HomeMy WebLinkAboutO-1999-006 r -r i �s LL epuoIJ 'goeag eiuep;o Fain f r, r 7 ORDINANCE NO.06.99 AN ORDINANCE PERTAINING TO THE SUBJECT OF SIGNS; AMENDING ARTICLE 2, SECTION 2.10 OF CHAPTER 28, ENTITLED "ZONING', OF THE CODE OF ORDINANCES OF THE CITY OF DANIA BEACH, FLORIDA, IN ORDER TO PROVIDE ADDITIONAL DEFINITIONS AND AMENDING ARTICLE 27, ENTITLED "SIGNS', OF CHAPTER 28; TO ADD NEW PROHIBITED SIGNS; TO REVISE PROVISIONS PERTAINING TO SIGN ADJUSTMENTS AND VARIANCES; TO REVISE PROVISIONS RELATING TO WALL SIGNS AND TO REAL ESTATE ADVERTISING SIGNS AND TO ALLOW FOR ENTRYWAY SIGNS FOR CERTAIN DEVELOPMENTS; PROVIDING A CONFLICT CLAUSE, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the following definitions are adopted and shall be codified and added in alphabetical order in Article 2, Section 2.10 of Chapter 28: Projecting pole sign shall mean a sign other than a flat wall sign which is attached to and projects perpendicular from a building wall or other structure not specifically designed to support the sign and is also supported by another means such as a pole or has attached to it other objects such as a pole. Residential multi-unit complexes or communities shall mean a group of structures that are either single family or multi-family or a combination of both that share some form of common management by a single entity and typically have one or more of the following: common entryway, common parking commonly maintained or used or both areas such as parking lots clubhouses, swimming pools community or mail centers or swale or median areas of rights-of-way: common theme or identity in appearance, or architecture in the layout of the structures in the complex or both. Section 2. That Section 27.060, entitled "Prohibited signs", is amended to add the following: 30. Projecting pole signs. Section 3. That Section 27.200, entitled 'Relief from requirements; sign adjustment; variances.", is amended to read as follows: 1 ORDINANCE NO. 06-99 1 L ■ r 7 27.200 Relief from requirements; sign adjustment; variances. An adjustment may be granted by the City Commission or granted with conditions (conditions must relate to the site and signs thereon) including the removal of other signs on the site after review and recommendation by the Planning and Zoning Board upon a showing by the applicant of the following: 5. The provisions of the South Florida Building Code ("SFBC") (or its successor Code) pertaining to unsafe structures SFBC Section 202 shall apply to signs that were permitted through the sign adjustment or variance process Section 4. That Section 27.095, entitled 'Residential multi-unit complexes or communities", is created to read as follows: 27.095 Residential multi-unit complexes or communities Residential multi-unit complexes or communities shall be allowed to have entryway signs at entryways to the complex or community. 1 Monument signs: One sign per entryway when the entryway has a minimum street frontage of three hundred (300) feet, with a maximum height of eight (8) feet a maximum overall width of fourteen (14) feet a maximum width of lettering of ten (10) feet and minimum setback from right-of-way line or clear recovery area, when applicable of twelve (12) feet: or 2 Wall signs: One wall sign per entryway on a perimeter wall when the wall or complex has a minimum street frontage of three hundred (300) feet. The height of the wall section bearing the sign shall not exceed eight (8) feet the width of combined lettering/logo shall not exceed twelve (12) feet and the height of individual letters shall not exceed fifteen (15) inches 3. Complex or community identification restrictions: Any sign, whether monument or wall shall only identify the one principal name of the general entitled complex or community. No additional (second or more) entitv(ies) or corporate identification containing either verbiage or logo shall be permitted 2 ORDINANCE NO. 06.99 A- f r 7 , r t r Section 5. That Section 27.110, entitled "Restrictions in areas zoned I commercial', is amended to add the following paragraph and the subsequent paragraphs shall be renumbered accordingly: 1. Signs at undeveloped Property. A sign may be permitted on unimproved parcels pertaining to Its sale lease or development of a size no more than sixteen (16) square feet when the parcel is four (4) acres In size or more Only one (1) sign per street front shall be permitted However, a second sign shall only be Permitted if the frontage on the rights-of way are at least three hundred (300) feet or more in width The sign dimensions of the second sign shall be reduced In accordance with the formula set out in Section 27.130. Parcels of under four (4) acres may have a sign Pertaining to its sale lease or development of a size no more than twelve (12) square feet Only one (1) sign per street front shall be permitted However, a second sign shall also be Permitted if the frontage on the rights-of-way are at least one hundred 100 feet wide. The dimensions of the second sign shall be reduced in accordance with the formula set out in Section 27.130. (b) Building identification wall signs. Total building identification wall sign area and height per building shall not exceed: height. (i) Sign area and (1) Sign area shall be no greater than the front footage of the building multiplied by 470 0_5. (2) Sign height shall not exceed hwe Av-five-(2-5) fifteen 15 percent of the building height. 3 ORDINANCE NO. 06-99 L t 1 r 7 (e� Leasing space signs Signs advertising the availability of space for lease shall be permitted in the following dimensions: A Minimum Percentage Minimum Of Building's Total Space/ Street Maximum Units Still Available Frontage Sign Area Eighty percent (80%) 300 or more feet 32 square ft Forty percent (40%) 200-299 feet 24 square ft. Less than forty percent (40%) 100-199 feet 16 square ft. One percent(1%) to one Hundred percent (100%) Less than 100 feet 12 square ft (Maximum sign area shall be calculated on the minimum space still available or the minimum street frontage whichever is the less.) Section 6. That Section 27.160, entitled "Downtown Dania Beach Redevelopment District sign regulations", is amended to read as follows: 27.160. Downtown Dania Beach Redevelopment District sign regulations. 1. Scope. Notwithstanding any provision in this Article to the contrary, this section provides the requirements for signs in the area bounded generally by: Old Griffin Road on the north; by Third Avenue on the west; by Stirling Road on the south; and on the east by Third Avenue south of Dania Beach Boulevard and Fronton Boulevard north of Dania Beach Boulevard. This area shall be known as the Downtown Dania Beach Redevelopment District. 2. Permitted signs. Signage in the Downtown Dania Beach Redevelopment District shall be in accordance with the following requirements unless exempted by Section 27.050: (b) Flat wall signs. Flat wall signs may be erected parallel to the face of or on the outside wall of, any building and 4 ORDINANCE NO. 06-99 L .. .f L - e r 7 supported throughout their length by such wall. Flat wall signs shall be permitted subject to the following conditions: (i) A flat wall sign shall extend no more than eighteen (18) inches beyond the building face. (ii) Total flat wall signage shall not exceed twe-aad one (1) square foot per each one linear foot of building frontage, subject to the following additional requirements: 3. Compliance required. All signs within the Downtown Dania Beach Redevelopment District of the City of Dania Beach, shall be required to comply with the regulations of this section, as amended, by removal or modification no later than ninety (90) days from the adoption of this ordinance. 4. Review Procedure. Except as otherwise provided in this section, all signs require plan approval and permits from the City of Dania Beach department of growth management. Appeals from adverse decisions shall be decided by the city commission, as set out in Article 10, Section 10.30, entitled, "Appeals", of Chapter 28. Section 7. That Section 27.190, entitled "Non-conforming signs", is amended to read as follows: 27.190. Non-conforming signs. 4. All other types of signs which were lawfully erected and which no longer meet the zoning requirements of the City of Dania Beach zoning ordinance are declared nonconforming and shall be removed or brought in to conformance with the zoning ordinance no later than ninety (90) days from the date of adoption of this ordinance, except as provided in subsection 3 of Section 27.160 of this Article for signs located in the Downtown Dania Beach Redevelopment District. Section 8. All ordinances or parts of ordinances in conflict herewith shall be, and the same are, hereby repealed to the extent of such conflict, except that this ordinance shall not repeal or alter any amortization period for nonconforming signs established by any previously adopted ordinances. 5 ORDINANCE NO. 06-99 r- .. f r, r 7 Section 9. If any section, sentence, clause, or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then the holding shall in no way affect the validity of the remaining portions of this ordinance. Virta, AICP Growth Management Director RE: Proposed Amendment to the New Sign Code Date: February 17, 1999 Shortly after the adoption of the new Sign Ordinance Commissioner Etling proposed and the Commission agreed that an amendment to it should be prepared. The attached draft ordinance is in direct response to that proposal. It provides for greater clarification within the existing Ordinance as well as further restricts certain dimensional requirements. Two definitions will be added if this proposal is approved. The first definition is for projecting pole signs. This defines certain signs that are hybrids between pole and projecting signs and following provides for their regulation. The second definition is residential multi-unit complexes or communities. This definition is provided so that standards can then be included to provide for such signage. The draft ordinance also provides some guidance as to the size of leasing signs in relation to the amount of the project available for lease and the frontage of the property. Lastly there is an amendment to the downtown sign regulations providing a wall sign standard that is comparable to that allowed citywide. At your first reading of this proposal Commissioner Etling offered some additional language modifications which are included in the attached draft and shown in bold type. These modifications were offered as clarifications and are not intended to alter the substance of the original amendments. The Planning and Zoning Board reviewed this proposed ordinance at their February 3, 1999 meeting.
