RESOLUTION NO. 26 -99
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
APPROVING THE SITE PLAN SUBMITTED BY DISMAS
CHARITIES, INC. FOR PROPERTY LOCATED AT 141 NW
1ST AVENUE, DANIA BEACH, AKA/HOTEL POINCIANA;
PROVIDING THAT ALL RESOLUTIONS OR PARTS OF
RESOLUTIONS IN CONFLICT WITH THIS RESOLUTION
ARE REPEALED TO THE EXTENT OF SUCH CONFLICT;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Fforida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Dismas Charities, Inc., has applied for site plan approval for
renovations to property located at 141 NW 1s' Avenue, Dania Beach, AKA/ Hotel
Poinciana; and
WHEREAS, the Growth Management Director, Terry L. Virta, AICP, has
recommended that the City Commission grant the site plan request based upon the criteria
set forth in section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of
Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That certain building permit application (Dismas Charities, Inc. ), a copy
of which is attached and made a part of this Resolution as Exhibit "A", is approved.
Section 2. That based upon criteria set forth in Section 8-4(p)of Article 1 of Chapter
8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall
automatically expire and become null and void unless building permits are obtained

on or before 18 months from the date of this resolution;
Section 3. That all resolutions or parts of resolutions in conflict with this resolution

are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon
its passage and adoption.

RE: Dismas Charities Site Plan
Date: January 21, 1999
You are being asked to review the Site Plan for the Dismas Charities site in
downtown. The City commission may recall that they had submitted the site plan in
conjunction with their attempt to restructure the Zoning Ordinance so their use would
have been allowed as a Special Exception. As a result of the lawsuit they have been
issued a building permit and are proceeding with their renovations.
At no time did they get or did they seek site plan approval for their project. The
Court did not address this issue during the trial nor in it's ruling. Therefor the question
of site plan approval remains open. The Planning and Zoning Board reviewed the site
plan when they reviewed the proposed Zoning Ordinance amendment. The plan that
Dismas has submitted exceeds the minimum standards of the City Code for
landscaping. It is recommended that the City Commission approve the site plan as
submitted.
