BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the rezoning request filed by Kevin Guthard, representative for Trafalgar Associates, Inc., for property legally described in Exhibit "A", a copy of which is attached to this ordinance and which is located within the City of Dania Beach, Florida, is granted and the property is rezoned from its present zoning classification of C-2 (Commerical) to RM-2 (Residential Medium High Multifamily — 25 units per acre) zoning classification. Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. Section 3. That this ordinance shall take effect upon the recording and filing of the document identified above in the Broward County Pubilc Records. Virta, AICP Growth Management Director RE: RZ-17-99 Rezoning Ordinance— Swede Land Date: May 4, 1999 The City Commission as a small area comprehensive plan amendment previously reviewed this site. At that time the applicant sought to use flex so that the City Plan could be amended while the County Plan remained constant. The City Commission approved the amendment with the use of Flex as requested. This request is to rezone the site from commercial to multifamily. The rezoning is completely compatible with the change in the City's Comprehensive Plan. The RM-2 Medium-High Zoning District allows for a maximum development of 25 units per acre. This project is proposed at a density of 24.76 units per acre. Mr. Aliaga is requesting relief from the 5 foot buffering requirement and proposes to install additional landscaping in the front and year yards.
