HomeMy WebLinkAboutR-1999-091 4 �- pr r y RESOLUTION NO. 91-99 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY TONY ALIAGA, ALIAGA ENTERPRISES, INC., FOR PROPERTY LOCATED AT 2180 SW 38T" STREET; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT WITH THIS RESOLUTION ARE REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Tony Aliaga, owner of Aliaga Enterprises, Inc. /European Auto Service Inc., has applied for site plan approval for the proposed construction of an auto body shop, office and storage facility, and European auto body shop for property located at 2180 SW 38" Street; and WHEREAS, the Planning &Zoning Board on April 21, 1999, recommended that the City Commission grant the site plan request (SP-27-99), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-27-99)for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A" is approved and it is further noted that the original Site Plan is maintained in the office of the Growth Management Department of the City of Dania Beach. 1 RESOLUTION NO. 91-99 r r 7 Section 2. That petitioner, Tony Aliaga, owner of Aliaga Enterprises, Inc./European Auto Service, Inc., agrees to the condition that two (2) Mahogany trees be substituted for two (2) Yellow Tab trees as indicated on the Site Plan (SP-27-99). Section 3. That based upon criteria set forth in Section 84(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 4. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 5. Virta, AICP Growth Management Director RE: SP-27-99 European Auto Date: May 4, 1999 The site of these requests is zoned industrial but until recently a single-family residence occupied it. The site is heavily wooded containing many mature oak trees. The applicant prior to developing a site plan for the project consulted with the City's Tree Consultant, Bill Tesauro, on maintaining the existing vegetation. The site plan that is included with this petition reflects the results of those preservation efforts. The landscape requirements for the City require a buffer strip to be placed around the perimeter of the property. At the same time the zoning regulations allow for a zero setback from the property lines on the rear and side yards. The applicant is requesting that he be allowed to use the zero setback provisions in order to maximize the use of his site. At the same time the building placement will allow him to preserve the existing mature oak trees. Staff believes that the applicant is attempting to meet the spirit of the City's development codes and obtain the best usage of his site. The applicant is also requesting that he be allowed to provide 16 parking spaces when 17 are required by the ordinance. Again this request is made so that the site plan will allow for the preservation of existing vegetation. RECOMMENDATION The Planning and Zoning Board recommends that the City Commission approve this site plan request. Staff supports this recommendation. mmemova6Wd= f A i�
