RESOLUTION NO. 95.99
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
ACCEPTING LAND TO BE CONVEYED TO THE CITY BY A RIGHT-OF-
WAY DEED, SUCH LAND TO ASSIST IN THE PROVIDING OF ACCESS
TO THE TRI-RAIL PARKING LOT IN CONJUNCTION WITH THE
SPORTSMAN'S PARK DEVELOPMENT AND THE BASS PRO SHOPS
OUTDOOR WORLD DEVELOPMENT; PROVIDING THAT ALL
RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT WITH
THIS RESOLUTION ARE REPEALED TO THE EXTENT OF SUCH
CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That the land to be conveyed to the City by a Right-of-Way Deed, which will
assist in the providing of access to the Tri-Rail parking lot in conjunction with the Sportsman's
Park development and the Bass Pro Shops Outdoor World development, a copy of which Deed
is attached and identified as Exhibit "A", is accepted, subject to and upon final review of all
documentation by the city manager and city attorney.
Section 2. That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

RIGHT OF WAY DEED
THIS INDENTURE made the 36 day of April, 1999, by SPORTSMAN PARK
DEVELOPMENT COMPANY, a Florida corporation, f/k/a The Coonas Company, a Florida
Corporation, hereinafter called the Grantor, whose address is 1500 North Federal Highway, Suite
200, Fort Lauderdale,Florida 33306 to THE CITY OF DANIA BEACH, a municipal corporation
of the State of Florida, whose post office address is 100 West Dania Beach Boulevard, Dania Beach,
Florida 33004, hereinafter called the Grantee:
(Wherever used herein the terms "grantor"or "grantee"include
all the parties to this instrument and the heirs,legal representatives
and assigns of individuals, and the successors and assigns of
corporations)
WITNESSETH: That the Grantor, for and in consideration of the sum of$10.00 and
other valuable considerations, receipt whereof is hereby acknowledged,hereby grants, bargains, sells,
aliens, remises, releases, conveys and confirms unto the Grantee, all that certain land situate in
Broward County, Florida, viz:
SEE EXHIBIT "A" ATTACHED HERETO
TOGETHER, with all the tenements, hereditaments and appurtenances thereto belonging
or in anywise appertaining.
TO HAVEAND TO HOLD, the same in fee simple forever.
AND the Grantor hereby covenants with said Grantee that the Grantor is lawfully seized of
said land in fee simple; that the Grantor has good right and lawful authority to sell and convey said
land, and hereby warrants the title to said land and will defend the same against the lawful claims of
all persons claiming by, through or under the said Grantor.

FURTHERMORE, it is the intention of the Grantor by this Instrument to convey to the
Grantee, and its successors in interest, the land above described for use as a public roadway and for
all purposes incidental thereto. It is also expressly provided that if and when said roadway shall be
lawfully and permanently discontinued, the title to the said above described land shall immediately
revert to the Grantor, its successors and assigns, and it or they shall have the right to immediately
repossess the same.
IN WITNESS WHEREOF, the said Grantor has hereunto set its hand and seal the day
and year first above written.

Dear Mike:
Enclosed for approval and acceptance by the City of Dania Be:,h is a Right of Way Deed. This
portion of the access road completes the prior conveyance to the City by FDOT for the access road East of
the CSX railroad. The purpose of die City road is to ensure public access to the Tri-Rail parking lot. I have
enclosed a key map and site plan detailing the location of this property.
Please schedule this item for approval at the earliest possi le City Commission hearing. Thank you
for your cooperation in this regard.
