RESOLUTION NO. 66-99
A RESOLUTION APPROVING VARIANCE REQUESTS BY JOHN
GLARENTZOS, OWNER OF PROPERTY COMMONLY KNOWN AS JOHN'S
AMOCO GAS STATION, FROM CHAPTER 26 VEGETATION, ARTICLE IV,
SECTION 26-50(a)&(b); CHAPTER 28 ZONING, ARTICLE 4.202, SCHEDULE
OF LOT, YARD AND BULK REGULATIONS; CHAPTER 28 ZONING,ARTICLE
6.24 SERVICE STATIONS; CHAPTER 28 ZONING, ARTICLE 6.63 SERVICE
STATIONS,SECTIONS(1)(a)APPLICABILITY,(5)(a)AND(5)(b)SIGNAGE AND
LIGHTING, FOR PROPERTY LOCATED AT 1554 SOUTH FEDERAL HWY.,
DANIA BEACH; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF
RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF
SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances: Chapter 26 Vegetation, Article IV,
Section 26-50 (a)&(b) sets the buffering requirements for commercial uses that abut residentially
zoned districts; Chapter 28 Zoning, Article 4.202. Schedule of lot, yard and bulk regulations sets
the set back requirements for the C-3 zoning district; Chapter 28 Zoning, Article 6.24 Service
Stations sets the separation requirements for service stations from residentially zoned districts;
Chapter 28 Zoning, Article 6.63 Service Stations, Section (1)(a) Applicability, states that all
renovations in excess of$5,000 must adhere to the design criteria for gasoline stations; and Article
6.63 Service Stations Section(5)(a) and (5)(b)Signage and Lighting, sets requirements for signage
and roof design; and
WHEREAS, John Glarentzos, owner of property commonly known as John's Amoco,
located at 1554 South Federal Hwy., Dania Beach, has applied for a variances (VA-63-98) which
would:
1) Grant the petitioner a variance from the required buffering regulations; and
2) Allow the building and canopies of the proposed service station to be built using less than
the 10' setback requirement; and
3) Allow the petitioner the continued use of the gasoline service station within 350 yards of a
residential district; and
4) Allow the petitioner to keep the existing pole sign on the site and to construct illuminated
pump island canopies with striping as per Amoco Standards and use of flat style roofs; and
WHEREAS, the Planning &Zoning Board on December 16, 1998, recommended that the
City Commission grant variance request VA-63-98 based upon the criteria set forth in section
I RESOLUTION NO. 66-99

10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-63-98, for variances from Chapter 26
Vegetation, Article IV, Section 26-50 (a)& (b); Chapter 28 Zoning, Article 4.202, Schedule of Lot,
Yard and Bulk Regulations; Chapter 28 Zoning, Article 6.24 Service Stations; Chapter 28 Zoning,
Article 6,63 Service Stations, Sections (1)(a)Applicability, (5)(a) and (5)(b) Signage and Lighting
of the Dania Beach Code of Ordinances, a copy of which is attached hereto and made a part
hereof as Exhibit "A" be and the same is hereby approved, and the appropriate city officials are
hereby directed to execute same.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in farce and take effect immediately upon its
passage and adoption.

2. Provide evidence that the special conditions and circumstances

The property was developed for this use a the tanks d pumps
installed prior to this applicant obtaining ownership.
3. Describe how granting the requested variance(s) will not confer
any special privilege on the applicant that is denied by the
zoning code to other lands, buildings or structures in this .same
zoning district.
This application will allow the current owner to continue the carrel
operation of this gasoline service station.
4. Provide evidence that the literal interpretaion of the provisions
of the zoning code would deprive the applicant of rights commonly
enjoyed by other properties in the same zoning district and would
work unnecessary and undue hardship on the applicant.
The applicant is reauired by the Amoco to meet brand requirements
Ingrder to continue operation as "Amoco"
5. Describe how the requested variance is the minimum variance that
will make possible the reasonable use of the land, building or
structure.
The requested variance will allow proper vehicular circulation for
proposed building use.
6. Explain how the grant of the variance(s) will be in harmony with
the general intent and purpose of the zoning code, ,and that such
variance(s) will not he injurious to the area involved or other-
wise detrimental to the public welfare.
The applicant is proposing to update & enhance the exsiting facilit•
The overall appearance will be greatly improved . Landscape will
be increased significantly. The facility will provide a more
