light poles for an added new look
down Dania Beach Boulevard and a restriction of a right turn only at
SE 2nd Avenue (amended 8/24/99) Street with a one-way out onto
Dania Beach Boulevard. It was noted that the entry feature would
include the City's name with the hotel.

The project is expected to cost an estimated $7 million dollars. Mr.
Shiff mentioned the need for the area to be upgraded because
lending institutions are reluctant to approve financing for the project
due to the transition of the neighborhood. He stressed the need to
Provide lenders with a commitment by the City that improvements
will be made along Dania Beach Boulevard from Federal Highway
prior to receipt of grant funding and that code enforcement will be
increased for the area.
Commissioner Cali expressed his support of the Developers
Agreement without the two items concerning the Fetish Box and the
City being purchasing agent. He agreed that the City should send
a clear message to the financial community of its' commitment to
invest money to enhance the area along Dania Beach Boulevard
and Main Street.
Commissioner Etling questioned whether it was legal to return
increased property tax revenues on one property back to the Main
Street Program? City Attorney Ansbro advised that there was
another way to appropriate the funds to identify them for Main
Street. City Manager Smith agreed that a CRA (Community
Redevelopment Agency) could be created for the whole area
instead of just the Gatsby Hotel site. He advised that Broward
County is no longer an obstacle in the CRA process because they
have recently established criteria for this type of use.
Commissioner Etling clarified that the City is not restricted in over
matching the ISTEA grant funds and that there would be an
increase in property values from this development. City Manager
Smith advised that more utility and franchise revenues would be
realized because the hotel is being development entirely different
from the previous hotel, which did not include air conditioning or
telephones.
City Attorney Ansbro suggested meeting with the Florida
Department of Transportation since the proposed improvements
affect Federal Highway down Dania Beach Boulevard. He
recommended expanding the improvements further down Dania
Beach Boulevard and encouraging other businesses to get
involved. Mr. Ansbro mentioned that there might also be other
grant opportunities for additional improvement.
City Manager Smith explained that the ISTEA Grant involves the
general area of Federal Highway from the Dania Cut-off Canal to
Stirling Road and Dania Beach Boulevard from Federal Highway to
the City limits. He clarified that the ISTEA grant area might need to

be redefined and that the City is restricted from co-mingling FDOT
Highway Beautiful grant funds with ISTEA grant funds. The City is
expected to receive $164,000.00 in federal funds from the ISTEA
grant and a 100% matching funds are not required. City Manager
Smith mentioned that the Griffin Road Phase 1 project cost was
around $180,000.00 and involved the installation of Royal Palm
trees from the island at the Hilton Hotel west to Ravenswood and
all approach ramps at 1-95 as well as irrigation. One of the good
points on Dania Beach Boulevard is that irrigation is already
present. However, he mentioned that there would be limited
median opportunities due to the stacking lanes on Federal
Highway.
Commissioner Cali, seconded by Commissioner Etling, made a
motion to authorize $150,000.00 from Contingency in the
1999/2000 budget for the project infrastructure and landscaping
improvements referenced in the Developers Agreement as follows:
1. Upgrade existing Dania Beach Blvd. Medians (up to the
Penn Dutch Restaurant). Shiff landscaping contractor will supply
design and parameters. Such upgrades and plantings by the City.
Replace concrete medians from Federal Highway with planted
medians on Dania Beach Boulevard. May be a combination of
plantings and pavers.

meeting of the Commission to show commitment and strength for
the Gatsby Hotel and Conference Center project.
Mayor Bertino clarified that the Commission is also directing the
City Manager to support strict adherence to Code Enforcement
rules for the hotel area and bring the area up to compliance in a
swifter fashion than usual. City Manager Smith also agreed to
meet with lenders for Mr. Shif's project. He stated the
Commission's commitment to raising community standards through
code enforcement, recently adopted design guidelines for new
construction, and a stringent sign code that will be bringing positive
changes to the City in years to come.
Commissioner Cali stressed the need for staff members in the
Planning and Building Department, or any employees working on
the project, to understand the importance of the project to ensure
smooth completion. City Manager Smith recommended having the
City's Historical Consultant work with Michael A. Shiffs
organization on the historic designation of the hotel.
Mr. Shiff asked for clarification on whether it was the consensus of
the commission to also waive the permit fees. Commissioner Cali
urged the Commission to realize that there is no other
redevelopment project of this magnitude, which is going to reduce
the burden for police services and public safety due to the current
clientele at the hotel. City Manager Smith advised that the Building
Official estimated $75,000.00 to $100,000.00 in building inspection
and subordinate permit fees based on $11.00 per 1,000 for a $6
million dollar proposed project. Commissioner Etling pointed out
that the hotel is being renovated and that most of the impact fees
are paid so the fees should not be as high as projected.
Commissioner Etling, seconded by Commissioner Cali, made a
motion that the City will commit to items A through G in as follows:
A. Review plans and provide comments for revisions within 14
days of submittal.
B. Install period street lamps in medians and on south side of
street up to SE 3`d Avenue.
C. Create safe and attractive sidewalk path from the Gatsby to
Federal Highway. This may include pavers and plantings.

Commission generally agreed that costs running a little over the
$200,000.00 amount could be brought back to the commission.
