HomeMy WebLinkAboutR-1999-044 1 11 �l M �� 1 r 7 RESOLUTION NO. 44-99 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY DCOTA DEVELOPMENT CO., LTD., PTR, FOR PROPERTY LOCATED ON PROPERTY COMMONLY KNOWN AS DESIGN CENTER OF THE AMERICAS PLAT, PB 119 PG 32, PARCEL 'A'; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT WITH THIS RESOLUTION ARE REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS DCOTA Development Co., Ltd., Ptr., has applied for site plan approval for Phase 3 of the DCOTA Development, located to the south of the existing DCOTA development at 1855 Griffin Rd., Dania Beach; and WHEREAS, the Planning & Zoning Board on February 17,1999, recommended that the City Commission grant the site plan request (SP-05-99), based upon the criteria set forth in section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-05-99)for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A" is approved and the appropriate city officials are directed to execute same. 1 RESOLUTION NO. 44-99 f H r 7 I Section 2. That petitioner, DCOTA Development Co., Ltd., Ptr, agrees to instruct their landscape architect to work with the landscape architect provided under the City's grant program with the Florida Department of Transportation to ensure continuity in landscaping for the project. Section 3. That based upon criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution; Section 4. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 5. That this resolution shall be in force and take effect immediately upon its passage and adoption. Virta, AICP Growth Management Director RE: SP-05-99 DCOTA Phase Ili Site Plan VC-12-99 Vacation Request for a Portion of NW 2"d Street Date: March 18, 1999 The DCOTA has submitted a site plan, which if approved, would allow them to construct a third building in their complex. It is similar to the two existing structures and would be constructed immediately to the south of what is there presently. This structure, as well as a fourth building, was approved as a part of this project when it was undergoing review as a project of regional Impact. Staff when it prepared its report to the Planning and Zoning Board noted a couple of areas of concern. The landscaping had not been provided as required along the property's boundary with Interstate 1-95. The landscape requirements require a tree every 40 feet as well as a hedge along this roadway. These materials are not indicated on the planting plan. The plans also show an electronic message board on the western elevation of the building. The City's sign code will not allow the placement of such a sign in this location. The plans will have to be modified to reflect compliance with the City's new sign regulations. The Fire Marshall had the following comments regarding this project: 1. Canopy on the east entry of DCOTA 3 must have a vertical clearance of 14 feet. 2. Demonstrate at a minimum that there will be 22 feet of inside turning radius and 50 feet of outside turning radius for fire access on all three sides of the building. 3. West side does not meet requirements of SFBC 5211.2 (g) (2) (dd) for maximum edge of roadway being no further than 30 feet from the building as the parking spaces interfere with this requirement. The DCOTA has also requested that the City vacate a portion of NW 2Id Street which runs along the southern boundary of their project site. When the original cmmemos 599da f r r 'I Development Order was approved for the DCOTA it contained a requirement that they provide an access to the site along their southern boundary. Subsequent amendments to the Development Order have removed that requirement. Therefor the original purpose of providing this right of way no longer exists. The DCOTA would like to incorporate the land area of this dedication to their site. RECOMMENDATION The Planning and Zoning Board recommends to the City Commission that they approve this proposed site plan. Any approval should be conditioned upon the site plan being modified to meet all of the concerns raised by the staff analysis. The applicant indicated that he would have no problem meeting these requirements and would be willing to do so.
