Home My WebLink AboutR-1999-003�, 7 l sue® j (� A r, ,Y r' RESOLUTION NO. 03-99 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE FIRST AMENDMENT TO THE 23RD YEAR FUNDING AGREEMENT BETWEEN BROWARD COUNTY AND THE CITY OF DANIA BEACH FOR SOUTHWEST IMPROVEMENTS PHASE III, UNDER COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAMS; PROVIDING FOR AN EXTENSION OF THE TERMINATION DATE OF THE AGREEMENT FROM FEBRUARY 28, 1999, TO AUGUST 31, 1999; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT ARE REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain First Amendment to the 23RD Year Funding Agreement between Broward County and the City of Dania Beach for the Southwest Improvements Phase III Project in the amount of$100,000.00, under the Community Development Block Grant Programs, in substantial form as Exhibit"A", attached, is approved and the appropriate city officials are directed to execute same. Section 2. . That the termination date of the Agreement, from February 28, 1999, to August 31, 1999, has been approved to allow additional time to advertise the project for bid and complete the construction. Section 3. . That all resolutions or parts of resolutions in conflict with this resolution are hereby repealed to the extent of such conflict. Section 4. WITNESSETH: WHEREAS, COUNTY and SUBGRANTEE entered into an agreement which was approved by COUNTY on May 6, 1998(hereinafter"Agreement"), providing for the funding and administration of Community Development Block Grant Programs; and WHEREAS, SUBGRANTEE has requested a six-month extension of the termination date of the Agreement, from February 28, 1999, to August 31, 1999, to allow additional time to advertise the project for bid and complete the construction; and f L 7 WHEREAS, an extension of the termination date is necessary and reasonable, due to reasons set forth above; NOW, THEREFORE, IN CONSIDERATION of the mutual terms, conditions, promises, and covenants hereinafter set forth, COUNTY and SUBGRANTEE hereby agree as follows: I. Article XII, "Term of Agreement," is hereby amended to read as follows: This Agreement shall commence on the date the Division Director provides a written Notice to Proceed for the Project to SUBGRANTEE and shall terminate on Fe �August 31 1999. it. Except as provided herein, all remaining terms and conditions contained in the original Agreement shall remain in full force and effect. THE AMENDMENT STIPULATES THAT THE DEADLINE FOR PROJECT COMPLETION BE CHANGED FROM FEBRUARY 28, 1999 TO AUGUST 31, 1999. THIS WOULD ALLOW THE CITY TO INCUR COSTS FOR WORK DONE ON THE PROJECT AND BE REIMBURSED BY THE COUNTY UP TO $100,000 FOR ENGINERRING AND CONTRACTUAL SERVICES FOR AN EXTRA SIX MONTHS. AN EXTENSION OF TIME BECAME NECESSARY BECAUSE THE FUNDING AGREEMENT FOR THIS PROJECT WAS SENT TO THE CITY BY THE COUNTY OVER TWO MONTHS LATE. THEREFORE, STAFF COULD NOT PROCEED WITH THE PROJECT ON TIME.
