RESOLUTION NO. 93-99
A RESOLUTION APPROVING THE VARIANCE REQUEST BY CARMELA ZITO,
FROM CHAPTER 28, ZONING, ARTICLE 4, DISTRICT REGULATIONS,
SCHEDULE OF LOT, YARD AND BULK REGULATIONS FOR THE RS-6000
ZONING DISTRICT, FOR PROPERTY LOCATED AT 845 NW 10T"AVE., DANIA
BEACH; PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS
IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH
CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances Chapter 28 Zoning, Article 4, District
Regulations, Schedule of Lot, Yard and Bulk Regulations sets the set back requirements for the
RS-6000 zoning district; and
WHEREAS, Carmela Zito, 845 NW 10"Ave., Dania Beach, has applied for a variance (VA-
16-99) to allow a shed to be placed on an existing slab which is 6.9 feet from the rear, where 15
feet are required and 4 feet from the south side, where 7 feet are required; and
WHEREAS, the Planning &Zoning Board on April 21, 1999, recommended that the City
Commission grant variance request VA-16-99 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-16-99, for variances from Chapter 28 Zoning,
Article 4, District Regulations, Schedule of Lot, Yard and Bulk Regulations of the Dania Beach
Code of Ordinances, a copy of which is attached hereto and made a part hereof as Exhibit"A" be
and the same is hereby approved, and the appropriate city officials are hereby directed to execute
same.
Section 2. That petitioner, Carmela M. Zito, agrees to add shrubbery around at least 50%
of the shed structure to hide the view from the roadway as a condition to the variance approval.
Section 3 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.

Beach Blvd., Dania Beach, Florida between the hours of 8:00 a.m. and 4:00 p.m., Monday - Friday. Interested
parties may appear at the public hearing and be heard with respect to the proposed petition.

MEMORANDUM

RE: VA-16-99 Variance Request—Carmela Zito
Date: May 4, 1999
The applicant purchased a home that had a storage shed on a slab in the rear
yard. The shed was in disrepair so the applicant sought to replace it. However, the
location of the slab does not meet the setback requirements for the district. A variance
of 8.1 feet is needed for the rear yard and 3 feet for the side yard if the shed is to remain
in the original position.
To relocate the shed on the property would require the removal of mature
vegetation from the yard. The applicant is not responsible for the present location and
is attempting to improve the situation. In addition the rear yard area is very small so
that relocating the structure would lessen the functionality of the usable space.
RECOMMENDATION
Staff believes that the applicant meets the tests necessary to consider a
variance. The Planning and Zoning Board recommends that the City Commission
approve this petition.
