RESOLUTION NO. 124-99
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
APPROVING THE SITE PLAN REQUEST SUBMITTED BY
CLIFF BERRY, INC., FOR PROPERTY COMMONLY KNOWN
AS PARCEL 'A', CBI PLAT NO. 2, LOCATED AT 851 ELLER
DRIVE, DANIA BEACH FL; PROVIDING THAT ALL
RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT WITH THIS RESOLUTION ARE REPEALED TO
THE EXTENT OF SUCH CONFLICT; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Cliff Berry, owner of property commonly known as Parcel 'A', CBI Plat
No. 2, has applied for site plan approval for a oil waste transfer facility and truck repair
shop located at 851 Eller Drive, Dania Beach; and
WHEREAS, the Planning & Zoning Board on December 16, 1998, recommended
that the City Commission grant the site plan request (SP-55-98), based upon the criteria
set forth in Section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of
Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-55-98)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A" is approved with the
following condition:

a) The petitioner, Cliff Berry, owner of property commonly known as
Parcel W, CBI Plat No. 2, agrees that the City of Dania Beach has the right, at any time
and at its own discretion and cost, to inspect the use, process and materials of the oil
waste transfer facility.
Section 2. That based upon criteria set forth in Section 8.4(p) of Article 1 of Chapter
8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall
automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon
its passage and adoption.

Dear Bill,
Thank you for the opportunity to review the proposed site plan for the new CBI transfer station
facility. As you know, I researched the applicable codes in some detail. NFPA 30 and the South
Florida Building Code address the subject of above ground storage tanks in Port Everglades. I
have reviewed Exhibit A and Exhibit B and Find both of them in compliance with the applicable
codes, however, final approval rests with the City of Dania Beach. Your site plan appears to
comply with the general requirements of the Broward County Land Development Code for
adequacy of fire protection as well.

Re: SR55-98-Proposed Site Plan "Cliff Berry, Inc. (CBI)" Transfer Facility
Dear Mr. Virta:
In accordance with Section 3.7 of the Interlocal Agreement dated May 6, 1994 between the Broward County
and the Cities of Dania, Hollywood and Fort Lauderdale, planning and zoning services within the Port continue
to be provided by the respective jurisdiction. All building permits and certificates of occupancy for
construction within the municipal boundaries of Dania shall be applied for and issued by Dania and all fees for
same shall be retained by Dania pursuant to its ordinances and regulations. In addition, all permits form the
Broward County Department of Natural Resources and the any other environmental governmental agency
having jurisdiction shall be obtained prior to the issuance of a Certificate of Occupancy.
Port Everglades' staff have reviewed the subject site plan and found it generally consistent with the Port
Everglades Master Plan. It is expected that the Project's drainage will be retained on-site in accordance with
all applicable permitting agencies. It is also expected that disposal of the generated hazardous materials, as
well as sanitary sewage,will not be discharged into the Port Everglades Sanitary Sewage System. Any traffic
impacts resulting from this Project shall be mitigated by the applicant in accordance with the standards
specified within the Broward County Land Development Code.

1 have had the opportunity to review the above referenced site plan on several occasions,the first
being on 4/24/95 when I was with the Broward County Fire Marshal's Office. Although the use
of the project has changed significantly,as well as the jurisdiction, the adequacy of fire
protection requirements remains substantially the same. My comments for the proposed project
are as follows:
1. In compliance with the Broward County Land Development Code and Port
Everglades minimum requirements, fire hydrants are to be installed on a minimum 10" water
main at intervals not to exceed 250'. The hydrants are to be capable of delivering the required
fire flows with a minimum of 20 psi residual pressure. This project will require a minimum of
four fire hydrants. Note: both fire hydrants are shown on a dead-end water main,the
northernmost being installed on a 6" water main. The water main must be looped and fed from
two directions to provide the minimum required fire flows at the minimum required 20 psi
residual pressure.
2. Fire Department Access: Chapter 52 of the South Florida Building Code, Section
5211.2(g)(ee) requires that dead end roads exceeding 300' have a minimum turning area of 100'
in diameter at the closed end. The site plan shows a turning diameter of 52'.
3. SFBC, Section 5211.2(g)and the Land Development Code require access to all
elevations of a building, when possible. This office will require an emergency fire lane to the
rear of the buildings and storage tank. The emergency lane is required to be a minimum of 20' in
width and stabilized to accommodate a 32 ton vehicle. The lane shall be marked in accordance
with the SFBC.

