AN ORDINANCE AMENDING THE FUTURE LAND USE PLAN
ELEMENT OF THE LOCAL COMPREHENSIVE PLAN OF THE
CITY OF DANIA BEACH, FLORIDA, TO REDESIGNATE FROM
COMMERCIAL TO RESIDENTIAL MEDIUM HIGH (25) A PARCEL
OF LAND CONTAINING 9.913 ACRES MORE OR LESS
LOCATED ON THE NORTH SIDE OF SHERIDAN STREET
APPROXIMATELY 691 FEET WEST OF S.E. 5T"AVENUE IN THE
CITY OF DANIA BEACH CONTAINING THE FOLLOWING
DESCRIBED:ALL OF TRACT 'A" OF SWEDE LAND,
ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT
BOOK 148, PAGE 14, OF THE PUBLIC RECORDS OF
BROWARD COUNTY, FLORIDA; IN ORDER TO ALLOCATE 250
FLEX UNITS; PROVIDING THAT ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE ARE
REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Trafalgar Associates has made an application to amend the
local future land use plan and has requested that Dania Beach allocate 240 flex
units for the proposed development; and
WHEREAS, the City Commission desires to approve said application;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF DANIA BEACH, FLORIDA:
Section 1. That the Future Land Use Element and Map is amended as
described below:
THE FUTURE LAND USE PLAN ELEMENT OF THE LOCAL
COMPREHENSIVE PLAN OF THE CITY OF DANIA BEACH,
FLORIDA, IS AMENDED TO REDESIGNATE FROM
COMMERCIAL TO RESIDENTIAL MEDIUM HIGH (25) A PARCEL
OF LAND CONTAINING 9.913 ACRES MORE OR LESS
LOCATED ON THE NORTH SIDE OF SHERIDAN STREET
APPROXIMATELY 691 FEET WEST OF S.E. 5T"AVENUE IN THE
CITY OF DANIA BEACH CONTAINING THE FOLLOWING
DESCRIBED: ALL OF TRACT "A" OF SWEDE LAND,
ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT

Section 2. If any section, clause, sentence or phrase of this ordinance is
for any reason held invalid or unconstitutional by a court of competent
jurisdiction, the holding shall not affect the validity of the remaining portions of
this ordinance.
Section 3. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 4. This ordinance shall take effect immediately at the time of its
Passage. However, this plan amendment shall not become effective until the
conclusion of the process and time frames set out in Section 163.3187(3)(a) of
the Florida Statutes.

RE: LU-03-99 Guthard/Sheridan 400 Land Use Flex Amendment
Date: February 3, 1999
The site of this requested land use change is east of the current "Publix" Shopping
Center and west of the existing apartment complex on the north side of Sheridan Street.
The applicant is seeking a "small area amendment", as the site is less than ten acres
(9.913 acres). They are also seeking approval utilizing existing "flex units" seeking
approval to use 240 units of the City's existing inventory of 535 flexibility units and 177
available reserve units. (A copy of a memorandum from Leigh Kerr is attached.)
The project on the surface appears to have merit. There does not appear to be a
significant demand for additional commercial in this area while those multifamily projects
being currently developed seem to be highly successful. The multifamily is less demanding
on most services while providing an excellent landuse transition for the neighborhood lying
to the north.
Staff is concerned, however, about such a large bite out of the existing inventory of
flex units within this flexibility zone. These same units serve any potential redevelopment
of the City's downtown as well as the City Commission desires to provide for a mixeduse
development along the north side of Sheridan west of U.S. 1.
RECOMMENDATION
Staff would support a landuse change that modify the commercial to a multifamily
designation but not through the use of flexibility units involving such a significant portion of
the City's available inventory. Staff recommends that the applicant pursue this proposal by
seeking a small area amendment to the Broward County Plan. The Planning and Zoning
Board concurred in this recommendation. They recommend that the City Commission that
not approve this request as submitted. Staff would support the requested landuse change
if it were not intended to utilize flex for the entire project.

The City of Dania Beach has received a request for a land use plan antertdmeat t
Proposes to allocate Z00 +flexibility units. hat The amendment site is located on the north
side of Sheridan Street between Federal Highway and NE 5 h Avenue in Flexibility Zone
84. Flexibility Zone 84 currently contains 535 available flexibility units and 177 available
reserve units. This flexibility zone is bounded by the Dania Cut off Canal on the north, the
City Limits on the east and south; and Dixie Highway on the west. Two important
redevelopment areas are located within Flexibility Zone 84• a portion of the Broward
County Chapter 163 Redevelopment Area and the Downtown Core. Future
redevelopment in these areas would likely require the allocation of adwelling
units on redevelopment parcels. Core'

The Chapter 163 Redevelopment Area includes the Southwest Dania neighborhood
located between Federal Highway and Dixie Highway. Over the years, the City of Dania
Beach has expressed the need to maintain and enhance this neighborhood. Currently, the
Parcels adjacent to Sheridan Street are designated for high-density residential and
commercial development. However, due to right-of--way acquisition for Sheridan Street
improvements, these lots are very shallow and cannot support commercial and residential
developments with adequate parking, landscaping and setbacks. In the future, the City
May want to consider a quality mixed use development along the Sheridan Street corridor
to enhance the Southwest Dania area. A mixed-use development including retail, office
and residential uses for example would be appropriate for this location since Sheridan
Street is a major roadway corridor that traverses the City. This type of development
would improve the tax base of the City and help to stabilize the Southwest Dania area

