RESOLUTION NO. 25-99
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
APPROVING THE SITE PLAN REQUEST SUBMITTED BY
CHARLES M. KELSEY III, VICE PRESIDENT OF PORT 5,
LTD., FOR PROPERTY WHICH IS LOCATED TO THE
SOUTH OF 2150 NE 7T" AVENUE, ALSO KNOWN AS
PARCEL "B" OF THE "NISA PLAT', DANIA BEACH,
FLORIDA; PROVIDING THAT ALL RESOLUTIONS OR
PARTS OF RESOLUTIONS IN CONFLICT WITH THIS
RESOLUTION ARE REPEALED TO THE EXTENT OF SUCH
CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Charles M. Kelsey, III, Vice-President of Port 5, Ltd., as property
owner, has applied for site plan approval for property which is located to south of 2150 NE
7t'Avenue, also known as Parcel "B" of the "Nisa Plat", Dania Beach, Florida; and
WHEREAS, the Planning &Zoning Board on January 20, 1999, recommended that
the City Commission grant the site plan request (SP-06-99), based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:

Section 1. That that certain application (SP-06-99) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A" is approved and the
appropriate city officials are directed to execute same.
Section 2. That based upon criteria set forth in Section 8-4(p) of Article 1 of Chapter
8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall
automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution;
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon
its passage and adoption.

MEMORANDUM

RE: Sp-06-99 Port 5 Ltd. Site Plan
Date: February 3, 1999
This proposed project would see 71,885 square feet of warehouse on a site of
188,863 square feet. The site is located on east side of NE 7'h Avenue just north of Taylor
Road. The project generally complies with the requirements of the City's Code. The only
exception is the area intended for truck use in the interior court area of the building.
The City's landscape requirements call for the landscaping of all vehicle use areas.
This interior court area will be utilized by semi-trailer truck traffic. Due to the nature of this
traffic and the space that they will be operating, landscaping of this space would not serve
any apparent purpose. If it was provided it could quickly be destroyed by the traffic it was
designed to serve. The applicant has exceeded the code requirements for overall
landscaping but has placed the materials that would normally have been found in this
vehicle use area in other parts of the site. In essence the requirements have been met, it is
only the physical location that has been varied.
RECOMMENDATION
Staff recommended that this request should be approved. The Planning and Zoning
Board concurs and recommends that the City Commission act favorably on this request.