The applicant has submitted a request to rezone to PEDD and a site plan
application for an oil recovery/recycle facility in the Port Everglades area. It has been
described as a transfer station. What has been explained to staff is that the company
collects material from oil spills and returns it to the site where water is removed and all
of the material is then sent on to other sites.
This site is similar to the Travel Ways location in that it was included as a portion
of the 1996 Annexation. As such it still retains and enjoys the County M-3 Zoning
designation. The County M-4 Zoning has Oil Recovery listed as a permitted use. There
is not a similar designation contained within the listing for M-3.
The City when it adopted the PEDD zoning designation agreed to rezone all of
the property that was within the City as well as within the Port to PEDD. The applicant
is requesting that his property be rezoned in advance of those other properties that will
ultimately be included within this designation. The PEDD District includes petroleum
processing, transmission and storage as a permitted use. This use would seem to
include the petroleum salvage activities, separating oil from water, conducted by the
applicant.
The site plan meets all requirements of the City Code. It should be noted that if
the property is zoned to PEDD they would technically be exempt from the City's site
plan process as well as having to comply with the City's landscape code. The applicant
is not seeking such an exemption.
RECOMMENDATION
The Planning and Zoning commission recommends that the rezoning from M-3 to
PEDD be approved on Second Reading. It is further recommended that the City
Commission approve the site plan as submitted.

RE: SP-44-99 Michael Mogerman /Festival Fun Parks
Date: June 1, 1999
Festival Fun Parks has requested a number of additional uses in the recent past.
The western portions of their site are proposed to be a family water theme park. The
applicant is, however, requesting that they be permitted to utilize the most western
portions of the site for a temporary dirt track. The applicant wishes to construct a facility
that can be traversed by small four-wheel off road vehicles.
The applicant has indicated a general area for the dirt track facility as well as an
area designated as temporary parking. They have not provided any detail as to how the
site will actually be developed or how the temporary parking will be developed. With no
detail to review, staff has been unable to comment on these aspects of the proposal.
RECOMMENDATION
Staff does not find the concept of this particular amusement to be objectionable.
It is not possible, however, to offer any specific review or comment due to the lack of
detail in the submittal. The Planning and Zoning Board after considering this matter
recommend that the City Commission approve this request.

SA-1 Stabilizer has been the tried and true friend of the asphalt paver since 1973. This
revolutionary product has saved both time and money over the last 24 years saving our
precious national resources. SA-1 Stabilizer provides for the use of a wider variety of
aggregate sizes,the use of fines,lower temperatures,manageable water contents and
lower pH levels while delivering a superior product to the public which lasts longer, can
be repaired easier and costs less than conventionally laid asphalt products.According
to Robert Erdman P.E. Materials Engineer and Kent Hamm P.E. Assistant County
Engineer(Maricopa County Department of Transportation, Phoenix, Arizona) the use
of SA-1 Stabilizer in the preparation of road construction and repair has saved the tax
payers between 50%and 75% per mile in labor and material costs. Approximately 100
gallons of stabilizer, at a cost of approximately$5000, are required to treat a roadbed
28 feet wide one mile long. The Maricopa County Department of Transportation has
been using SA-1 Stabilizer for ten years with great results.
Asphaltic construction compositions have three basic functions:
1. Bonds the aggregate together.
2. Coats the particles of aggregate to decrease plasticity quotients and eliminate
sub-base skidding.
3. Seal the spaces, or voids, so the surface is impermeable too almost
Impermeable to water.
SA-1 Stabilizer creates a better bond at the points of contact between aggregate
particles than do asphaltic compositions with 10% to 40% higher asphalt content.
Asphaltic compositions void of the SA-1 Stabilizing solution require between 10%and
40% more oils and asphalt to achieve the above-mentioned functions. Heavy
mechanical traffic consisting of tens of thousands of pounds of cars and trucks every
day set up vibration and wear factors that send the smaller aggregates (sand) to the

Following are a few specifications and applications:
SA-1 Stabilizer addresses the vexing E.P.A. problem of what to do with the old
distressed asphalt that is broken up and hauled away before laying down the new
asphalt roadway. The SA-1 Stabilizer used properly will allow the contractor to reuse
the old asphalt as either a bonded sub-base material, the base ready for chip sealing
and slurry sealing or as the new riding surface itself without having to haul it away to
a batch site and haul it back again to the roadway site. The resulting base is superior
to ordinary aggregate bases because of its bituminous content, moisture stability and
1600 psi crush strength. Lay down a solution of SA-1 Stabilizer and water on about a
half a mile of old distressed road surface and let it sit for several hours. Then rip it
down about six to eight inches and spray is again as you work it with a pulvamixer.
Spray it once again as you mix it with a road grader and throughly mix with water and
SA-1 Stabilizer to get the moisture content to about 20%. Crown it and roll with,
preferably with a rubber tire roller, flat in one inch lifts. Blade it once again if needed
and roll with a steel roller and you are done. Let it sit over night and chip or slurry seal
the next morning, for best results chip it again in thirty days.