Mother focal point of the City of Dania Beach redevelopment efforts is the downtown
core area. The Land Use Visioning Study conducted for the City highlights the need to
create a "sense of place' for the downtown corn. In order to create a vibrant activity
center for the downtown core, a residential component would be necessary to support
nonresidential development in the area.
The revised City of Dania Beach Comprehensive plan includes revisions that will assist
development of mixed-use projects throughout the City. However, these provisions
require the allocation of flexibility or reserve units. For example, the Commercial land use
category will allow residential units in mixed-use developments and Geestanding multi-
family residential uses on small parcels. In addition, the Downtown Development District
also includes provisions that will allow residential and commercial to exist in the same
building subject to certain criteria and the allocation of flexibility or reserve units.
Based on the long range planning efforts of the City of Dania Beach highlighted in the
Land Use Visioning Study, the City may wish to retain as many of the available flexibility
and reserve units in Flexibility Zone 84 for future redevelopment activities that support the
Land Use Visioning Study.

E) APPLICANTS RATIONALE FOR THE AMENDA4UT
The developer recently completed a multi-family residential project immediately
west of the amendment site. It is the intent to expand the development to include
the amendment site, thereby creating a unified development.
Without the amendment, and assuming a 25% building coverage, a 100,000
square foot shopping center could be built on the amendment site. However
immediately east of the amendment site is a large shopping center anchored by
Publix Supemarket. There are storefronts in this center that have remained vacant
for years. Plans for a proposed shopping center in Hollywood at the southeast
comer of SE 5th Avenue and Sheridan Street were abandoned. A large shopping
center exists approximately a mile north of the amendment site and a new Publix
is proposed a few miles west of the site. In addition, Oakwood Plaza, a mile west
of the site in Hollywood serves the area.
It is evident that there is no market currently for another shopping center. With
the Dania Beach/Hollywood area nearly built out, the demand for another
shopping center does not exist. The demand for commercial space created by the
future residents of the amendment site, should the amendment be adopted, will
not be significant.
The amendment will result in a reduction of solid waste generation and a
reduction of 5,573 daily trips. The increase in water and sewer demand can be
handled by the existing facilities
The Broward County Land Use Plan will not be amended. Currently Flex Zone
84 has 471 units. 240 flexibility units will be applied to the property, leaving 231
flex units in Flex Zone 84. The Broward County Planning Council will then
recertify the City of Dania Beach's local land use plan.

bedroom garden apartments generate a demand of 250 gallons per day
(GPD). Current level of service is 291 MGD.

Sanitary sewer service is provided under a Large User Agreement with the

48 Million Gallons per Day(48 MGD),the current(June 1998) demand is
27.1 MGD and the eommited demand is approximately 3 MGD.

Buildings shall have the lowest floor elevation no lower than the elevation
for the respective area depicted on the National Flood Insurance Rate Map

based on the 100 year flood elevation, or a minimum of 6 inches above the
crown of the adjacent public street, whichever is highest. Current level of
service of the City's drainage system is good. Once developed, unless all
drainage is retained on site, the project will be subject to a yearly

According to the Comprehensive Plan, the level of service standard is 8.9
lbs. per day per residential unit, 9 lbs. per day per 100 sq. ft. of
Supermarket, 5 lbs. per day per 100 sq. ft.of Drug Store and 4 lbs. per day
per 100 sq. ft. of Department Store. The current level of service is 600
tons per month.

The City of Dania Beach contracts with Reuter Recycling for solid waste
disposal. The Average Annual Tonnage for the City of Dania Beach
10,000 tons. The initial capacity of the plant in Pembroke Pines, opened
in 1990, is 200,000 tons per year. The contract allows that when the plant
capacity of 175,000 tons per year are reached, the plant capacity will be
increased by 100,000 tons per year to 300,000 tons per year.

The amendment site is located in the Plan B Zone (evacuation in a category 3 or higher
hurricane). The site is only a mile from the west end of the Plan C Zone(Category 4 or 5
hurricane). Sheridan Street, Interstate 95 and Stirling Roads are designated evacuation
routes. The nearest Shelter is Hollywood Hills High School at 5400 Stirling Road in
Hollywood. The development of the site will not adversely impact the evacuation times,
as the site is at least a mile west of the drawbridges over the Intracoastal Waterway.
10. REDEVELOPMENT ANALYSIS
Indicate if the amendment is located in an identified redevelopment area. If so, describe
how the amendment will facilitate redevelopment and promote existing redevelopment
plans:
The amendment site is located with in the County designated Urban In-fill Area. The
development of this site furthers the goal of the South Florida Regional Planning council
and other agencies in curbing urban sprawl and steer development back to the developed
eastern area. This initiative is known as "Eastward Ho!" While the site is vacant, and
hence is not being"redeveloped", the additional residents will provide a boost the City of
Dania Beach's downtown redevelopment/main street plans by generating potential
consumers for the downtown area.
11. INTERGOVERNMENTAL COORDINATION
Describe whether the proposed amembnent affects adjacent local governments:
The proposed amendment should have no affect on the City of Hollywood, the only
government"adjacent"to the site.
