RESOLUTION NO. 112-99
A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY MICHAEL MORRISON, OWNER OF
MORRISON BUILDERS, INC., FOR PROPERTY LOCATED
AT 2765 SW 36T" STREET (COLLINS RD), DANIA BEACH,
FLORIDA; PROVIDING THAT ALL RESOLUTIONS OR
PARTS OF RESOLUTIONS IN CONFLICT WITH THIS
RESOLUTION ARE REPEALED TO THE EXTENT OF SUCH
CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Michael Morrison, owner of Morrison Builders, Inc., has applied for site
plan approval for the proposed renovation/construction of an existing residential structure
into an office building, for property located at 2765 SW 361h Street (Collins Rd.); and
WHEREAS, the Planning &Zoning Board on May 19, 1999, recommended that the
City Commission grant the site plan request (SP-38-99), based upon the criteria set forth
in Section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-38-99) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit"A" is approved and it is
further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.

Section 2. That based upon criteria set forth in Section 8-4(p) of Article 1 of Chapter
8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall
automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon
its passage and adoption.

RE: SP-38-99 Michael Morrison—Morrison Builders
Date: June 1, 1999
The applicant is requesting site plan approval for a portion of the property owned
by Morrison Builders Inc. It is located on the north site of SW 36 Street (Collins Road)
and west of SW 26 Terrace. The entire site contains approximately 1.86 acres and is
zoned M-1. The City of Dania Beach land use plan (proposed) and the County Land
Use Plan designate this property for industrial use. Morrison Builders, Inc. builds
fences and decks and property will be used as the company's office. The proposed
use is consistent with the current zoning and land use plan designation on the property.
The site plan provides for pervious area in excess of 50%.
The City Commission approved a plat for the subject property earlier this year. The plat
has not yet been recorded. The site plan is generally consistent with the plat approval.
Staff recommends approval of the site plan subject to the following:
1. The plat must be recorded prior to the issuance of a certificate of
occupancy. The Applicant has agreed that this will be done.
2. A lighting plan must be submitted and approved prior to the
issuance of a building permit. The applicants building plans provide
for exterior lighting.
3. The site plan must be revised prior to City Commission approval to
reflect a sidewalk adjacent to the parcel along Collins Road as
required by Sec 22-21. The applicant has agreed to construct a
sidewalk along the front of his property.
4. The site plan must be revised prior to City Commission approval to
reflect a 10' terminal island on the east side of the parking located
north of the building. This may require minor adjustments to the
location of the dumpster. The Applicant has arranged for these
changes through notations to the site plan. The Fire Dept must
review fire truck access.
5. Dumpster detail must meet code. The applicant has agreed to
construct the dumpster enclosure to the City standard.

RECOMMENDATION
The Planning and Zoning Board recommends that you approve this site plan
subject to the concerns raised by staff. The applicant has agreed reviewed the several
comments and has agreed to address all of them as noted earlier in this report.

Dear Mr. Virta:
Thank you very much for taking the time to meet with me last Friday to address the items
from the Planning&Zoning meeting. As you requested,I will address each of the items
in this letter with respect to what you and I agreed upon at our meeting.
1. It is agreed that the plat must be recorded prior to a C.O. being issued. Mr.
Javier De La Rocha at Stoner and Associates stated to me today that we are
scheduled for June 15, 1999 before the County Commissioners for approval of the
plat with approximately two(2)weeks for recording to follow.
2. Lighting plan: As per the submitted plans we have sufficient lighting via four
(4)fight packs mounted onto the comer of the building facing both the front and
rear parking lots. The lights are sodium vapor high output 150 watt.
3. Sidewalk: It is agreed that we will install a 4' wide and 125' long sidewalk
along Collins Road.
4. Terminal Island:Agreed that a 10'terminal island will be installed not 5' as
shown on plans. Also it is noted and agreed that a 5' sod area will exist between
the handicap parking space and building.
5. Fire Department: Has reviewed and approved the plans.
6. Dumpster detail is per city code,CBS structure with steel frame gates on the
front.
7. The Royal Poinciana tree in question to be relocated is not on my property,it
belongs to the east side neighbor.
