RESOLUTION NO. 106-99
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA, RELATING TO
ZONING IN PROGRESS; DECLARING THAT THE CITY IS
CONSIDERING THE ADOPTION OF ZONING
REGULATIONS PRESCRIBING PERVIOUS AND
IMPERVIOUS LAND AREA RATIOS OR SIMILAR
REGULATIONS TO ALLOW FOR THE EFFECTIVE
DRAINAGE OF STORMWATER; PROVIDING THAT ALL
RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT ARE REPEALED TO THE EXTENT OF SUCH
CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Dania Beach believes that
specific regulations which prescribe pervious and impervious land area ratios to allow
for the effective drainage of stormwater or similar regulations designed to accomplish
that objective would be in the best interests of the City; and
WHEREAS, such regulations would be of benefit to both the environment and the
residents of the City of Dania Beach since they are expected to result in the
preservation of green space and to provide a more effective drainage system for the
City; and
WHEREAS, the Commission wishes to place all parties on notice that it is
considering such regulations and that all parties who contemplate construction activities
in the City will be obligated to comply with the provisions of such ordinance;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the City Commission of the City of Dania Beach declares that it is
processing an ordinance, which will be an amendment to the water and sewer
ordinances of the City of Dania Beach, which will prescribe pervious and impervious
land area ratios or similar regulations to allow for the effective drainage of stormwater
within the City and that all parties seeking to commence construction activities within the
City shall be subject to the regulations adopted by the City Commission, provided such
regulations are adopted within the next one hundred twenty (120) days.
Section 2. That all property owners are placed on notice that any application for a
development permit or any construction activity involving lot coverage shall be subject

to review pursuant to the requirements of the ordinance in progress pertaining to
stormwater and any such permit or activity must be consistent with the terms of Such
ordinance.
Section 3. That the adoption of this Resolution shall be evidenced by placement in a
newspaper of general circulation within the City in a one-eighth page advertisement on
two occasions within two weeks after adoption of this Resolution. A copy of this
Resolution shall also be posted in the Growth Management Department of the City for
the next one hundred twenty (120) days.
Section 4. That all resolutions or parts of resolutions in conflict are repealed to the
extent of such conflict.
Section 5. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

DECLARING THAT THE CITY IS CONSIDERING THE
ADOPTION OF ZONING REGULATIONS PRESCRIBING
PERVIOUS AND IMPERVIOUS LAND AREA RATIOS OR
SIMILAR REGULATIONS TO ALLOW FOR THE
EFFECTIVE DRAINAGE OF STORMWATER; PROVIDING
THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS

The attached public notice has been advertised in the Miami Herald, Broward Local Section, as
a display ad on June 1o1h and June 17v, 1999. Section 3 indicates that your department must
post this resolution for 120 days.
