ORDINANCE NO. 03-99
AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING
SECTION 6.21, WHICH SECTION IS ENTITLED"OFF-STREET PARKING',
OF CHAPTER 28, ENTITLED "ZONING', OF THE CODE OF ORDINANCES
OF THE CITY OF DANIA BEACH, FLORIDA, TO PROVIDE A
REGULATION WHICH WILL REQUIRE THE PROVISION OF PARKING
SPACES FOR OCCUPANTS OF GAMBLING BOATS; FURTHER,
CHANGING THE CURRENT PARKING REQUIREMENTS FOR YACHT
CLUBS, BOAT MARINAS, CHARTER BOATS AND SIGHTSEEING BOATS;
PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND
ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT ARE
REPEALED TO THE EXTENT OF SUCH CONFLICT; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That subparagraph (c) (entitled "Number of parking spaces required"),
paragraph 21 of the "Schedule of Off-Street Parking Requirements" of Section 6.21 of
Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach, which Section
is entitled "Off-Street Parking", is amended to read as follows:
21. Yacht club, boat marina, Seven-tenths (0.7) spaces
charter boat,sightseeing per each slip plus one space
boat or gambling boat per each feui: (4) two 2
persons allowed within
maximum occupancy of charter,
of sightseeing gr_gamblinci
boat. Other uses operated in
conjunction with the primary
use shall provide parking as if
such uses were operated
separately.
Section 2. That except as amended, all other provisions of Section 6.21, Chapter 28 of
the Code of Ordinances of the City of Dania Beach, Florida, as previously amended, shall
remain in full force and effect.

Section 3. If any section, clause, sentence or phrase of this ordinance is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this ordinance.
Section 4. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed.
Section 5. That this Ordinance shall be in force and take effect immediately upon its final
passage and adoption.

RE: Parking Standards Ordinance
Date: January 19, 1999
Attached is a copy of an amendment to the parking standards found in the zoning
ordinance. It changes the standard for charter and sightseeing boats from one space
for each four persons to one space for each two persons. It also adds to the listing
gambling boat and applies the standard of one space for each two persons. This
standard was arrived at through consultation with staff from the City of Hollywood who
have benefited from having a gambling boat parked in their community. The Planning
and Zoning Board recommends that you approve this amendment to the parking
standards found in the zoning ordinance.
The Board asked that staff make certain changes to the draft ordinance. City
Attorney Ansbro cautioned that it would be safer to adopt and subsequently amend the
regulation. To that end staff is planning on having a revised Ordinance to the Planning
and Zoning Board for their review at their February Meeting. Staff recommends that the
City Commission adopt this Ordinance on Second Reading.
